Book excerpt: Reshaping the British Constitution provides a vigorous critique of the deformations of Britain's customary constitution and why it could not effectively stem the growth of a centralized political authority. On this foundation it provides a critical description and assessment of recent constitutional changes including devolution, House of Lords reform, human rights and the encroachment of the European Union. Nevil Johnson suggests that since the reform programme has rested on pragmatic political expediency rather than on coherent thinking about constitutional principles, it is likely to strengthen the familiar deformations of the customary constitution.

Book excerpt: The third edition of Constitutional Reform examines central government, Parliament, and the judiciary in Britain and proposes an agenda for reform. In addition to issues such as voting reform, reform of House of Lords and how citizens' rights might be better protected, the book considers thebest methods through which such changes should be achieved and provides material for the international comparison of constitutions. Whilst the book has been fully revised and updated to provide a retrospective analysis of the major constitutional reforms of Tony Blair's premiership, it is notlimited to that government's agenda and includes material on previous government's reforms and Gordon Brown's reform agenda. The third edition includes two new chapters, one on the structure and possible future of the United Kingdom and the other on whether the United Kingdom should adopt a codified constitution. It retains the clarity and lucid writing style of previous editions and features an expanded bibliographyenabling readers to follow up points of particular interest. The book provides detailed coverage of British constitutional reform in the early twenty-first century and whilst aimed primarily at students of constitutional law, politics and government, it will also be of interest to the generalreader.

Book excerpt: In this book the former head of Mrs Thatcher's policy unit looks at the state of the British Constitution at a crucial time in its history, arguing that recent years have seen an increased willingness to monitor itself on the part of the Establishment, but that more audacious reforms are needed to restore full confidence in Parliament, government and the legal system.

The author argues that the Constitution is more than a body of institutions working in accordance with principles laid down in law or expressed in conventions. It is society in its political aspect. In addition to the features of the Constitution, the book also explains the functions of the House of Commons, the House of Lords, the King, the Cabinet, the parties, the administration and the armed forces. This book will be of interest to anyone keen on learning about the British Constitution as well as students of political science and history.

Available in PDF, EPUB and Kindle. Book excerpt: The last decade has seen radical changes in the way we are governed. Reforms such as the Human Rights Act and devolution have led to the replacement of one constitutional order by another. This book is the first to describe and analyse Britain's new constitution, asking why it was that the old system, seemingly hallowed by time, came under challenge, and why it is being replaced. The Human Rights Act and the devolution legislation have the character of fundamental law. They in practice limit the rights of Westminster as a sovereign parliament, and establish a constitution which is quasi-federal in nature. The old constitution emphasised the sovereignty of Parliament. The new constitution, by contrast, emphasises the separation of powers, both territorially and at the centre of government. The aim of constitutional reformers has been to improve the quality of government. But the main weakness of the new constitution is that it does little to secure more popular involvement in politics. We are in the process of becoming a constitutional state, but not a popular constitutional state. The next phase of constitutional reform, therefore, is likely to involve the creation of new forms of democratic engagement, so that our constitutional forms come to be more congruent with the social and political forces of the age. The end-point of this piecemeal process might well be a fully codified or written constitution which declares that power stems not from the Queen-in Parliament, but, instead, as in so many constitutions, from `We, the People'. The old British constitution was analysed by Bagehot and Dicey. In this book Vernon Bogdanor charts the significance of what is coming to replace it. The expenses scandal shows up grave defects in the British constitution. Vernon Bogdanor shows how the constitution can be reformed and the political system opened up in`The New British Constitution'.

Book excerpt: Contrary to popular myth, Britain does have a constitution, one that is uncodified and commanded little political interest for most of the twentieth century. In the late 1990s, Tony Blair's New Labour Government launched a program of reform that was striking in its ambition. Reinventing Britain tells the story of Britain's constitutional reform and weighs its long-term significance, with essays both by officials who worked on the reforms and by other leading commentators and academics from Britain and North America. Contributors: Mark Bevir, Jack Citrin, Joseph Fletcher, Robert Hazell, Ailsa Henderson, Kate Malleson, Craig Parsons, Kenneth MacKenzie, Peter Riddell

Available in PDF, EPUB and Kindle. Book excerpt: Since coming to power in 1997 the Labour government 's programme of constitutional reform represents an historic challenge to both British constitutional doctrine and Labour Party orthodoxy. Mark Evans examines the nature and extent of this challenge and argues that the New Constitutionalism is a key element of a policy agenda that in its most crucial aspects reflects the continuing transformation of the British industrial-welfare state into a competition state. Constitution-Making and the Labour Party analyzes key areas of reform under the Blair government from the perspective of Labour Party history and contemporary policy analysis.

Book excerpt: The English Constitution addresses two burning contemporary and complementary questions; one regarding the so-called English 'question', the changing identities of England and English-ness, and a second regarding the changing shape of the Anglo-British constitution. It is suggested that there are both internal and external pressures that are driving the reformation of our constitutional order. There are internal pressures of decay, even corruption, and popular apathy, and there are external pressures brought to bear by the geopolitical challenges of the new world order and the new Europe. The present 'project' of constitutional reform inaugurated by the present government is supposed to reflect these pressures. This book challenges this assumption, arguing that a far more radical re-constitution is required, involving: deeper institutional reforms (the most pressing being the abrogation of monarchy, and the established Church); geopolitical reforms to recast the devolutionary settlement and redefine English regionalism; and perhaps most importantly, conceptual reform, reform that will embrace the need to rebalance the constitution and to promote greater accountability and democracy. It is intended that the book will provide a stimulating text for both academics and students; advancing a series of original ideas on a subject of considerable contemporary interest. Along the way it discusses most of the major topics, institutions and debates which are ordinarily addressed in public law courses, and equivalents in non-law disciplines
