Available in PDF, EPUB and Kindle. Book excerpt: The nineteenth-century prison, we have been told, was a place of 'hard labour, hard board, and hard fare'. Yet it was also a place of education. Schemes to teach prisoners to read and write, and sometimes more besides, can be traced to the early 1800s. State-funded elementary education for prisoners pre-dated universal and compulsory education for children by fifty years. In the 1860s, when the famous maxim, just cited, became the basis of national penal policy, arithmetic was included by legislators alongside reading and writing as a core skill to be taught in English prisons. By c.1880 every prison in England used to accommodate those convicted of criminal offences had a formal education programme in which the 3Rs - reading, writing, and arithmetic - were taught, to males and females, adults and children alike. Not every programme, however, had prisoners enrolled in it. Illiterate Inmates tells the story of the emergence, at the turn of the nineteenth century, of a powerful idea - the provision of education in prisons for those accused and convicted of crime - and its execution over the century that followed. Using evidence from both local and convict prisons, the study shows how education became part of the modern penal regime. While the curriculum largely reflected that of mainstream elementary schools, the delivery of education, shaped by the penal environment, created an entirely different educational experience. At the same time, philosophies of imprisonment which prioritised punishment and deterrence over reformation undermined any socially reconstructive ambitions. Thus the period between 1800 and 1899 witnessed the rise and fall of the prison school in England.

A complainant centred standpoint is developed to counteract the marginalization of the interests of victims, which is held to demonstrate that the drive for effective and efficient law enforcement has overshadowed the public interest in holding officers to account for misconduct. After officer accountability before the criminal courts diminished in the nineteenth century, missed opportunities to reform complaints procedures following commissions of inquiry in 1906-08, 1928 and 1960-62 are discussed. The second volume of the study, Combating Impunity: Complaints Against Metropolitan Police, 1964-2021, will examine the part played by complainants and civil society organisations in combating police impunity in the citizen oversight era.

Originally published in 1980, Charging for Social Care provided a long overdue examination of the use of these charges in the personal social services. In addition, it provides a clear theoretical framework within which pricing policies should be determined and outlines the policy for pricing personal social services in the future. In undertaking this analysis Ken Judge and James Matthews had gone beyond the rhetoric which in the past had characterised discussions about charges. However, judges do not receive any specific training in ethical decision-making, and often disown any place for ethics in their decision-making. Consequently, decisions made by judges do not present consistent or robust ethical theory, even when cases appear to rely on moral claims. The project explores this dichotomy by imagining a world in which decisions by judges have to be ethically as well as legally valid. Nine specific cases are reinterpreted in light of that requirement by leading academics in the fields of medical law and bioethics. Two judgments are written in each case, allowing for different views to be presented. Two commentaries - one ethical and one legal - then explore the ramifications of the ethical judgments and provide an opportunity to explore the two judgments from additional ethical and legal perspectives. These four different approaches to each judgment allow for a rich and varied critique of the decisions and ethical theories and issues at play in each case.
