Book excerpt: "Report on the Judicial Establishments of New South Wales" is the second report by English judge and royal commissioner John Thomas Bigge on the situation in the colonies. His inquiry started as several wealthy landowners, mainly John Macarthur, complained about the governorship of Lachlan Macquarie. The latter was famous for his policies of remediating ex-convicts back into society, creating a lack of a cheap and free workforce for the landowners. In this report, Bigge focused upon a defamation action launched by Samuel Marsden to argue against the appointment of emancipated convicts to positions of magistrates and jurors. Bigge thought these policies promoting emancipists by Macquarie were "inexpedient and dangerous."

Book Synopsis Public Sentinels by : Patrick Keyzer
Download or read book Public Sentinels written by Patrick Keyzer and published by Routledge. This book was released on 2016-04-15 with total page 296 pages. Available in PDF, EPUB and Kindle. Book excerpt: In recent years, controversy has surrounded the role of top government lawyers in the United States and the United Kingdom. Allegations of bad lawyering and bad ethics in public office over the ’torture memos’ in the United States and the political pressure placed on the Attorney-General in the United Kingdom to approve the legality of the Iraq war, have seen these relatively obscure group of government lawyers thrust into the public debate. Unlike its Anglo-American contemporaries, Australia’s chief legal adviser, the Solicitor-General, has remained largely out of the public eye. This collection provides a rare and overdue insight into a fundamental public institution in all Australian jurisdictions. It provides a historical, theoretical, practical and comparative perspective of this little known, but vitally important, office at a time when the transparency and accountability of government has taken on an increased significance. Of interest to anyone interested in the integrity of government, the book will be particularly useful to government, political parties and the academy. It will also be a valuable reference work to those working towards a redefinition of the role of top government legal advisors.

Book Synopsis The Europeans in Australia by : Alan Atkinson

Available in PDF, EPUB and Kindle. Book excerpt: 'It is the duty of historians to be, wherever they can, accurate, precise, humane, imaginative - using moral imagination above all – and even-handed.' - Alan Atkinson The second of three volumes of the landmark, award-winning series The Europeans in Australia gives an account of early settlement by Britain. It tells of the political and intellectual origins of this extraordinary undertaking that began during the 1780s, a decade of extraordinary creativity and the climax of the European Enlightenment. Volume Two, Democracy, takes the story from around 1815 to the early 1870s. By exploring the nineteenth-century ‘communications revolution’ Atkinson casts new light on the way Australia first found its place in a ‘global’ world. This volume is more than a story of geography and politics. It describes the way people thought and felt. Throughout the trilogy Atkinson traces subtle and sudden shifts of ‘common imagination’ by analysing the lives of both powerful and ordinary Australians. He sets out the ideas and the imagery that moved and marked the people. This book, like all his work, is grounded in thorough and rigorous scholarship yet imbued with compassion and insight. Written ‘from the inside’, it is – as he says – history ‘caught up with the flesh and memory it describes’. The culmination of an extraordinary career in the writing and teaching of Australian history,The Europeans in Australia grapples with the Australian historical experience as a whole from the point of view of the settlers from Europe. Ambitious and unique, it is the first such large, single-author account since Manning Clark’s A History of Australia.

Download or read book Freedom on the Fatal Shore written by John Hirst and published by Black Inc.. This book was released on 2008-05-01 with total page 784 pages. Available in PDF, EPUB and Kindle. Book excerpt: Freedom on the Fatal Shore brings together John Hirst's two books on the early history of New South Wales. Both are classic accounts which have had a profound effect on the understanding of our history. This combined edition includes a new foreword by the author. Convicts with their "own time", convicts with legal rights, convicts making money, convicts getting drunk - what sort of prison was this? Hirst describes how the convict colony actually worked and how Australian democracy came into being, despite the opposition of the most powerful. He writes: "This was not a society that had to become free; its freedoms were well established from the earliest times." “Colonial Australia was a more ‘normal’ place than one might imagine from the folkloric picture of society governed by the lash and the triangle, composed of groaning white slaves tyrannised by ruthless masters. The book that best conveys this and has rightly become a landmark in recent studies of the System is J.B. Hirst’s Convict Society and Its Enemies.” —Robert Hughes, The Fatal Shore “Anyone with an interest in Australian political culture will find The Strange Birth of Colonial Democracy invaluable.” —Professor Colin Hughes, former Electoral Commissioner for the Commonwealth
