The constitution provides for a multiparty democracy with legislative and executive branches, as well as an independent judiciary and a clear separation of powers. Legislative authority is vested in the unicameral parliament (Parliament). The Alliance for European Integration (AIE) coalition retained its parliamentary majority in November 2010 elections, which international observers stated met most Organization for Security and Cooperation in Europe (OSCE) and Council of Europe commitments. Security forces reported to civilian authorities. The most significant human rights problem in the country during the year was government corruption, which undermined the credibility and effectiveness of police and the judiciary as well as respect for the rule of law in general. Police torture and mistreatment of persons in detention was a second major area of concern. The government also failed to make progress in holding officials accountable for killings and other abuses committed by government security forces during the 2009 crackdown on postelection demonstrations. Other significant problems during the year included harsh and overcrowded conditions in prisons and detention centers; arbitrary detention by police; use of libel suits to harass media outlets; violence against women; trafficking in persons; discrimination against Roma; harassment of lesbian, gay, bisexual, and transgender (LGBT) individuals; limited enforcement of workers' rights; and child labor. While authorities investigated reports of official abuse in the security services and elsewhere, officials accused of human rights violations, complicity in trafficking, or corruption were rarely successfully prosecuted and punished. Impunity was a major problem.

The 2014 parliamentary elections met most Organization for Security and Cooperation in Europe (OSCE), Council of Europe, and other international commitments, although local and international observers raised concerns about the inclusion and exclusion of specific political parties. The significant number of parliamentarians switching parties in 2017 amid allegations of political pressure and bribery significantly reshaped parliament's structure and the parliamentary majority. Two rounds of presidential elections in 2016 resulted in the election of Igor Dodon. According to the OSCE election observation mission, both rounds were competitive and respected fundamental freedoms. International and domestic observers, however, noted polarized and unbalanced media coverage, harsh and intolerant rhetoric, lack of transparency in campaign financing, and instances of abuse of administrative resources.Civilian authorities maintained effective control over the security forces.Human rights issues included torture at prisons and psycho-neurological institutions; harsh prison conditions; arbitrary arrest or detention by authorities; restrictions on freedom of the media; refoulement of political asylum seekers to a country where they had a well-founded fear of persecution; high-level corruption; cases of forced abortion; rape and other violence against persons with disabilities in state institutions.

The bicameral parliament (Parlament) consists of the Senate (Senat) and the Chamber of Deputies (Camera Deputatilor), both elected by popular vote. The 2009 presidential elections were considered generally free and fair. Security forces reported to civilian authorities. Major human rights problems included trafficking of persons for labor, sexual exploitation, and forced begging. Significant societal discrimination against Roma continued. Government corruption remained a widespread problem that affected all sections of society. During the year there were reports that police and gendarmes mistreated and harassed detainees and Roma. Prison conditions remained poor. The judiciary lacked impartiality and was sometimes subject to political influence. Property restitution remained extremely slow, and the government failed to take effective action to return Greek Catholic churches confiscated by the former Communist government in 1948. A restrictive law on religion remained in effect. There were continued reports of violence and discrimination against women as well as child abuse. Anti-Semitic articles continued to be published and anti-Semitic, racist, xenophobic, and nationalistic views continued to be disseminated via the Internet. Government agencies provided inadequate assistance to persons with disabilities and neglected persons with disabilities who were institutionalized. Societal discrimination against lesbian, gay, bisexual, and transgender (LGBT) persons and individuals with HIV/AIDS, particularly children, remained problems. A new labor code eliminated the legal basis for collective bargaining at the national level, reduced protections against antiunion discrimination, and generally weakened workers' position vis-a-vis employers.

Book excerpt: Ours has been called a global "age of rights," an era in which respect for human rights is considered the highest aspiration of the international democratic community. Since the United Nation's 1948 Universal Declaration of Human Rights, a wide variety of protections—civil, political, economic, social, and cultural—have been given legal validation as countries ratify treaties, participate in intergovernmental organizations, and establish human rights tribunals and truth and reconciliation commissions. Yet notable human rights failures have marred the post-Declaration era, including ongoing state violence toward citizens, the selectivity of humanitarian intervention (evidenced by the international community's failure to respond in Rwanda), and recent legislation in advanced democracies that trades some rights for protection against the threat of terrorism. How are we to reconcile the language of rights with the reality? Do we live in an age of rights after all? In Protecting Human Rights, Todd Landman provides a unique quantitative analysis of the marked gap between the principle and practice of human rights. Applying theories and methods from the fields of international law, international relations, and comparative politics, Landman examines data from 193 countries over 25 years (1976-2000) to assess the growth of the international human rights regime, the effect of law on actual protection, and global variation in human rights norms. Landman contends that human rights foreign policy remains based more on geo-strategic interest than moral internationalism. He argues that the influence human rights ideals have begun to have on states cannot be separated from the broader impact of socioeconomic changes that swept the globe in the late twentieth century. Landman concludes that international law alone will not suffice to fully protect human rights—it must be accompanied by democratic government, effective conflict resolution, and just economic systems.
