Book excerpt: The 1970's was a decade for discovery of the enforceable legal rights of disabled people. What does the coming decade hold in store? Where once disabled people were a silent minority, their consumer organizations and self-help groups will increasingly assert claims of right, not charity. The International Year of the Disabled will offer a time to formulate specific agendas to breathe life into noble declarations of principle and just statements of law. The International Year will also mark the tenth anniversary of the United Nations Declaration on the Rights of Mentally Retarded Persons. Will these events provoke a searching reassessment of existing legal protection at national, state and local levels? Will this focus attention on governmental and private compliance with evolving international norms of decent treatment for, and social integration of retarded persons? This paper examines some ways of strengthening legal advocacy services as a means of keeping society's promises to disabled people and turning broad rights into realities.

Book excerpt: This book is the formal presentation of the issues discussed at the Second National Conference on the Legal Rights of Citizens with Mental Retardation. A relationship between the community and its citizens with mental retardation is discussed extensively in the first section of the book. Other sections of the book are devoted to key litigation and legislation for the rights of citizens with mental retardation, law as it pertains to newborns with severe handicaps, advances in education and rehabilitation, and future strategies for advocacy. A few of the noted contributors include Carl R. Halpern, Dean of the CUNY Law School, Professor Robert A. Burt of Yale University, and Professor Robert H. Mnookin of Stanford University. This book is designed as a basic reference for advocates and others concerned with the mentally retarded.

Available in PDF, EPUB and Kindle. Book excerpt: The United Nations' Decade of Disabled Persons has served as a time for standard setting in the field of human rights and disability, and has created the need to evaluate the relevant human rights instruments for disabled persons. This volume responds to this need by offering a collection of essays on the subject of human rights and disability, and an extensive compilation of international and regional human rights instruments, guidelines and principles which are of special relevance to disabled people. It should serve organizations of disabled people as well as governments throughout the world as a resource and as an introduction to human rights and disability. This shortcoming may be one reason for the widely prevailing notion that disability is a welfare issue rather than a human rights issue.

Book excerpt: Engaging in sex, becoming parents, raising children: these are among the most personal decisions we make, and for people with mental retardation, these decisions are consistently challenged, regulated, and outlawed. This book is a comprehensive study of the American legal doctrines and social policies, past and present, that have governed procreation and parenting by persons with mental retardation. It argues persuasively that people with retardation should have legal authority to make their own decisions. Despite the progress of the normalization movement, which has moved so many people with mental retardation into the mainstream since the 1960s, negative myths about reproduction and child rearing among this population persist. Martha Field and Valerie Sanchez trace these prejudices to the eugenics movement of the late nineteenth and early twentieth centuries. They show how misperceptions have led to inconsistent and discriminatory outcomes when third parties seek to make birth control or parenting decisions for people with mental retardation. They also explore the effect of these decisions on those they purport to protect. Detailed, thorough, and just, their book is a sustained argument for reform of the legal practices and social policies it describes.

Available in PDF, EPUB and Kindle. Book excerpt: This volume offers a collection of writings on ethical issues regarding retarded persons. Because this important subject has been generally omitted from formal discussions of ethics, there is a great deal which needs to be addressed in a theoretical and critical way. Of course, many people have been very concerned with practical matters concerning the care of retarded persons such as what liberties, entitlements or advocacy they should have. Interestingly, because so much practical attention has been given to issues which are not discussed by ethical theorists, they offer a rare opportunity to evaluate ethical theories themselves. That is, certain theories which appear convincing on other subjects seem implausible when they are applied to reasoned and com pelling views we hold concerning retarded individuals. Our subject, then, has both practical and conceptual dimensions. More over, because it is one where pertinent information comes from many sources, contributors to this volume represent many fields, including philosophy, religion, history, law and medicine. We regret that it was not possible to include more points of view, like those of psychologists, sociologists, nurses and families. There is however, a good and longstanding literature on mental retardation from these perspectives.

Book excerpt: 'This book...is both timely and important, Great strides have been made in the understanding of mental illness, in the effectiveness of treatments, and in the improvement of living conditions for those who suffer. But much still needs to be done. People with mental disabilities continue to experience discrimination and stigma and are not able to enjoy the full fruits of American life. The Rights of People with Mental Disabilities reviews the issues and contemplates the areas in which all consumers, mental health professionals, and advocates can continue to make improvements. I Commend the authors for their work.' Rosalynn Carter
