To Western intellectuals, foreign policy experts, and politicians, "empire" and "imperialism" are categories that apply exclusively to Europe and more recently to the United States of America. As they see it, Middle Eastern history is the product of its unhappy interaction with these powers. Forming the basis of President Obama's much ballyhooed "new beginning between the United States and Muslims around the world," this outlook is continuing to shape crucial foreign policy among Western governments, but in these pages, Efraim Karsh propounds a radically different interpretation of Middle Eastern experience. He argues that the Western view of Muslims and Arabs as hapless victims is absurd. On the contrary, modern Middle Eastern history has been the culmination of long-existing indigenous trends. Great power influences, however potent, have played a secondary role constituting neither the primary force behind the region's political development nor the main cause of its notorious volatility. Karsh argues it is only when Middle Eastern people disown their victimization mentality and take responsibility for their actions and their Western champions drop their condescending approach to Arabs and Muslims, that the region can at long last look forward to a real "spring."

This solidarity underscores the interlocking, global struggles for emancipation from racial domination and economic exploitation. Drawing on key Palestinian voices, including Edward Said and Larissa Sansour, as well as a wide range of influential philosophers such as Slavoj Žižek, Frantz Fanon and Achille Mbembe, Zalloua brings together the Palestinian question, Indigeneity and Critical Black Studies to develop a transformative, anti-racist vision of the world.

Book excerpt: During the last decade of the British Mandate for Palestine (1939–1948), Arabs and Jews used the law as a resource to gain leverage against each other and to influence international opinion. The parties invoked "transformational legal framing" to portray the essentially political-religious conflict as a legal dispute involving claims of justice, injustice, and victimisation, and giving rise to legal/equitable remedies. Employing this form of narrative and framing in multiple "trials" during the first 15 years of the Mandate, the parties continued the practice during the last and most crucial decade of the Mandate. The term "trial" provides an appropriate typology for understanding the adversarial proceedings during those years in which judges, lawyers, witnesses, cross-examination, and legal argumentation played a key role in the conflict. The four trials between 1939 and 1947 produced three different outcomes: the one-state solution in favour of the Palestinian Arabs, the no-state solution, and the two-state solution embodied in the United Nations November 1947 partition resolution, culminating in Israel's independence in May 1948. This study analyses the role of the law during the last decade of the British Mandate for Palestine, making an essential contribution to the literature on lawfare, framing and narrative, and the Arab-Israeli Conflict.
