Book excerpt: Long accepted as the standard code of Jewish law and practice, the Shulhan Aruch was written by Rabbi Joseph Karo in 1565. Now, in an unprecedented restatement of Hoshen haMishpat, one of the four sections of the Shulhan Aruch, Rabbi Emanuel Quint brings fresh insight, modern scholarship, and succinct explication to this brilliant halachic work that will fascinate the educated layperson and advanced scholar alike. With this effort, Rabbi Quint fills the long-felt need to make this material more accessible. A Restatement of Rabbinic Civil Law: Volume IX - Laws of the Paid Bailee; Laws of the Lessee; Laws Regarding Labor; Laws Regarding Borrowed Objects; Laws Regarding Stealing; Laws Regarding Robbery; Laws of Abiding by the Laws of the Land, continues to open the Shulhan Aruch to the wider audience it deserves. Rabbi Quint, the co-founder of the Jerusalem Institute of Jewish Law, an institute dedicated to the study and dissemination of Jewish civil law, brings his professional expertise to bear on the vast array of Jewish legal processes, procedures and practices encoded here. The reader may be surprised to discover that such a meticulous legal--yet not overly religious--system fits under the category of Jewish law. And yet it does, clearly illustrating that Judaism is not only a religion, but also a culture and community. Beyond a translation, A Restatement of Rabbinic Civil Law provides the author's own commentary and also incorporates the four centuries of scholarship since the Shulhan Aruch was written, including commentaries and responsa literature. Ample footnotes help guide the reader every step of the way. The result is a comprehensive, well-organized body of rabbinic jurisprudence available to the English reader for the first time. If the Shulhan Aruch can be said to be the distilled essence of Jewish law, then A Restatement of Rabbinic Civil Law triumphs as a major judicial-literary landmark of its own.

Book Synopsis The Traditional Jewish Law of Sale by : Joseph ben Ephraim Karo
Download or read book The Traditional Jewish Law of Sale written by Joseph ben Ephraim Karo and published by . This book was released on 1983 with total page 366 pages. Available in PDF, EPUB and Kindle. Book excerpt: Rabbinic tradition is in large part a tradition of law and jurisprudence. This tradition of law comprehends fields as diverse as the law of evidence and the dietary regimen, as laws on credit and debt and the laws of ritual purity. It follows naturally that many, if not most, of the great works of rabbinical literature are law books, commentaries on the law, and collections of cases. The principal legal code, or restatement, still authoritative among traditional Jews, is the Shulhan Arukh, compiled by Joseph b. Ephraim Karo of Safed (1488-1575) and glossed by Moses Isserles of Cracow (1520-1572). This work, published in four volumes, provided the rabbinic jurist or magistrate, as well as the learned layman, with a concise review of the various areas of Jewish law that might come to his attention. One such area of traditional Jewish law was the laws of buying and selling and the laws of fraud in sales. This particular domain within traditional Jewish commercial law is surprisingly intelligible and fascinating for modern students of Jewish tradition. Buying and selling are just as much a part of the modern world as they were of past ages. Moreover, the student of legal history or comparative law will find that this rabbinical code on sales and fraud in sales provides, at a glance, a view of the strata of Jewish legal development from the ancient period to the sixteenth century. Among the matters treated in this code are the formation of the agreement to buy and sell, the concept of acquisition as it relates to various types of property, legal capacity, and the requirement of good faith. The chapters on fraud reflect the moral and ethical values of Jewish tradition which are always implicit, and often explicit, in the rules of Jewish civil, criminal, and commercial legal codes. The material is clearly of interest to modern students of business ethics. A synopsis of the law of sale prefaces the work. It underscores some of the main features of this area of the law and furnishes some terminology and analysis of the material. While this synopsis does note some points of contrast and comparison with Roman law and medieval church law, it is not intended as a detailed historical or comparative study. It serves principally to introduce the text itself and establish some useful lines of understanding and classification. The translation of the laws of sale and fraud presented here has been prepared with the utmost care and attention to the technical nuances of legal terminology in both modern and ancient law. Its apparatus of notes and references includes material on the history of the printing of this translated portion of the Jewish legal tradition.

Book excerpt: Most bioethicists concern themselves with common law when considering the mores that inform practitioners operating in the framework of medical institutions. These questions are generally addressed from the perspective of secular ethics. Many Jewish physicians, however Contributors to this volume address medical issues such as organ transplantation, physician's fees, new reproductive technologies, informed consent, and medical confidentiality in the context of Jewish law. Jewish thought is presented as of great relevance to both the history of medical ethics and contemporary medico-legal issues. The volume concludes with a chronicle of Jewish Law in the State of Israel and a survey of recent literature.

Book Synopsis Crime and Punishment in Jewish Law by : Walter Jacob
Download or read book Crime and Punishment in Jewish Law written by Walter Jacob and published by Berghahn Books. This book was released on 1999-10-01 with total page 149 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Bible presents only a small portion of the laws necessary for a state to function. Nevertheless, whole tractates of the Talmud discuss a wide variety of legal issues both civil and criminal. Although the jurisdiction of the beth din was limited in every land where Jews have lived, the scholars felt that it was important to develop a system which dealt with every aspect of life. Quite a few of the issues were discussed at a purely theoretical level. But faced with specific problems in their respective communities, the rabbinic scholars were forced to be practical and go beyond the traditional halakhah in order to protect the community. This mixture of idealism and reality shape the later rabbinic discussions, some elements of which have been incorporated into modern Israeli law, but also shape modern Jewish thinking in the Diaspora. This area of the halakhah has been rather neglected, but this volume will no doubt stimulate further research. Published in Association with the Solomon B. Freehof Institute of Progressive Halakhah
