Book Synopsis Planning Law and Practice in Northern Ireland by : Stephen McKay
Download or read book Planning Law and Practice in Northern Ireland written by Stephen McKay and published by Taylor & Francis. This book was released on 2022-10-24 with total page 475 pages. Available in PDF, EPUB and Kindle. Book excerpt: Each of the jurisdictions within the United Kingdom is constantly refining the operational characteristics of its planning system and while there are some common practices, there are also substantive divergences. In each territory the planning template is shaped within a dynamic political and legal context and thus students and practitioners require an accessible, in-depth and up-to-date literature dealing with this matter. The multi-disciplinary contributors to this expanded Second Edition of Planning Law and Practice in Northern Ireland explore the progression of planning within the region and discuss prominent facets of contemporary development management, development plans, environmental law, property law and professional practice. Consideration is given to the consequences of Brexit for planning in Northern Ireland, devolved government institutional structures for planning, and the post-2015 emergent performance of local authorities in this arena. The book makes an important contribution to the wider literature in this field and, with its extensive citing of statutes and cases, provides an essential resource for students, planning practitioners and researchers.

Book Synopsis Executive Decision-Making and the Courts by : TT Arvind
Download or read book Executive Decision-Making and the Courts written by TT Arvind and published by Bloomsbury Publishing. This book was released on 2021-02-25 with total page 479 pages. Available in PDF, EPUB and Kindle. Book excerpt: In this book, leading experts from across the common law world assess the impact of four seminal House of Lords judgments decided in the 1960s: Ridge v Baldwin, Padfeld v Minister of Agriculture, Conway v Rimmer, and Anisminic v Foreign Compensation Commission. The 'Quartet' is generally acknowledged to have marked a turning point in the development of court-centred administrative law, and can be understood as a 'formative moment' in the emergence of modern judicial review. These cases are examined not only in terms of the points each case decided, and their contribution to administrative law doctrine, but also in terms of the underlying conception of the tasks of administrative law implicit in the Quartet. By doing so, the book sheds new light on both the complex processes through which the modern system of judicial review emerged and the constitutional choices that are implicit in its jurisprudence. It further reflects upon the implications of these historical processes for how the achievements, failings and limitations of the common law in reviewing actions of the executive can be evaluated.

Book Synopsis The Northern Ireland Assembly by : Sean Haughey
Download or read book The Northern Ireland Assembly written by Sean Haughey and published by Taylor & Francis. This book was released on 2023-09-08 with total page 134 pages. Available in PDF, EPUB and Kindle. Book excerpt: Northern Ireland’s power- sharing Assembly is understudied in the legislative studies literature. Having been suspended (or de facto suspended) for around 40% of its existence, conversation has tended to focus more on the wider political problems in which the Assembly has been enmeshed and less on its day-to-day functions as a legislature. This book is the first to examine how the Assembly fulfils the four core functions of a legislature: representation, linkage, scrutiny, and policy- making. Using Members of the Legislative Assembly (MLAs) as the primary unit of analysis, the book explores: who and how MLAs represent; their approach to cultivating links with constituents; their use of parliamentary scrutiny tools; and their contribution to law- making. The book grounds its analysis in original data sourced from elite interviews, surveys, parliamentary questions, legislation, and the Official Report of parliamentary proceedings. Readers will therefore be able to reflect on whether the Assembly’s (often poor) reputations comport with empirical realities. This book contributes to debates in the legislative studies and consociational power- sharing literatures, and will be of interest to students and scholars of parliaments, devolution, and Northern Ireland politics.

The book will be of great interest to academics and researchers from a wide variety of disciplines, such as criminal law, criminology, social policy, human rights, family law, gender studies and sociology; as well as practitioners and those in the voluntary sector who are working in the area of combating domestic abuse.
