Available in PDF, EPUB and Kindle. Book excerpt: The emergence of a common security and foreign policy has been one of the most contentious issues accompanying the integration of the European Union. In this book, Michael Smith examines the specific ways foreign policy cooperation has been institutionalized in the EU, the way institutional development affects cooperative outcomes in foreign policy, and how those outcomes lead to new institutional reforms. Smith explains the evolution and performance of the institutional procedures of the EU using a unique analytical framework, supported by extensive empirical evidence drawn from interviews, case studies, official documents and secondary sources. His perceptive and well-informed analysis covers the entire history of EU foreign policy cooperation, from its origins in the late 1960s up to the start of the 2003 constitutional convention. Demonstrating the importance and extent of EU foreign/security policy, the book will be of interest to scholars, researchers and policy-makers.

This book was released on 1998-10-31 with total page 306 pages. Available in PDF, EPUB and Kindle. Book excerpt: Small States in and outside the European Union offers a broad overview of the small states problematic in Europe. It touches upon definition issues, history, security policy, neutrality, EU institutional aspects and also includes contributors from Central and Eastern European countries. It presents a thorough analysis of different scenarios for EU institutional reform and their repercussions on the influence of small member states. The comparative results are visualized in tables. The work contains several contributions from practitioners who give insight into policy games and issues of national sensitivity not usually covered by purely scholarly publications. The European environment has changed dramatically through the processes of regional integration and rising interdependence. Relations between European states both inside and outside the EU are governed as never before by rules, norms, and fixed procedures. The book investigates the consequences of these developments on the foreign and security policy of small states. Academics and professionals from Austria, Denmark, Finland, Ireland, Lithuania, Luxembourg, Slovenia, Sweden, and Switzerland, as well as from the European Commission and the Council of Ministers, elaborate on these issues. Institutional regulations and traditional power politics as well as the foreign and security policy traditions of the states concerned, including the question of neutrality, are investigated. In addition, the book identifies the main interests of small states in today's Europe and offers an overview of different strategies these states apply in the realm of foreign and security policy. The book is interesting for the case studies it offers as well as for the reflections it contains regarding fundamental questions of the essence of statehood in today's Europe.

Book excerpt: The major Commentary on the Treaty on European Union (TEU) is a European project that aims to contribute to the development of ever closer conceptual and dogmatic standpoints with regard to the creation of a “Europeanised research on Union law”. This publication in English contains detailed explanations, article by article, on all the provisions of the TEU as well as on several Protocols and Declarations, including the Protocols No 1, 2 and 30 and Declaration No 17, having steady regard to the application of Union law in the national legal orders and its interpretation by the Court of Justice of the EU. The authors of the Commentary are academics from ten European states and different legal fields, some from a constitutional law background, others experts in the field of international law and EU law professionals. This should lead to more unity in European law notwithstanding all the legitimate diversity. The different traditions of constitutional law are reflected and mentioned by name thus striving for a common framework for European constitutional law.

Available in PDF, EPUB and Kindle. Book excerpt: The role of national parliaments in EU matters has become an important subject in the debate over the democratic legitimacy of European Union decision-making. Strengthening parliamentary scrutiny and participation rights at both the domestic and the European level is often seen as an effective measure to address the perceived ‘democratic deficit’ of the EU – the reason for affording them a prominent place in the newly introduced ‘Provisions on Democratic Principles’ of the Union (in particular Article 12 TEU). Whether this aim can be met, however, depends crucially on the degree to which, and the manner in which, national parliaments actually make use of their institutional rights. This volume therefore aims at providing a comprehensive overview of the activities of national parliaments in the post-Lisbon Treaty era. This includes the ‘classic’ scrutiny of EU legislation, but also parliamentary involvement in EU foreign policy, the use of new parliamentary participation rights of the Lisbon Treaty (Early Warning System), their role regarding the EU’s response to the Eurozone crisis, and the, so far under-researched, role of parliamentary administrators in scrutiny processes. This book was originally published as a special issue of West European Politics.

Book excerpt: Provided for under the Treaty of Lisbon, the accession of the European Union to the European Convention on Human Rights is destined to be a landmark in European legal history because it will finally make it possible for individuals and undertakings to apply to the European Court of Human Rights for review of the acts of European Union institutions, which unquestionably play an increasingly important role in our daily lives. After nearly three years of negotiations, a draft agreement on European Union accession was adopted on 5 April 2013. In the light of the draft agreement, this publication offers a concise analysis of the reasons for European Union accession to the Convention, the means by which this is to be achieved and the effects it will have.

Book excerpt: The European Union Intergovernmental Conference (IGC) opened on 23 July 2007 and was initiated following a report originally produced by the German Presidency on the "Treaty establishing a Constitution for Europe" (Constitutional Treaty, Cm.6429, ISBN 9780101642927), which in turn led to a "Draft IGC Mandate" setting out a detailed prescription on issues raised by the above report, circulated by the Presidency of the European Council. The report itself recommended a "Reform Treaty" which would amend existing treaties and so required an intergovernmental conference. The European Scrutiny Committee has set out a number of conclusions, including: the Committee questioned the aims of the European Council in engaging with EU citizens on the EU Constitution whilst setting out changes to the constitution in an essentially secretive manner; that the substance of the Reform Treaty is substantially equivalent to the Constitutional Treaty itself; the Committee is concerned about the UK's position under the Charter; that the UK retains opt-outs that were previously arranged under the Constitutional Treaty will still be retained under the Reform Treaty; that the proposals in the Reform Treaty raise a serious difficulty of a constitutional order, appearing to impose a legal duty on national parliaments to the European Union itself, the Committee calls such a legal duty on Parliament, objectionable, and states that as a matter of principle it should be resisted.

Available in PDF, EPUB and Kindle. Book excerpt: The radical changes taking place in the international scene during the late 1980s have presented the European Communities with important new challenges. The twelve Member States agreed that the only way to respond effectively to this new situation was to speed up the European integration process, and in December 1990 two Intergovernmental Conferences were inaugurated, focusing respectively on the development of an Economic and Monetary Union and a Political Union. It was the difficult task of the Luxembourg and Dutch Presidencies to channel the often very diverging positions of the different actors in the process into one coherent set of amendments to the Treaties forming the European Communities. This publication examines the positions which the different Member States, the Commission and the European Parliament have been defending in the Intergovernmental Conference on Political Union and more particularly with regard to one of the most sensitive topics under discussion, namely the development of a Common Foreign and Security Policy (CFSP). The introduction places the debate on the development of a Political Union and a CFSP in an historical perspective and gives an overview of the progression of the negotiations. The concluding chapter presents a general framework for better understanding of the course and results of the negotiations, and a critical evaluation of the outcome. The annexes reproduce the main proposals on the development of a CFSP submitted to the Conference.
