Book excerpt: The study found that male inmates engaged in more predatory, bartered, and consensual sex with other inmates; however, these different types of sex were highly related, suggesting that inmates who engage in one type of sex are far more likely to be involved in the other types of sex. A discussion of the implications of these findings for inmate programming highlight the importance of developing gender-specific programs that address a broad spectrum of behaviours associated with sexual violence. The discussion reflects on the issue of consent as attributed to prison inmates and addresses the importance of boundary training for the correctional staff at risk for sexual involvement with inmates. The analytic process resulted in the construction of nine valid conceptual models for predatory, victimized, bartered, and consensual sex in prison, each of which was different for male and female inmates. This exploratory research was the first effort to apply empirically validated static and dynamic risk factors for violence to sexual predation and victimization in prisons. The models were developed using a sample of 471 inmates (288 males and 183 females) from two States.

Book excerpt: The occurrence of prison rape has continuously afflicted U.S correctional facilities for decades (Neal & Clements, 2010). It is estimated that prison rape costs the U.S $52 billion dollars annually (RIA, 2009). For victims, the experience of rape in prison carries a multitude of physical, psychological, and emotional consequences (Dumond, 2000). This thesis project examines the risk factors which may put an inmate at greater risk for prison rape. Findings within this project indicate that a variety of demographic factors (age, race, sexual orientation, etc.), mental health, social perceptions, and incarceration history may increase an inmate's level of risk. A summary of the findings, and an analysis of the Prison Rape Elimination Act (PREA) of 2003, a policy aimed at tackling this issue, are presented. An examination of PREA at both the federal and the state level, reveal that states (Colorado and Texas) have made progress towards reducing sexual victimization within their facilities, but that ongoing training and assistance is still needed. The implications of the findings for social work knowledge and practice are discussed; as well as areas of future research.

To an inmate, the formal structure of a prison – its planned work, recreation, and rehabilitation – may be a thin veneer. The ‘real’ world is the social environment, created by the convict community, and sexual violence is a traditional part of that environment. A range of sexual behaviors, all perceived as threatening and offensive by the targets of aggressors were examined, with discussion on the nature of the overture, the physical and verbal response of the target, his thoughts and feelings, the living patterns resulting from sexual pressure, and how peers and staff react. In this population, sexual aggression is shown to be racially-based: most aggressors were black, and most victims were white, of a slighter build than the aggressor, and perceived as having feminine physical and personality characteristics. About half of the 152 incidents examined involved physical violence, half initiated by aggressors coercing targets; the rest from targets reacting to threats. Both aggressors and targets tended to come from outside and prison social subcultures which used aggression as a primary means of relieving frustration and irritation. After fights, targets reported that aggressors left them alone, that they moved around the prison with less fear, felt better about themselves, and had a higher status among other prisoners. Sexual attacks increased fear, and victims continued to be affected emotionally months after the event. Prison staff did not usually intervene directly in the incidents, nor is there evidence that such intervention would be effective in reducing the problem. The author recommends the provision of program alternatives such as the Alternatives to Violence (AVP) and other conflict resolutions programs. (NCJRS, modified).

Book excerpt: This study reports that 4.4% of prison inmates and 3.1% of jail inmates experienced sexual victimization within a period of twelve months or since admission to a correctional facility, if the admission took place within less than twelve months. "Nationwide, these percentages suggest that approximately 88,500 adults held in prisons and jails at the time of the survey had been sexually victimized." Approximately 2.1% of prison inmates and 1.5% of jail inmates reported inmate-on-inmate sexual victimization, whereas approximately 2.8% of prison inmates and 2.0% of jail inmates reported staff sexual misconduct. In comparison to male inmates in prisons and jails, the BJS Report found that female inmates were more than twice as likely to report inmate-on-inmate sexual victimization. Reported sexual activity with facility staff involved 2.9% of male prisoners, 2.1% of male jail inmates, 2.1% of female prisoners, and 1.5% of female jail inmates. The rates of reported inmate-on-inmate sexual victimization were significantly higher for inmates who had the following characteristics: Being white or multi-racial, Having a college education, Having a sexual orientation other than heterosexual, and Experiencing sexual victimization prior to coming to the facility. The rates of reported staff sexual misconduct were lower among inmates who were white and twenty-five years old or older, whereas the rates were higher among inmates who had a college education and who experienced sexual victimization before coming to the facility. Among inmates reporting inmate-on-inmate sexual victimization, 13% of male prisoners, 19% of male jail inmates, and 4% of female inmates in both prisons and jails said they were victimized within the first twenty-four hours of admission to a facility.25 Among inmates reporting staff-oninmate sexual victimization, 16% of male prisoners, 30% of male jail inmates, 5% of female prisoners, and 4% of female jail inmates said they were victimized within the first twenty-four hours of admission to a facility. Significantly, most perpetrators of staff sexual misconduct were female and most victims were male: among male victims of staff sexual misconduct, 69% of prisoners and 64% of jail inmates reported sexual activity with female staff

Although research has shed light on the prevalence and incidence of sexual violence in U.S. prisons, few studies examine inmates’ perceptions of rape and safety from rape in prison. This study examined rape perceptions and the likelihood to seek mental health treatment in prison of three distinct groups of male inmates who are at greater risk of sexual victimization or exposure to sexual violence while incarcerated: gay and bisexual inmates, inmates with a juvenile incarceration history, and inmates who were first incarcerated in the adult criminal justice system during adolescence or emerging adulthood. This study examined the relationships between sexual orientation and inmates’ perceptions of the threat of rape and seeking of mental health treatment in prison. Data from 409 incarcerated men residing in 23 maximum security correctional institutions revealed that gay and bisexual inmates were significantly more likely than straight inmates to fear the threat of rape and to voluntarily request mental health treatment in prison. Incarcerated men with a history of childhood vi abuse were significantly more likely than inmates without an abuse history to fear the threat of rape. Having a history of childhood sexual abuse, identifying as black, and being incarcerated for longer than 18 years also significantly predicted increased likelihood to voluntarily request mental health treatment in prison. Implications for practice and policy are discussed.
