Practitioners with clients involved in agri-business will be particularly interested in the broad spectrum of matters discussed, as will trade negotiators, policy advisors and graduate students in this vital and fascinating field.Õ Ð Phillip Taylor MBE and Elizabeth Taylor, The Barrister Magazine Agriculture has been the unruly horse of the GATT/WTO system for a long time and efforts to halter it are still ongoing. This Research Handbook focuses on aspects of agricultural production and trade policy that are recognized for their importance but are often kept out of the limelight, such as the implication of national and international agricultural production and trade policies on national food security, global climate change, and biotechnology. It provides a summary of the state of the WTO agriculture negotiations as well as the relevant jurisprudence, but also, and uniquely, it focuses on the new and emerging issues of agricultural trade law and policy that are rarely addressed in the existing literature. With contributions from a multi-disciplinary team of leading analysts from around the world, this Research Handbook will appeal to trade negotiators, international trade law and policy academics as well as postgraduate students in the field.

Available in PDF, EPUB and Kindle. Book excerpt: Following the conclusion of the latest round of reforms to the Common Agricultural Policy (CAP) in 2013, the Research Handbook on EU Agriculture Law provides an up-to-date discussion of these reforms and the changing landscape in which the CAP now operates. Adopting an interdisciplinary approach, and with international contributors from across Europe and the United States, the Handbook commences with analyses of the legal instruments which implement the reformed CAP, before moving on to consider questions of land use, the role of agriculture within the wider food chain and the international dimension. In these contexts, particular issues identified include: the environmental impact of past, present and future farming practices; the ability of the food chain to accommodate consumer preferences and scientific innovation; and the hurdles to be cleared before international consensus can be reached on a whole range of agricultural imperatives. As well as providing a state-of-the-art point of reference for academics, this comprehensive book will be of great interest to students, scholars and policymakers dealing with these new challenges faced by agriculture in the EU.

Available in PDF, EPUB and Kindle. Book excerpt: This is an insightful book of ideas offering an alternative conceptualisation of the problems of international agricultural trade, which are seen as polycentric and so must be managed rather than resolved. It demonstrates that where there is convergence without genuine agreement on the meaning no specific resolution can be achieved. The author is to be commended for offering a valuable springboard for further reflection on the management of the problems of international agricultural trade. Joseph McMahon, University College Dublin, Ireland International agricultural trade regulation remains problematic despite the creation of the WTO and a specific Agreement on Agriculture in 1995. Fiona Smith challenges this orthodoxy and presents a new conceptual method by which the problem of international agricultural trade in the WTO can be understood. Attempts to revise the rules in the Doha Development Round of multilateral trade talks have repeatedly stalled as negotiators grapple with what is perceived to be the problem of international agricultural trade. Issues such as how best to address the contemporary challenges to market liberalisation whilst preserving the environment, difficulties of biofuels, development, human rights and the demands of the changing nature of global governance are all examined in this timely book. Challenging convention and introducing new concepts, Agriculture and the WTO will strongly appeal to academics working in the fields of international agricultural trade, international relations, international economic law, agriculture law and policy. It will also be warmly welcomed by policymakers and graduate students with a special interest in international agricultural trade.

Book excerpt: The World Trade Organization’s Doha Round of trade talks has been plagued by a lack of concrete progress toward establishing a fair and harmonious agricultural trading system. Because the results of the Doha Round could have far-reaching implications for the trade and economic prospects of developing countries in the twenty-first century, it is critical for these countries to fully understand the issues involved in the negotiations on agriculture. However, there has been no authoritative analysis of the rules and modalities on which governments of developing countries can rely. This book, coauthored by an insider to the trade talks that led to the establishment of the WTO, fills this gap. The volume begins with a detailed analysis of the provisions of the WTO’s Agreement on Agriculture and the modalities of the negotiations. It examines the implementation experience of key members of the WTO, then traces the developments in the negotiations up to the recent impasse. In light of these considerations, and on the basis of a case study of India, the authors propose various elements of a negotiating position and strategy for developing countries. The authors offer tough but realistic recommendations regarding tariffs, market access, treatment of sensitive or special products, and other aspects of international trade. This book will be of particular interest to researchers and practitioners as well as students seeking in-depth knowledge of the recent history of agricultural trade talks.

Available in PDF, EPUB and Kindle. Book excerpt: Farm support is contentious in international negotiations. This in-depth assessment of the legal compliance and economic evaluation issues raised by the WTO Agreement on Agriculture presents consistent support data and forward-looking projections for eight developed and developing countries (EU, US, Japan, Norway, Brazil, China, India, Philippines), using original estimates where official notifications are not available. Variations over time in notified support in some cases reflect real policy changes; others merely reflect shifts in how countries represent their measures. The stalled Doha negotiations presage significantly tighter constraints for developed countries that provide the highest support, but loopholes will persist. Developing countries face fewer constraints and their trade-distorting farm support can rise. Pressure points and key remaining issues if a Doha agreement is reached are evaluated. Vigilant monitoring for compliance of farm support with WTO commitments will be required to lessen its negative consequences whether or not the Doha Round is concluded.

Book excerpt: This book examines the public stockholding policies of selected developing countries from the perspective of WTO rules and assesses whether the provisions of the Agreement on Agriculture (AoA) could hamper these countries’ efforts to address the challenges of food security. Further, it highlights the need to amend the provisions of the AoA to make WTO rules just and fair for the millions of people suffering from hunger and malnutrition in developing countries. This book highlights that 12 countries namely China, Egypt, India, Indonesia, Jordan, Kenya, Morocco, Pakistan, Tunisia, Turkey, Zambia and Zimbabwe are facing or will face problems in implementing the food security policies due to the provisions under AoA. These provisions need to be amended for permitting developing countries to address hunger and undernourishment. Progress in WTO negotiations on public stockholding for food security purposes are also discussed and analysed. The findings of this study greatly benefit trade negotiators, policymakers, civil society, farmers groups, researchers, students and academics interested in issues related to the WTO, agriculture and food security.

Book excerpt: This book is devoted to the complex relationship between the global trading system and food security, focusing on two important elements: the Doha Development Agenda (DDA) and how food price volatility can be managed, or not, through trade instruments. The first section of the book is based on the premise that more trade integration can fight poverty and alleviate hunger. The second section examines whether managing price volatility is doable through more or less trade integration. This section deals in particular with policy instruments available for policy makers to cope with price volatility: food stocks, crop insurance, and export restrictions. Analysis concludes that without a strong and efficient World Trade Organization (WTO) capable of conducting ambitious trade negotiations, the food security target will be much more difficult to hit.

Available in PDF, EPUB and Kindle. Book excerpt: This book examines the application of the World Trade Organization’s (WTO) Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS) in the fields of agriculture, public health and economic development in a Least Developed Country (LDC) such as Bangladesh. In particular, it evaluates the question whether the TRIPS’ one-size-fits-all approach compulsorily applicable for all countries, irrespective of their development standing, fulfils the developmental needs of Bangladesh and other such LDCs in the fields of agriculture, public health and economic development. The book shows that the TRIPS’ introduction of IPRs in the name of Plant Varieties Protection (PVP) and patents not only secures private sector investment in agriculture but also brings traditional agricultural practices within the spectrum of private monopoly, increases the price of agricultural products and forces people into dependency on engineered seeds and other agricultural inputs. To guard against such trade rules, this book recommends that Bangladesh should incorporate the TRIPS flexibilities in the form of redefining patentable invention, choosing between patents and PVP and providing for compulsory licensing. This book also reveals that the TRIPS patenting in pharmaceuticals encourages innovations by ensuring royalty collections and protects public health by raising standards of living. However, patenting offers exclusivity to pharmaceutical companies, extending the duration of the patent term and establishing their control over production, supply and distribution. Such control results in exclusivity over drug pricing. The flexibilities of the compliance deadline, compulsory licensing, and parallel importation built into the TRIPS are set to tackle untenable situations arising from patenting exclusivity. However, patent laws in most LDCs are out-dated in terms of dealing with such flexibilities. Given this, the research recommends that Bangladesh should invoke the TRIPS flexibilities. The author of this book further establishes that the TRIPS’ standard-setting in agriculture and pharmaceuticals does not help the country to fulfil subsistence needs or promote economic development through innovation. However, the appropriation of agricultural and pharmaceutical goods during the use of the TRIPS flexibilities has the potential to feed the people, protect public health interests and increase economic development with the supply of food and drugs at home and abroad. To this end, the research asks Bangladesh to reform its existing IPRs provisions by redefining patentable inventions and simplifying compulsory licensing and other differential treatments to appropriate foreign technologies.
