Book excerpt: "What matters is not so much that Žižek is endorsing a demythologized, disenchanted Christianity without transcendence, as that he is offering in the end (despite what hesometimes claims) a heterodox version of Christian belief."--John Milbank"To put it evenmore bluntly, my claim is that it is Milbank who is effectively guilty of heterodoxy, ultimately ofa regression to paganism: in my atheism, I am more Christian than Milbank."--SlavojŽižekIn this corner, philosopher Slavoj Žižek, a militant atheist who representsthe critical-materialist stance against religion's illusions; in the other corner, "RadicalOrthodox" theologian John Milbank, an influential and provocative thinker who argues thattheology is the only foundation upon which knowledge, politics, and ethics can stand. In TheMonstrosity of Christ, Žižek and Milbank go head to head for three rounds, employing animpressive arsenal of moves to advance their positions and press their respective advantages. By theclosing bell, they have not only proven themselves worthy adversaries, they have shown that faithand reason are not simply and intractably opposed. Žižek has long been interested in theemancipatory potential offered by Christian theology. And Milbank, seeing global capitalism as thenew century's greatest ethical challenge, has pushed his own ontology in more political andmaterialist directions. Their debate in The Monstrosity of Christ concerns the future of religion, secularity, and political hope in light of a monsterful event--God becoming human. For the firsttime since Žižek's turn toward theology, we have a true debate between an atheist and atheologian about the very meaning of theology, Christ, the Church, the Holy Ghost, Universality, andthe foundations of logic. The result goes far beyond the popularized atheist/theistpoint/counterpoint of recent books by Christopher Hitchens, Richard Dawkins, and others.Žižek begins, and Milbank answers, countering dialectics with "paradox." Thedebate centers on the nature of and relation between paradox and parallax, between analogy anddialectics, between transcendent glory and liberation. Slavoj Žižek is a philosopher andcultural critic. He has published over thirty books, including Looking Awry, The Puppet and theDwarf, and The Parallax View (these three published by the MIT Press). John Milbank is aninfluential Christian theologian and the author of Theology and Social Theory: Beyond Secular Reasonand other books. Creston Davis, who conceived of this encounter, studied under both Žižekand Milbank.

Available in PDF, EPUB and Kindle. Book excerpt: This book discusses the law of safeguard measures as laid down in the WTO agreements and cases decided by the Panel and the Appellate Body. It sets out a comprehensive treatment of safeguard measures covering the history and evolution of the law, as well as the procedural requirements and the application of safeguard measures. In addition to measures under Article XIX and the Safeguards Agreement, the book includes coverage of safeguard measures for agricultural products, Special Safeguard Measures for developing countries, safeguard measures for textiles and proposed safeguard measures under General Agreement on Trade in Services (GATS) as well as special safeguard clauses against China. Recognition and Regulation of Safeguard Measures Under GATT/WTO considers safeguards from a developing country’s perspective drawing on Joseph E. Stiglitz’s argument that developing countries require these trade remedy measures to protect their domestic industries and ensure their development. Sheela Rai considers this view and goes on to examine how beneficial the provisions relating to safeguard measures and their interpretation given by the Panel and Appellate Body have been for developing countries.

Book excerpt: Drawing upon Fernando Piérola-Castro's extensive experience as a WTO practitioner, this book is a comprehensive and up-to-date overview of safeguard measures. With each chapter exploring a different provision of the agreement, it explores the relevant rules and procedures that govern safeguard investigations, the imposition of measures, the question of consultations and rebalancing and the multilateral transparency requirements of notification. Grounded in relevant case law, this book emphasises practice, logistics and risk management. Without focussing on the practice of any particular jurisdiction, it offers a general framework that can be applied to several domestic laws. It is a practical manual with the view of assisting in day-to-day problems in the handling of safeguard matters.

Book excerpt: This thesis examines Article XIX of the General Agreement on Tariffs and Trade, the "safeguard" provision, which allows states that experience an unexpected disruption or downturn in a domestic industry, caused by increased imports resulting from GATT trade concessions, to temporarily suspend, on a non-discriminatory basis, the GATT obligations that caused the disruption. Alan O. Sykes, based on his application of public choice theory to the behaviour of the signatory states, has argued that the safeguard provision is a necessary component of the GATT, since without it states would have lacked the incentives to enter into the GATT, and the present agreement would unravel. By contrast, I analyze rationales for the safeguard regime from a 'two-level game' perspective, incorporating international as well as domestic incentives. I conclude that states will comply with a more restrictive safeguard regime than that advocated by Sykes, and propose reforms to the current regime accordingly.

Book excerpt: The General Agreement on Trade in Services (GATS) along with other agreements was concluded in the Uruguay Round of Multilateral Trade Negotiations in 1994. However, negotiations continued within the WTO framework and are still a work in progress on some specific issues under the GATS including the question of Emergency Safeguard Measures, which has been raised in Article X of the GATS as part of its 'built-in agenda'. The thesis looks at the concept of the Emergency Safeguards Measures (ESMs) in the GATT/WTO and tries to develop an answer to the 'question of ESMs', which is deluding the negotiators and researchers for more than fifteen years. The thesis tries to analyse whether the GATT type ESMs can be transposed to GATS. It also explores that whether ESMs that are modelled on GATT are feasible under GATS, and if feasible, are these really desirable. If these are feasible and desirable then what should be their possible structure remaining within the existing GATT paradigm. The thesis walks through the provisions that already exist in the GATS to meet the circumstances perceived by the countries that are seeking specific ESMs under GATS and whether these provisions address the concerns of the demanders of the concept. The thesis not only takes into account the academic and legal literature on the subject but also and perhaps more practically, takes into account the dynamics of the negotiations, discussions and debates within the WTO system on the subject. The thesis tries to provide an in-depth analysis of the issue and goes beyond what is already available in the International Trade Law literature on the ESMs under the cross border trade in services. It seeks to answer a question that presently exists in the International Trade Law especially with reference to the law emerging out of WTO.
