En él confluyen los mundos virtuales, las tecnologías inmersivas, la inteligencia artificial y el blockchain. En su reciente Iniciativa en la materia, la Comisión Europea indicaba que "los mundos virtuales brindan oportunidades sin precedentes en muchos ámbitos sociales, como mejores servicios sanitarios, una educación y formación mas atractivas, nuevas formas de interacción y colaboración entre las personas o experiencias culturales inmersivas". No obstante, el desarrollo de estos mundos virtuales también plantee retos para los derechos fundamentales y para importantes objetivos de interés publico general en una sociedad democrática. Se hace necesario, por tanto, un análisis sobre la adaptación del marco normativo a esta nueva realidad tecnológica. . En este contexto, el presente libro, impulsado por el Grupo de investigación de la Universidad de Alicante GIPLaw (UA), ofrece un análisis sobre la adecuación de la normativa sobre propiedad intelectual para hacer frente a los retos que conllevan los mundos virtuales y las tecnologías inmersivas relacionadas con el metaverso. La Comisión sostiene que la protección de los derechos de propiedad intelectual es un requisito indispensable para atraer inversión a estas nuevas tecnologías, y que la Unión Europea cuenta con un marco adecuado. No obstante, como se demuestra en la presente obra, la progresiva generalización de los mercados de activos digitales, el recurso a blockchain como tecnología de gestión de estos mercados o, incluso de alguna de las plataformas de mundos virtuales existentes, conlleva importantes retos en cuestiones tan dispares como la gestión de los derechos de autor, la moderación de contenidos, o la determinación de la jurisdicción competente o la ley aplicable. Así mismo, asuntos recientes han demostrado que la aplicación analógica a los mundos virtuales de la jurisprudencia en materia de infracciones de derechos de propiedad industrial en Internet no puede darse por descontando, sino que será necesario precisarla. En fin, otro reto importante, de carácter no solo jurídico sino también de estrategia empresarial es el de la interoperabilidad de los mundos virtuales, cuestión en la que, de nuevo, juega un papel importante la propiedad intelectual. . Tómese el presente trabajo como una primera aproximación a los retos que el metaverso supone para la propiedad intelectual con el modesto propósito de abrir un debate doctrinal que se nos muestra inevitable.
