Se abordan, por tanto, cuestiones relativas a la relación entre medioambiente y derechos fundamentales, pero también aquellas que tienen que ver con el desarrollo rural, o las políticas económica, energética o urbanística y el desarrollo sostenible. Siendo necesario determinar cuáles son dichos alcances, efectos y retos reales de la Opinión Consultiva OC-23/17 de la Corte IDH, frente a la posibilidad de establecer una protección judicial contenciosa internacional del derecho al medio ambiente sano como derecho "humano" autónomo. Para dar una respuesta a la pregunta es esencial ahondar en la naturaleza jurídica, definición conceptual, y el alcance de la protección internacional del derecho al medio ambiente sano en el SIDH, para (i) reiterar la conexión existente entre este derecho y otros derechos humanos que los hace indivisibles, (ii) abordar la distinción problemática entre la categorización de derechos económicos, sociales y culturales, y los derechos civiles y políticos, por la diferenciación de los mismos a la hora de ser judicializados ante la Corte IDH, y (iii) abrir la discusión de que la Corte IDH falle de manera contenciosa casos en torno al derecho al medio ambiente sano.
