Une telle recherche d'unification était cependant nécessaire tant la question du sort de l'enfant dans le cadre d'une relation juridique internationale peut faire l'objet de traitements différents selon les juridictions saisies. L'articulation des textes, qu'ils soient communautaires (règlements n° 1347/2000 et 2201/2003) ou conventionnels (conventions bilatérales ou conventions de La Haye de 1961, de 1980 et de 1996), devient alors un réflexe nécessaire au bon fonctionnement des règles posées. Certes perfectible, le droit international privé conventionnel et communautaire de la protection des enfants peut néanmoins désormais être considéré comme un véritable ensemble aux solutions abouties. L'époque actuelle apparaît comme une charnière entre une ère de foisonnement des textes internationaux, lequel a semble-t-il atteint son paroxysme, et une ère moins prolixe, contribuant à ce que chaque instrument tende de plus en plus à tenir compte de l'autre. Les règlements communautaires, symboles de ce paroxysme, auraient pu remettre en cause les progrès accomplis dans le cadre de la Conférence de La Haye. Mais le contenu du règlement le plus récent, jumeau de la convention de 1996, permet de croire qu'il n'en est rien.

Book excerpt: Dans le domaine de la protection des mineurs en droit international privé, un principe récurrent apparaît nettement depuis le milieu du XXe siècle : assurer à l'enfant une protection de proximité par l'établissemnet de règles concrètes, plus réalistes que celles qui découlent des mécanismes classiques du DIP. Ce mouvement de concrétisation s'observe à la fois dans les règles de conflits de juridictions et de lois et au sein des mécanismes des effets des décisions étrangères. Cette orientation pragmatique se manifeste tout d'abord par la primauté du conflit de juridictions sur le conflit de lois notamment grâce au principe d'unité du "forum" et du "jus" largement adopté par les conventions. La compétence généralisée des autorités de la résidence habituelle du mineur (au détriment essentiellement de celles de sa nationalité) et le développement du principe de proximité qui apporte de la souplesse dans les mécanismes sont également deux manifestations de cette tendance. Cependant, cette protection de proximité peut être compromise par la recherche, dans le cadre conventionnel, de l'unité du contentieux international du divorce et de l'autorité parentale devant le juge de la désunion. La tendance pragmatique se traduit également par un intérêt croissant du droit conventionnel pour la question de la circulation des rapports d'autorité parentale une fois établis et particulièrement des décisions établissant un droit de visite transfrontière. Les très nombreux accords bilateraux relatifs aux effets des décisions étrangères auxquels la France est partie n'apportent souvent rien au régime relativement strict qui découle du droit commun. Au sein de la Conférence de La Haye ou de l'Union européenne les travaux les plus récents visent au contraire à alléger les conditions du contrôle de régularité. Cette orientation est particulièrement illustrée en matière d'enlèvement international d'enfants par la convention de La Haye de 1980.

This symposium, entitled `Globalization of Child Law: The Role of the Hague Conventions', was organized by the Faculty of Law of Tilburg University and the International Society of Family Law in collaboration with the Hague Conference on Private International Law. Adair Dyer, best known for his exceptional work in the area of international child abduction, was active at the Hague Conference for more than 25 years. The protection of children has been a major concern of the Hague Conference from the very beginning of its existence. The Conference followed and reacted to developments such as the increasing numbers of children - alone or accompanied - moving or migrating internationally, which has given rise to many new legal, economic, social and cultural problems. It contributes to the topical academic debate on ‘family law exceptionalism’ by exploring the blurred lines between public law, private law and family law, and sheds light on the many shades of grey that exist. The contributions focus on both substantive and procedural family law on parents and children and on life partners, with particular attention for contractual arrangements of family formations and of conflict resolution. The hypothesis underlying all contributions was the trend towards contractualisation of family law. A convergent research outcome resulting from the comparison of national reports was the ambivalent position of family law in legal systems worldwide. That comparison shows that, whereas family law is clearly moving towards contract with regard to old family formations, the contrary is true for new family formations. The movement towards contract is rarely considered to be contractualisation pur sang, with civil effect. The movement towards status, finally, does not necessarily witness ‘family law exceptionalism’ vis-à-vis private law, in view of the increasing State interventionism in private law relations in general. In sum, as the volume shows, the high permeability of the demarcations between the State, the family and the market impedes a categorial approach. This volume is based on the general and selected national reports on the topic “Contractualisation of Family Law” that were presented at the XIXth International Congress of Comparative Law in Vienna in July 2014.

L'objectif du texte est de contribuer à la création d'un espace de libre circulation des décisions de justice dans les pays de l'Union. Il remplace le règlement (CE) n° 1347/2000 dit " règlement de Bruxelles II ", dont il étend considérablement le champ en matière d'autorité parentale puisque sont désormais concernées toutes les décisions prises ou à prendre en matière de protection de l'enfant, que l'enfant soit né en mariage ou hors mariage. Reposant sur le principe de confiance mutuelle entre juridictions des Etats membres, le nouveau règlement " Bruxelles II bis " pose des règles de compétence judiciaire très ouvertes, avec, en principe, obligation de se dessaisir au profit de la juridiction d'un Etat membre première saisie. De même, les conditions de reconnaissance et d'exécution des décisions rendues dans un Etat membre sont elles simplifiées et allégées. Le règlement comporte également des innovations en matière d'enlèvement d'enfants et de droit de visite. L'ensemble de ces dispositions devrait révolutionner la pratique du divorce et de la séparation familiale dans l'espace communautaire. Elles nécessitent une coopération accrue entre Etats membres mais aussi des contacts directs entre juridictions et entre praticiens, par-delà les frontières.
