Book Synopsis The Pluralist Character of the European Economic Constitution by : Clemens Kaupa
Download or read book The Pluralist Character of the European Economic Constitution written by Clemens Kaupa and published by Bloomsbury Publishing. This book was released on 2016-08-25 with total page 401 pages. Available in PDF, EPUB and Kindle. Book excerpt: This monograph intervenes in the long-standing and controversial debate on the socio-economic orientation of the European Union. Arguing that the European economic constitution is pluralist in the sense that it does not favour any specific socio-economic paradigm, it shows that European law allows the pursuit of very different regulatory projects by the European and the national legislators. This pluralist character of the European economic constitution stands in an uncomfortable relationship with the policies currently pursued by the European Union, which are often neoliberal in their orientation. The book takes an interdisciplinary approach: it analyses the Treaty on the Functioning of the European Union as interpreted and developed in the case law of the Court of Justice, its history, and its regulatory purpose in the light of conflicting socio-economic paradigms. By challenging the orthodoxy, the book makes a bold proposition that will likely resonate in both European economic law scholarship and European law in general. With the ongoing economic crisis triggering a significant interest in economic questions among legal scholars it is particularly timely and topical.

Available in PDF, EPUB and Kindle. Book excerpt: Shedding new light on the foundations of European competition law, this volume is a legal and historical study of the emerging law and its evolution through the 1980s. It retraces the development and critical junctures of competition law not only at the level of the European Economic Community but also at the level of major Member States of the EEC. Intensely researched and rich with insights, the chapters in this volume reflect a close collaboration among an expert group of lawyers and historians and capitalize on previously unavailable source materials. The book examines several key themes including: the influence of national and international competition law on the development of EEC competition law; the drafting of the regulations that lead to the development of modern EU competition law; the role of the European Court of Justice in establishing the protection of competition as a central pillar of the Common Market; the internal dynamics, ideologies and tensions within the Competition Directorate General (DG IV) of the European Commission; and the role of industrial policy in European integration. Combining legal analysis with a meticulous excavation of historical evidence to reveal the forces driving key actors and the interactions among them, this volume rediscovers a past largely forgotten but essential to understanding the genesis of competition law in Europe, its role in Europe's construction, its hybrid institutional traits, and its often unique substance.

Available in PDF, EPUB and Kindle. Book excerpt: 'This book is a most valuable contribution to the understanding of the complexity of European policies and their impact on individual businesses and industry as a whole. That focus makes this book unique. All in all, there are only a few books about the industrial policy of the European Union and none with such a focus.' - Karel van Miert, Universiteit Nyenrode, The Netherlands 'Contrary to standard works covering community industrial policy, this book is based on the experience of those involved in the actual formulation of policies. It documents the evolution of this policy towards a horizontal approach combining various instruments that need to be made consistent with each other. This book will be very valuable to scholars and policymakers alike.' - Alexis Jacquemin, European Commission and Université Catholique de Louvain, Belgium European policies increasingly affect the daily decisions of European firms. Better understanding of the motivation and reasoning behind policies that affect industry is therefore essential to those interested in or affected by industrial policy. Industry and the European Union explores different European policy areas, focusing on aspects that are of particular importance for business.
Book Synopsis Competition and Industrial Policy in the European Community by : Dennis Swann
Download or read book Competition and Industrial Policy in the European Community written by Dennis Swann and published by Routledge. This book was released on 2018-01-09 with total page 189 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book, first published in 1983, is primarily concerned with the economic policies of the European Economic Community and the European Coal and Steel Community. It explains in detail how the common market was established and how it was maintained. Free competition cannot be created merely by removing customs duties and quotas: it is also necessary to attack the many non-tariff barriers which would otherwise impede free movement. Moreover, the Community sought to develop an industrial policy, notably in relation to the ECSC, to provide a stance towards declining industries suffering from Developing World competition.

Book Synopsis The Regulation of the State in Competitive Markets in the EU by : Erika Szyszczak
Download or read book The Regulation of the State in Competitive Markets in the EU written by Erika Szyszczak and published by Bloomsbury Publishing. This book was released on 2007-08-31 with total page 322 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book looks at the changing role and nature of the regulation of State intervention in the liberalised and privatised markets of the European Union. It examines how the traditional role of the State is now challenged by European Union law, and the implications for traditional public services provided by the State. For the first time in an academic work, the book brings together the interaction of the Internal Market and the Competition rules of the European Union when they are applied to State economic activity. Individual chapters examine specific rules which address squarely the permissible role of State activity in competitive markets, for example an examination of the State aid rules, the rules in Article 86 EC regulating State monopolies and the controversial application of Articles 81 and 82 EC to the State. Other chapters examine the processes of privatisation and liberalisation with case studies on the postal sector, utilities and telecommunications.
