Available in PDF, EPUB and Kindle. Book excerpt: The concept of customary international law, although differently formulated, is already present in early modern European debates on natural law and the law of nations. However, no scholarly monograph has, until now, addressed the relationship between custom and the European natural law and ius gentium tradition. This book tells that neglected story, and offers a solid conceptual framework to contextualize and understand the 'problematic of custom', namely how to identify its normative content. Natural law doctrines, and the different ways in which they help construct human reason, provided custom with such normative content. This normative content consists of a set of fundamental moral values that help identify the status of custom as either a fundamental feature or an original source of ius gentium. This book explores what cultural values and practices facilitated the emergence of custom and rendered it into as a source of the law of nations, and how they did so. Two crucial issues form the core of the book's analysis. Firstly, it qualifies the nature of the interrelation between natural law and ius gentium, explaining why it matters in relation to our understanding of the idea of custom. Second, the book claims that the process of custom formation as a source of law calls into question the role of the authority of history. The interpretation of the past through this approach can thus be described as one of 'invention'.

Book excerpt: The original Latin text of Johann Gröning’s Navigatio libera has never before been translated into any modern vernacular language. Gröning’s intention was to set out the position of neutral nations (in this case the Danes and Swedes), and their right to pursue trade during the wars of the great maritime powers (particularly the English and the Dutch). It specifically sought to engage with and refute the work of Hugo Grotius while taking cognisance of the critique of Gröning’s work by Samuel Pufendorf. The text serves as a bridge between 17th-century polemical discourse surrounding the ‘free sea’ versus ‘enclosed sea’ debate and later 18th-century legal literature on the rights of neutrals and the continuation of free trade in time of war.

Before Anarchy offers a novel account of Hobbes's interpersonal and international state of nature and rejects two dominant views. In one, international relations is a warlike Hobbesian anarchy, and in the other, state sovereignty eradicates the state of nature. In combining the contextualist method in the history of political thought and the historiographical method in international relations theory, Before Anarchy traces Hobbes's analogy between natural men and sovereign states and its reception by Pufendorf, Rousseau and Vattel in showing their intellectual convergence with Hobbes. Far from defending a 'realist' international theory, the leading political thinkers of early modernity were precursors of the most enlightened liberal theory of international society today. By demolishing twentieth-century anachronisms, Before Anarchy bridges the divide between political theory, international relations and intellectual history.

Book excerpt: Studies of Gottfried Leibniz's moral and political philosophy typically focus on metaphysical perfection, happiness, or love. In this new reading of Leibniz, Christopher Johns shows that it is based on a 'science of right'. Based on the deontic concepts of jus (right) and obligation, this science of right is established in Leibniz's early writings on jurisprudence and depended on throughout several of his major late writings. Johns shows that the moral rightness of an action is grounded in the rights and obligations derived from the agent's capacity for freedom. This new interpretation of Leibniz's moral philosophy compares Leibniz's positions with Grotius, Pufendorf, Hobbes, Locke, and Kant. Providing a comprehensive examination of Leibniz's most important writings on natural right, John's argues that Leibniz, properly understood, provides a compelling account of the grounds of morality and of political institutions-an account relevant to present philosophical debates.

Available in PDF, EPUB and Kindle. Book excerpt: Millions of Africans were enslaved and transported to the Americas in the eighteenth century. Europeans--many of whom viewed themselves as enlightened--endorsed, funded, legislated, and executed the slave trade. This atrocity had a profound impact on philosophy, but historians of the discipline have so far neglected to address the topics of slavery and race. Many authors--including enslaved and formerly enslaved Black authors--used philosophical ideas to advocate for abolition, analyze racist attitudes, and critique racial bias. Other authors attempted to justify the transatlantic slave trade by advancing philosophical defenses of racial chattel slavery. Slavery and Race: Philosophical Debates in the Eighteenth Century explores these philosophical ideas and arguments, with a focus on the role race played in discussions of slavery. In doing so, author Julia Jorati reveals how closely associated Blackness and slavery were at that time and how many White people viewed Black people as naturally destined for slavery. In addition to examining well-known authors like David Hume, Immanuel Kant, and Jean-Jacques Rousseau, Jorati also discusses less widely studied philosophers like Quobna Ottobah Cugoano, Lemuel Haynes, and Olympe de Gouges. By revealing important aspects of debates about slavery in North America and Europe, this book and its companion volume on the sixteenth and seventeeth centuries are valuable resources for readers interested in a more complete history of early modern philosophy.
