Book excerpt: Excerpt from The Pathway of Safety: Or Counsel to the Awakened I write this book specially for one class of persons - not a very large class I fear, but certainly a very important class. These pages contain some christian counsel for those, who, through God's mercy, have been awakened out of their spiritual sleep, and who now feel that there is a great journey before them, and a happy land which they are most anxious one day to reach. And, if I mistake not, these are the very persons who are ready to receive, with a hearty welcome, a little advice from one who is desirous to lead them right. Book excerpt: Excerpt from The Life and Adventures of a Limb of the Law The law was originally designed for the furtherance of justice and the preservation of right, or, in other words, to [protect the innocent, and secure punishment to the guilty; but when instances daily occur of the very reverse of these principles prevailing, in the defeat of the honest man's claim, and in the rescinding of com tracts which parties entered into with their eyes open, either through the dexterity of counsel in discovering what is vulgarly termed a flaw, or from non-confon mity with some of those absurd Forms that have been handed down to us from time immemorial, and conse crated by use, an inference may fairly be drawn that the law has been perverted to uses for which it was never intended; and, instead of being a stafl' to the ia nocent and a terror to the guilty, it has thrown its shield around the dishonest and unprincipled portion of the community, for whose correction and punish ment it was intended. How to do that depends very much upon the tact of the lawyer; a client you must have no matter at what cost or how you manage it; and it must be a real, live one. After you have him, to be sure of him, always demand a retainer. Retainers have made many lawyers rich. You can usually do this by telling him it is the rule of your othee; ind insures good faith on his part. Give him a receipt for it, to insure good faith on your part. If you are a young practitioner, it is a good plan to take down on paper all the circumstances connected with the case; then tell him you are verv busy, and, that as the case will not need your immediate attention he had better go home and return in a few days. The point is this: it gives you time to look up the authorities, and impresses the client with the fact that you are the. Gowen, of Counsel for the Commonwealth If this be so, how much more credit should be given to the iden tification by a human being. How much more to identification by a mother clinging to her offspring to keep him from danger, when the picture of the assassin is presented before her Did you hear the remark that Mrs. Williams made when she was cross examined 'by one of my learned friends? When she was asked how can you tell this man, by his profile or by his full face she answered: by his profile; for that was all I saw. But she said something else: It seems to me that I could always see that face. In the dark visions of the night it was ever before her, and the face -of the murderer was ever haunting the witness whom Providence had appointed for his identification. We did not know that she knew this. She was not subpoenaed as a witness. We be lieved, acting for the Commonwealth, that we had done all that we could to ferret out these offenders; but you can see that there are some things which human ingenuity, human sagacity and human endurance will omit and will neglect, and I can safely say that it looks to me as if the finger of God was here revealed, and as if it unerringly pointed out the evidence which the officers of the Commonwealth had not been able to secure. The husband of this woman had been subpoenaed and had come here as awitness, and she accompanied him. The husband was excluded from Court, but she was not. She came into the Court room and the moment she saw the profile of this pris oner sitting at this table, sitting among two or three men, with noth1ng upon his person or in his countenance to indicate that he was the prisoner. With no previous knowledge on, r part that this was the man who was being tried, but simply g him sitting there facing the table, with his profile toward her as she sat among the audience, she said to those around her: That is the man I saw passing the road when I was holding my son that morning. Of course the report was brought to us at the counsel table, and we put her on the stand. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from The Confessions of an Attorney Let it not be forgotten either that the attorney is the only real, practical defender of the humble and needy against the illegal oppressions of the rich and powerful - the shrewd, indomitable agent who gives prosaic reality to the figurative eloquence of old Chancellor Fortescue, when he says, "that the lightning may flash through, the thunder shake, the tempest beat, upon the English peasant's hut, but the king of England, with all his army, cannot lift the latch to enter in." The chancellor of course meant, that in this country overbearing violence cannot defy, or put itself in the place of the law. This is quite true; and why? Chiefly because the attorney is ready, in all cases of provable illegality, with his potent strip of parchment summoning the great man before "her Sovereign Lady the Queen," there to answer for his acts; and the richer the offender, the more keen and eager Mr. Attorney to prosecute the suit, however needy his own client; for he is then sure of his costs, if he succeed! Again, I cheerfully admit the extreme vulgarity of the motive; but its effect in protecting the legal rights of the humble is not, I contend, lessened because the reward of exertion and success is counted out in good, honest sovereigns, or notes of the Governor and Company of the Bank of England. Thus much by way of conciliatory prologue to the narrative of a few incidents revealed in the attorney's privileged confessional; throughout which I have of course, in order to avoid any possible recognition of those events or incidents, changed the name of every person concerned. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from The Irish Attorney This excellent farce is from the pen of the talented author on "The Nervous Man," Bayle Bernard, Esq., who is an American by birth, though of Irish descent. It was first performed at the Haymarket Theatre, London, on the 6th of May, 1840; its success was then unequivocal; and it has ever since been regarded as one of the most valuable additions to our stock of mirth-provoking after-pieces. Mr. Bernard dedicates this piece "To the memory of Luke Bernard, attorney-at-law, Limerick," as a "Reminiscence of his life and virtues, by his affectionate descendant." Of the performance of Pierce O'Hara, the hero of this farce, by the late Mr. Power (for whom it was expressly written), we can but say, it was perfection. Mr. Collins, Mr. Leonard, and a host of "Irish Comedians," have since enacted the part, the former with very distinguished success; and amongst the latter, Mr. Nickinson, of the Olympic Theatre, deserves honourable mention. His style of dressing and enacting the "four-bottled, five-barred, rollicking" Galway gentleman, is certainly equal to that of any of the other candidates for "the mantle of Poor Power." It is to this gentleman we are indebted for the copy from which this edition is printed. That copy was, by permission, carefully revised and corrected by him from the manuscript used by the original personator of the hero during his last engagement in New York. The alterations and additions by Mr. Power, add very much to the effectiveness of the piece; and we feel much pleasure in being enabled to present what we believe to be the only edition of "The Irish Attorney," as per formed by that lamented actor.
