Book Synopsis The Waitangi Tribunal by : Janine Hayward
Download or read book The Waitangi Tribunal written by Janine Hayward and published by Bridget Williams Books. This book was released on 2016-09-26 with total page 367 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Waitangi Tribunal sits at the heart of the Treaty settlement process, with a unique remit to investigate claims and recommend settlements. But although the claims process has been hugely controversial, little has been written about the Tribunal itself. These essays, by leading academics, lawyers and researchers, successfully fill that gap, examining the Tribunal’s role in reshaping Māori identity and society, the Tribunal’s future mission, and its contribution to ideas of justice and reparation. This perceptive analysis of a key institution is vital reading for anyone seeking to understand Treaty settlements. Book Synopsis Motiti by : New Zealand. Waitangi Tribunal

Book excerpt: "Motiti: report on the Te Moutere o Motiti inquiry is the result of a Waitangi Tribunal inquiry focusing on a 'kinship review' undertaken by the Crown in 2015 and 2016. This review sought to assess the claimants' argument that the tangata whenua of Motiti Island are a distinct tribal group, separate from Ngāti Awa, and that their historical Treaty of Waitangi claims remain unsettled. The review also aimed to clarify who the Crown should engage with in relation to Motiti by identifying which tribal group or groups had authority to speak for the island. Motiti examines the claimants' allegations that the review was flawed and that tit reached incorrect findings, perpetuating what they saw as the Crown's enduring failure to understand their identity and to recognise their distinct rights on Motiti. It also considers whether the Ngāti Awa Claims Settlement Act 2005 settled Motiti Island historical claims based on descent from Te Hapū."--Publisher information.

Book excerpt: " ... In order for environmental management to take account of the principles of the Treaty, the Commissioner has found that it must address the three main themes of partnership, tribal rangatiratanga, and active protection. The principal change implied for the existing environmental management system is a greater share of decision-making power between Crown/Pakeha and maori partners to the Treaty and greater cognisance of Maori cutlural values in the protection of resources and other taonga. The holistic approach of traditional Maori environmental management has much to offer, and is receiving belated recognition of its essential similarity to the ecological approach. ..."--Executive summary p. 1.

Book Synopsis Indigenous Aspirations and Rights by : Amy Klemm Verbos
Download or read book Indigenous Aspirations and Rights written by Amy Klemm Verbos and published by Routledge. This book was released on 2017-07-20 with total page 190 pages. Available in PDF, EPUB and Kindle. Book excerpt: Indigenous peoples are recognised as groups with specific rights based on their historical ties to particular territories. The United Nations estimates there are 370 million Indigenous peoples, with Indigenous populations being recognised in Australia, Canada, New Zealand, the United States, the Arctic region, Central and South America, and across Asia and Africa. Indigenous Aspirations and Rights takes an Indigenous perspective in examining the intersection of business with Indigenous peoples' rights, in light of the UN Global Compact and the PRME. Indigenous rights include, but are not limited to, human, cultural, educational, employment, participatory development, economic, and social rights, rights to land and natural resources, and impacts on identity, institutions, and relations. This book illustrates three main aspects of business practices in relation to Indigenous peoples: Indigenous perspectives on failures, business and ongoing challenges to Indigenous aspirations and rights, and modelling success for Indigenous and business interests. Edited by three leading voices in Indigenous rights research and practice, Indigenous Aspirations and Rights features contributions from around the globe. The work draws together policy implications for management and implications for Indigenous peoples, and examines how the PRME, the UN Global Compact, and the concept of socially responsible business can be expanded to encompass more positive outcomes for Indigenous peoples.
