Available in PDF, EPUB and Kindle. Book excerpt: Located at the junction of the St. Lawrence and Ottawa rivers, Montreal Island is the main contact point between French and English Canadians. Prior to Quebec's "Quiet Revolution" of the 1960s, local governments in Montreal both reflected and perpetuated the mutual isolation of French and English. Residential concentration in autonomous suburbs, together with self-contained networks of schools and social services, enabled English-speaking Montrealers to control the city's economy and to conduct their community's affairs with little regard for the French-speaking majority. The modernization of the Quebec state in the 1960s dramatically challenged this arrangement. The author demonstrates how the English-speaking politicians in cooperation with certain French-speaking allies have succeeded in preventing the wholesale adoption of ambitious schemes for metropolitan reorganization. He describes the workings of a society divided by language and ethnicity, where the pervasiveness of the politics of language impedes all plans for comprehensive metropolitan reform. This title is part of UC Press's Voices Revived program, which commemorates University of California Press's mission to seek out and cultivate the brightest minds and give them voice, reach, and impact. Book excerpt: The purpose of this guide is to provide a user-friendly handbook to inform school administrators and teachers about the Canadian Charter of Rights and Freedoms, highlighting some of its more prevalent implications for educational practice. The guide begins with a brief introduction to the Charter, followed by a synopsis of the pertinent rights and freedoms. The text then focuses on ten main concerns under the Charter and how they relate to both denominational and non-denominational schools and school systems throughout Canada. The sections of the guide cover legal, religious, equality, and minority language rights, plus rights relating to special education and school attendance. Where applicable, each section presents true-to-life case scenarios which highlight suggestions for dealing with those and similar situations.

Available in PDF, EPUB and Kindle. Book excerpt: Constitutions are meant to endure, providing both stability and adaptability. Their public legitimacy depends on the ability of the courts and other interpreters to get this balance right. Why, then, has Canada’s constitution – only four decades old – produced so many surprises? Canada’s Surprising Constitution investigates unexpected interpretations of the Constitution Act, 1982 by the courts. In this illuminating collection of essays, leading scholars reflect on these surprising interpretations, focusing on fundamental freedoms; equality, Aboriginal, and language rights; structural features of the Charter; as well as the courts’ approach to the interpretation of the Constitution. The public legitimacy of the Constitution requires that it be seen as both relevant, as circumstances change, but also true to the values it embodies. The responsibility for getting this balance right lies not only with judges but also with legislatures, executives, scholars, advocates, and public interest organizations. The thoughtful work of this volume is crucial in identifying, accounting for, and – looking ahead – anticipating potential surprises. Its thorough analysis also offers a view of the Constitution in action.

Book excerpt: This edited collection gathers together Canadian and non-Canadian scholars to reflect on and celebrate the 20thanniversary of the Quebec Secession Reference, delivered by the Canadian Supreme Court in 1998. It opens withtwo Canadian scholars exchanging thoughts on the legacy of the reference from a domestic perspective as one ofthe most questioned decisions of the Canadian Supreme Court. To follow, non-Canadian scholars discuss theimpact of this reference abroad, reflecting upon its influence in European and non-European contexts (Spain,Scotland, the EU after Brexit, Eastern European Countries, Ethiopia, and Asia). Two final chapters, one by a lawyerand one by a political scientist, explore the democratic theory behind that reference.
