Available in PDF, EPUB and Kindle. Book excerpt: In recent years, international trade in toxic waste and hazardous technologies by firms in rich industrialized countries has emerged as a routine practice. Many poor countries have accepted these deadly imports but are ill equipped to manage the materials safely. For more than a decade, environmentalists and the governments of developing countries have lobbied intensively and generated public outcry in an attempt to halt hazardous transfers from Northern industrialized nations to the Third World, but the practice continues. In her insightful and important book, Jennifer Clapp addresses this alarming problem. Clapp describes the responses of those engaged in hazard transfer to international regulations, and in particular to the 1989 adoption of the Basel Convention. She pinpoints a key weakness of the regulations—because hazard transfer is dynamic, efforts to stop one form of toxic export prompt new forms to emerge. For instance, laws intended to ban the disposal of toxic wastes in the Third World led corporations to ship these byproducts to poor countries for "recycling." And, Clapp warns, current efforts to prohibit this "recycling movement" may accelerate a new business endeavor: the relocation to poor countries of entire industries that generate toxic wastes.Clapp concludes that the dynamic nature of hazard transfer results from increasingly fluid global trade and investment relations in the context of a highly unequal world, and from the leading role played by multinational corporations and environmental NGOs. Governments, she maintains, have for too long failed to capture the initiative and have instead only reacted to these opposing forces.

Book excerpt: In the 1970s the world became aware of a huge danger: the destruction of the stratospheric ozone layer by CFCs escaping into the atmosphere, and the damage this could do to human health and the food chain. So great was the threat that by 1987 the UN had succeeded in coordinating an international treaty to phase out emissions; which, over the following 15 years has been implemented. It has been hailed as an outstanding success. It needed the participation of all the parties: governments, industry, scientists, campaigners, NGOs and the media, and is a model for future treaties. This volume provides the authoritative and comprehensive history of the whole process from the earliest warning signs to the present. It is an invaluable record for all those involved and a necessary reference for future negotiations to a wide range of scholars, students and professionals.

Book excerpt: In June 1997, heads of government and senior representatives from over 130 countries met in New York to consider what progress had been made since the first Earth Summit in 1992, and la decide upon priorities for the future. Earth Summit II presents the principal official documents agreed al the Summit alongside an authoritative analysis of where progress is and is not being made, the reasons for this, and the priorities of the parties involved. Finally, the authors look forward to the ten-year follow-up in 2002, and propose methods for ensuring that that event is both effective and participatory. Insightful and comprehensive, this will be essential reading for policy makers, lobbyists and students on environment and development courses.

Available in PDF, EPUB and Kindle. Book excerpt: Environmental harms exert a significant toll and pose substantial economic costs on societies around the world. Although such harms have been studied from both legal and social science perspectives, these disciplinary-specific approaches are not, on their own, fully able to address the complexity of these environmental challenges. Many legal approaches, for example, are limited by their inattention to the motivations behind environmental offences, whereas many social science approaches are hindered by an insufficient grounding in current legislative frameworks. This edited collection constitutes a pioneering attempt to overcome these limitations by uniting legal and social science perspectives. Together, the book’s contributors forge an innovative socio-legal approach to more effectively respond to, and to prevent, environmental harms around the world. Integrating theoretical and empirical work, the book presents carefully selected illustrations of how legal and social science scholarship can be brought together to improve policies. The various chapters examine how a socio-legal approach can ultimately lead to a more comprehensive understanding of environmental harms, as well as to innovative and effective responses to such environmental offences.

Available in PDF, EPUB and Kindle. Book excerpt: Protecting the Ozone Layer: Lessons, Models, and Prospects Since the mid-1980s, the international community has adopted several significant instruments designed to reverse the degradation of the life support systems of the planet. None of these international agreements have been as successful as the 1987 Montreal Protocol in creating the incentives and mechanisms for protecting the ozone layer. Through the efforts of industry, government and public interest groups, national commitments and achievements have progressed further and faster than expected, while the list of controlled chemicals has expanded. Now in its second decade, the Protocol enters a crucial phase of its implementation. Protecting the Ozone Layer: Lessons, Models, and Prospects presents a wealth of information about the scientific, legal-political, and technological hurdles that we will have to overcome if humanity is to reverse its self-destructive course. The technology section in particular should appeal to industries affected by ozone layer protection as well as those affected by climate protection, since this is the first ozone publication featuring insights by the companies that spearheaded the major technological breakthroughs. Every initiative to improve the environmental performance of industry has been accompanied by pronouncements of economic devastation, from acid rain to auto emissions standards, from auto mileage improvements to the protection of the ozone layer. Each new initiative brought claims from industry that this situation was different, yet none of their predictions have come true. At a time when industry fights efforts to protect the environment, the ozone experience shows both how technical breakthroughs have enabled environmental protection policies to work in the past and how they will work again in the future. Protecting the Ozone Layer: Lessons, Models, and Prospects is the product of a Colloquium that was organized in September 1997 to celebrate the tenth anniversary of the Montreal Protocol. Contributions have been gathered from researchers and practitioners in the field, including some of the very same scientists whose work awakened the international community to the seriousness of the danger that humanity now faces. Other contributors include the scholars and diplomats who wrote and negotiated the text of the Protocol and its amendments, and the key figures who have been influential in convincing industry to support the process.
