Committee on the Effectiveness of Safety and Environmental Management Systems for Outer Continental Shelf Oil and Gas Operations and published by Transportation Research Board National Research. This book was released on 2012 with total page 140 pages. Available in PDF, EPUB and Kindle. Book excerpt: This report recommends that the Bureau of Safety and Environmental Enforcement (BSEE) take a holistic approach to evaluating the effectiveness offshore oil and the Safety and Environmental Management Systems (SEMS) programs of gas industry operators. According to the report, this approach should, at a minimum, include inspections, audits by the operator and BSEE, key performance indicators, and a whistleblower program. SEMS is a safety management system (SMS) aimed at shifting from a completely prescriptive regulatory approach to one that is proactive, risk based, and goal oriented in an attempt to improve safety and reduce the likelihood that events similar to the April 2010 Macondo incident will reoccur. According to the committee that produced the report, it is not possible for a regulator to create a culture of safety in an organization by inspection or audit; that culture needs to come from within the organization. To be successful, the tenets of SEMS must be fully acknowledged and accepted by workers, motivated from the top, and supported throughout the organization and must drive worker actions. The report also notes that BSEE can encourage and aid industry in development of a culture of safety by the way it measures and enforces SEMS. The committee believes BSEE should seize this opportunity to make a step change in safety culture by adopting a goal based holistic approach to evaluating the effectiveness of SEMS programs. In recommending a holistic approach to evaluating the effectiveness of SEMS programs, the report explores in detail the role of SEMS in helping to develop a culture of safety, highlights the pros and cons of various methods of assessing the effectiveness of a SEMS program, and investigates existing approaches for assessing the SMS programs of various U.S. and international regulatory agencies whose safety mandates are similar to that of BSEE.

Book excerpt: Global findings estimate that 80 per cent of marine pollution originates from land-based sources and is trans-boundary in nature. These problems persist in spite of a number of legal and policy initiatives taken to protect the marine environment. This volume explores the applications and shortcomings of current international regimes in addressing these issues. The book identifies the sources and effects of land-based marine pollution and analyzes the problems of controlling them. Management principles, policy and regulation are examined at both regional and international level. The author discusses the strengths and weaknesses of existing regimes and advances a more effective international legal framework. The text provides a valuable insight into an important area of international environmental law. It will be of interest to researchers and policy-makers working in this area.

Book excerpt: In Regional Co-operation and Protection of the Marine Environment Under International Law: The Black Sea, Nilufer Oral examines the regional co-operation mechanism for protection and preservation of the Black Sea marine environment within the framework of international law, and subsequently identifies the necessary components for a robust regional regime based on best legal practices. The book provides a thorough review of the complex modern challenges related to the Black Sea, with particular emphasis on biodiversity, fisheries, land-based pollution and vessel-based sources of pollution. A history of regional co-operation in the Black Sea offers an enlightening comparison to the development of regional co-operation in international law, in particular, to Part IX of the 1982 United Nations (Montego Bay) Convention on the Law of the Sea. Further comparative analyses, such as the existing regional regime of the Black Sea as established under the 1992 UNEP Regional Seas Programme, and selected regional seas programmes, including the acquis communautaire of the European Union, cohere into a firm foundation of present findings, upon which basis the author makes recommendations for the future. All those interested in the Law of the Sea, international environmental law, and fisheries management will find a critical new text in Regional Co-operation and Protection of the Marine Environment Under International Law: The Black Sea.

Book excerpt: Despite the potential benefits that the IMO's Particularly Sensitive Sea Area (PSSA) designation can deliver, recent practice within the IMO and by individual member states has considerably undermined confidence in this emerging concept. The focus of this book is on the events within the IMO that have led to this lack of confidence arising. In the process, this book presents an examination of coastal State practice with the PSSA concept.

Available in PDF, EPUB and Kindle. Book excerpt: Despite widespread popular support for environmental action, Phillip F. Cramer argues that current U.S. environmental policy approaches fail to address the real threat of environmental insecurity. Cramer traces this failure to a reluctance to recognize and address the interconnectedness of natural forces--just as all elements within the environment are linked, so too should our perspectives on, and responses to, environmental degradation be linked. In this book Cramer provides an innovative holistic approach to environmental protection that incorporates the best lessons learned from the fields of biology, ethics, philosophy, political science, law, ecology, and international relations. He especially advocates local action and, providing illustrative examples, demonstrates how local action around the world is most effective when carried out within a global framework that supports information dissemination and international coordination. This book will energize to thought and action any scholar, student, or general reader concerned with environmental issues and our current trajectory toward environmental decay.

Available in PDF, EPUB and Kindle. Book excerpt: How can we best protect the polar marine environment against pollution? Leading scholars on environmental law, the law of the sea, and Arctic and Antarctic affairs here examine this important question. To what extent do existing global instruments of environmental protection apply to the Arctic Ocean and the Southern Ocean? Can the arrangements adopted at regional, sub-regional and national levels provide adequate protection? This book examines and compares various levels of regulation in protecting the marine environment of the Arctic and Antarctic, with specific attention to land-based activities, radioactive waste dumping, and shipping in ice-covered waters. Developments since the establishment of the Arctic Council in 1996 and the entry into force of the Protocol on Environmental Protection to the Antarctic Treaty in 1998 are also discussed. This is a volume that will appeal to polar specialists and to all those interested in environmental law and policy.
