Book excerpt: The agricultural industry has been one of the principal contributors to a number of serious water quality problems that currently affect the groundwaters, rivers and lakes of Northern Ireland. The largest and most widespread of these is nutrient enrichment, which results in a phenomenon known as eutrophication. This causes accelerated growth of algae, excessive plant growth and consequential reduction in oxygen levels. The 1991 Nitrates Directive by the European Commission was intended to improve the use of nutrients on farms and result in improved water quality. The Department of Agriculture and Rural Development (DARD) introduced the Farm Nutrient Management Scheme (FNMS) in 2005 which was completed in December 2009. But the Scheme was poorly planned and badly managed. As a result, it cost many millions of pounds more than should have been necessary to ensure compliance. Combined with the fundamental uncertainty over the extent to which the Scheme is actually contributing to the improvement of Northern Ireland's water quality, the Committee can only conclude that the Scheme provided poor value for taxpayers' money. Contrary to best practice, the Department failed to set performance measures and targets for the Scheme. It also failed to set up a performance information database at the outset. The Department must ensure that all of its programmes have effective data systems built in from the start. The Committee felt that a much-reduced Scheme, specifically targeting those areas where eutrophication problems were greatest, might have proved a more cost-effective option. The Committee makes 12 recommendations.

Book excerpt: Although agriculture is one of the most significant and pernicious causes of water pollution in the U.S., federal environmental laws designed to protect water resources exclude or exempt most agricultural activities. State efforts to address water quality impacts from agriculture have met with little success. The challenge of finding a way to reduce agricultural water pollution without causing severe economic harm to farmers is one of the greatest environmental challenges of our time. Large scale industrialized agriculture, with its heavy reliance on fertilizer, pesticide and water inputs, is a major contributor to water pollution. Agricultural practices can cause serious adverse impacts to the quality of both groundwater and surfacewater. Rain or irrigation water that falls on farm fields, picks up water soluble pesticides such as atrazine and nutrients such as nitrites found in fertilizers, causing them to leach into groundwater. Rain and irrigation water that is not absorbed into the soil runs off of agricultural fields carrying with it a variety of pollutants which ultimately end up in surface water bodies. Run-off from farm fields frequently contains high levels of sediments from soil erosion from tilled fields, pesticides and fertilizers. Pesticides that enter waterbodies can adversely impact aquatic life. Nutrients from fertilizers can cause waterbodies to be hypereutrophied, which can severely impact submersed plants and aquatic animals. Run-off of sediments from soil erosion due to tilling can clog streams and fill in shallow areas in water bodies, thereby reducing habitat and light availability to submersed plants. A report by the National Water Quality Inventory identified agricultural nonpoint source (NPS) pollution as “the leading source of water quality impacts on surveyed rivers and lakes, the second largest source of impairments to wetlands, and a major contributor to contamination of surveyed estuaries and ground water.” The federal Clean Water Act (CWA), the primary federal authority for addressing water pollution, has been largely successful at reducing water pollution from point sources such as wastewater treatment plants and industrial discharges through the National Pollutant Discharge Elimination System (NPDES). A major shortcoming of the NPDES program, however is that it does not apply to NPS discharges, including most agricultural runoff. Although most pollutant discharges to waterbodies from agriculture are not subject to NPDES regulation, the federal CWA does require states to establish water quality standards and total maximum daily loads (TMDLs) that can be used by the states to address agricultural water pollution through regulatory or non-regulatory mechanisms. A TMDL tells you how much of a particular pollutant a particular water body can assimilate without a violation of a water quality standard. Thus, the establishment of TMDL's is an important step in ensuring that state water quality standards are met. The greatest challenge, however, is the allocation of TMDLs among all point and nonpoint source dischargers, and the implementation of the TMDLs. For point source discharges, TMDLs are allocated and implemented through the NPDES permit program and may require pollution reductions beyond what would be required using only technology-based standards. For nonpoint sources such as agricultural, the allocation and implementation of TMDLs is much more daunting. This Article will explore a number of legal mechanisms that could play a role in ensuring that discharges from agricultural activities do not cause or contribute to violations of water quality standards. Specifically, this article will evaluate the relative effectiveness of: 1) narrative nutrient criteria and numeric nutrient criteria, 2) TMDL implementation through regulatory and nonregulatory mechanisms; and 2) Design-based standards such as Best Management Practices (BMPs) and performance-based standards in reducing water pollution form agriculture. The Article will draw on experiences from the State of Florida, including Everglades's restoration efforts, and efforts to reduce agricultural pollution in the Chesapeake Bay basin to demonstrate the efficacy of a variety of approaches and will suggest a multifaceted, watershed-based approach comprised of a combination of regulatory and nonregulatory federal and state efforts.

DARD was responsible for administering the scheme between January 2005 and December 2009 and made total payments of 121 million to some 4,000 farmers. The scheme was originally intended to be run on a 'first come, first served basis' with a budget of 45 million, but the Department subsequently obtained approval from the Department of Finance and Personnel (DFP) to fund all applicants. DARD put forward the potential sale of its property at Crossnacreevy, with an initial informal valuation of 200 million with appropriate planning permission, In the context of seeking funding for the expanded FNMS scheme. In DFP's view, this potential receipt was the persuasive point and obtained Ministerial approval to provide DARD with the necessary capital cover. However, due to the absence of residential planning permission, subsequent professional advice was that the site would only produce potential market values ranging from 2.28 million to 5.87 million. Key recommendations made in this report include that the Department should: implement all EU Directives in a timely manner; establish relevant and meaningful performance measures for grant schemes; obtain accurate and up-to-date base information before the introduction of any grant scheme; take steps to obtain details of the slurry/manure storage capacity on all livestock farms in Northern Ireland

To help illuminate these issues, the National Research Council held a colloquium on July 12, 2007 in Washington, DC. Water Implications of Biofuels Production in the United States, based in part on discussions at the colloquium, concludes that if projected future increases in use of corn for ethanol production do occur, the increase in harm to water quality could be considerable from the increases in fertilizer use, pesticide use, and soil erosion associated with growing crops such as corn. Water supply problems could also develop, both from the water needed to grow biofuels crops and water used at ethanol processing plants, especially in regions where water supplies are already overdrawn. The production of "cellulosic ethanol," derived from fibrous material such as wheat straw, native grasses, and forest trimmings is expected to have less water quality impact but cannot yet be produced on a commerical scale. To move toward a goal of reducing water impacts of biofuels, a policy bridge will likely be needed to encourage growth of new technologies, best agricultural practies, and the development of traditional and cellulosic crops that require less water and fertilizer and are optimized for fuel production.
