Además, se observa que existen pocos desarrollos doctrinales y escasos decisiones judiciales sobre esta materia que ahonden en la tipología de la señalada responsabilidad y, por supuesto, en las consecuencias patrimoniales para el notario por el ejercicio incorrecto de la Función pública que le es delegada. la autora, al escudriñar en el tema de la responsabilidad civil del notario y al analizar los pronunciamientos judiciales de que se dispone, percibe la ausencia de una postura unificada del Consejo de Estado colombiano en el aspecto de la legitimación en la causa por pasiva, situación que ha impedido el estudio de fondo, por parte de aquel, de las pretensiones de las demandas puestas en su conocimiento y el avance en la determinación de la responsabilidad patrimonial del Estado y del notario, con lo cual se estaría vulnerando el derecho de acceso a la administración de justicia.
