Book excerpt: Despite the fact that many researchers have focused on Hamas’ armed resistance activities, surprisingly few have theorised about the political choices and dilemmas that Hamas has faced in the context of the changing overarching conflict between Israelis and Palestinians. This study aims to show, theoretically, how context-dependent Hamas is when formulating its resistance and Demo-Islamic practise and that this occurs in interrelations with key actors of the conflict. This study also presents important new empirical data that, in part, also challenges previous research. Hamas is one of the very few Islamist organisations that has reached a governance position via democratic and fair elections. Thus, Hamas can serve as a case study of how Islamist may act in (quasi)democratic surroundings. At the same time, Hamas is a key actor in the overarching conflict, which has several unique characteristics. Hamas’ armed resistance is described as an instrument for the Jihad against the Israeli occupation. However, the Dawa work at the grassroots level can also be seen as a resistance practice that can be identified as constructive resistance. The internal discussion in Hamas as to what strategies to apply, as will be shown, are also formed and impacted by various interrelations with external actors of the conflict. The Palestinian public, in particular, is a key actor that influences Hamas in various ways, although Fatah, PLO, Israel and other external actors also have their specific roles to play.

We subconsciously find our place in it by sniffing our body, the body of the one next to us, the room in which we are, the culture with which we are familiar. There is an incessant olfactory flow consisting of bodies, human and nonhuman, that are agents of generation, consumption, diffusion, reproduction and dissolution of odours. As they move or pause, as they cluster with others or try to move away, these bodies constantly partake in this olfactory flow, this dense planetary swirl that leaves nothing outside. The law aims at presenting itself as rational and objective. Smell, on the other hand, is one of the least integrated senses in the legal edifice, in comparison to, say, seeing and hearing. This can be attributed mainly to the fact that sense-making of smell and law are different, even antithetical. Smell operates undercurrent, tickling the olfactory antennas of individual and collective bodies while habitually hiding behind other sensory volumes. Law, on the other hand, has an interest in appearing present, universal, constant. Olfactory sense-making relies on its elusiveness; legal sense-making invests in its obviousness. Yet, the two can interact in most unexpected ways, as this volume amply shows. If anything, smell airs the way in which law conceptualises and contextualises its own actuality. Smell brings law forth by allowing it to show its underbelly, its elusive sense-making that is invariably sacrificed in preference to the necessity of legal impressions of constancy. However, smell’s fragmentary, discontinuous and unstable nature, despite all the ordering that goes to it, poses a peculiar challenge to the law. This volume sets out to investigate this juncture.

Legitimation and Delegitimation in Global Governance explores processes of legitimation and delegitimation of such institutions. How, why, and with what impact on audiences, are global governance institutions legitimated and delegitimated? The book develops a comprehensive theoretical framework for studying processes of (de)legitimation in governance beyond the state. It provides broad comparative analyses to uncover previously unexplored patterns of (de)legitimation processes. A diverse set of global and regional governmental and nongovernmental institutions in different policy fields are included. Variation across these institutions is explained with reference to institutional set-up, policy field characteristics, and broader social structures, as well as to the qualities of agents of (de)legitimation. The approach builds on a mixed-methods research design that uses quantitative and qualitative new empirical data. Three main interlinked elements of processes of legitimation and delegitimation are at the center of the analysis: the varied practices employed by different agents that may boost or challenge the legitimacy of institutions; the normative justifications that these agents draw on when engaging in legitimation and delegitimation practices; and the different audiences that may be impacted by legitimation and delegitimation. The term “recognition” shapes debates over Indigenous cultural distinctiveness, Indigenous rights to land and self-government, and Indigenous peoples’ right to benefit from the development of their lands and resources. In a work of critically engaged political theory, Glen Sean Coulthard challenges recognition as a method of organizing difference and identity in liberal politics, questioning the assumption that contemporary difference and past histories of destructive colonialism between the state and Indigenous peoples can be reconciled through a process of acknowledgment. Beyond this, Coulthard examines an alternative politics—one that seeks to revalue, reconstruct, and redeploy Indigenous cultural practices based on self-recognition rather than on seeking appreciation from the very agents of colonialism. Coulthard demonstrates how a “place-based” modification of Karl Marx’s theory of “primitive accumulation” throws light on Indigenous–state relations in settler-colonial contexts and how Frantz Fanon’s critique of colonial recognition shows that this relationship reproduces itself over time. This framework strengthens his exploration of the ways that the politics of recognition has come to serve the interests of settler-colonial power. In addressing the core tenets of Indigenous resistance movements, like Red Power and Idle No More, Coulthard offers fresh insights into the politics of active decolonization.
