There is also compelling evidence that he committed perjury in his confirmation hearing. Nor does it rely on the accuracy of her recollection or the truthfulness of her testimony, without unimpeachable corroboration. Moreover, Mr. Kavanaugh's false testimony in September 2018 was originally planned by him in July 1982, shortly after the attempted rape of Dr. Ford. So, the theory that Mr. Kavanaugh honestly believed in his innocence when he testified with such emotion and indignation to the Judiciary Committee is nonsense. *The evidence supporting those conclusions is in plain sight, and the significance of the evidence is not subject to reasonable dispute. However, the facts are sufficiently clear as the record now stands both to remove Mr. Kavanaugh from the Supreme Court for judicial misconduct and to commence an investigation that should lead to his prosecution. Indeed, his removal from the bench should be inevitable in my opinion. *There is evidence of abhorrent conduct by Senate Republicans related to the confirmation of Mr. Kavanaugh. They suppressed evidence of Dr. Ford's credibility; ignored evidence of his dishonesty; and conducted a smear campaign against a victim of sexual assault, based on lies, while pretending to be concerned about sexual assault victims. Even worse, the Republicans engaged in that pattern of dishonest conduct for the purpose of confirming to the Supreme Court someone they had reason to know at the time was probably an attempted rapist and a repetitive perjurer. So, the Republican senators engaged in abhorrent conduct to achieve an abhorrent objective. However, as detailed in the discussion, Mr. Kavanaugh is now revealed to be an actual attempted rapist and perjurer. *The significance of the conduct of Republicans in the Kavanaugh confirmation proceedings goes beyond those proceedings and beyond the Senate. Their conduct reveals the existence of a Republican playbook comprised of a series of pernicious operating principles that are designed to deceive and defraud voters. An awareness of the playbook of operating principles provides a new basis for understanding the conduct and objectives of Republicans as a group and for reinterpreting our understanding of the American political universe. For example, the discussion reveals that the confirmation of Mr. Kavanaugh by the Senate Republicans, despite his status as a likely attempted rapist, is probably a conscious part of a broader Republican effort to oppose the progress made by the #metoo movement. *Moreover, our new understanding of the Republicans' conduct and objectives has significant implications with respect to the effectiveness of media coverage of Republicans and Democrats and of political events, past and present. *It falls to the House Judiciary Committee to respond to Mr. Kavanaugh's confirmation and to his conduct during the confirmation proceedings. My expectation is that, at the end of the day, Justice Kavanaugh will be impeached and that he will resign or be convicted, given the weight of the evidence that he will face following a competent investigation of his conduct.

Book excerpt: In an ideal world, the laws of Congress--known as federal statutes--would always be clearly worded and easily understood by the judges tasked with interpreting them. But many laws feature ambiguous or even contradictory wording. How, then, should judges divine their meaning? Should they stick only to the text? To what degree, if any, should they consult aids beyond the statutes themselves? Are the purposes of lawmakers in writing law relevant? Some judges, such as Supreme Court Justice Antonin Scalia, believe courts should look to the language of the statute and virtually nothing else. Chief Judge Robert A. Katzmann of the U.S. Court of Appeals for the Second Circuit respectfully disagrees. In Judging Statutes, Katzmann, who is a trained political scientist as well as a judge, argues that our constitutional system charges Congress with enacting laws; therefore, how Congress makes its purposes known through both the laws themselves and reliable accompanying materials should be respected. He looks at how the American government works, including how laws come to be and how various agencies construe legislation.
