Mustering tens of thousands of previously overlooked arrest and prison records, John K. Bardes demonstrates the opposite: in parts of the South, enslaved and free people were jailed at astronomical rates. Slaveholders were deeply reliant on coercive state action. Authorities built massive slave prisons and devised specialized slave penal systems to maintain control and maximize profit. Indeed, in New Orleans—for most of the past half-century, the city with the highest incarceration rate in the United States—enslaved people were jailed at higher rates during the antebellum era than are Black residents today. Moreover, some slave prisons remained in use well after Emancipation: in these forgotten institutions lie the hidden origins of state violence under Jim Crow. With powerful and evocative prose, Bardes boldly reinterprets relations between slavery and prison development in American history. Racialized policing and mass incarceration are among the gravest moral crises of our age, but they are not new: slavery, the prison, and race are deeply interwoven into the history of American governance.

Historically, women incarcerated in prison, jails, and reformatories accounted for a small number of inmates across the United States. Early on, they were often held in prisons alongside men and faced neglect, exploitation, and poor living conditions. Various attempts to reform them, ranging from moral instruction and education to domestic training, faced opposition at times from state officials, prison employees, and even male prison reformers. Due to the consistent small populations and relative neglect the women often faced, their experiences in prison have been understudied. This collection of essays seeks to recapture the perspective on women’s prison experience from a range of viewpoints. This edited collection will explore the challenges women faced as inmates, their efforts to exert agency or control over their lives and bodies, how issues of race and social class influenced experiences, and how their experiences differed from that of male inmates. Contributions extend from the early nineteenth century into the twenty-first century to provide an opportunity to examine change over time with regards to female imprisonment. Furthermore, the chapters examine numerous geographic regions, allowing for readers to analyze how place and environment shapes the inmate experience.

It is extraordinarily difficult for historians to reconstruct the lives of individual enslaved people. Records—where they exist—are often fragmentary, biased, or untrue. In Enslaved Archives, Maria R. Montalvo investigates the legal records, including contracts and court records, that American antebellum enslavers produced and preserved to illuminate enslavers' capitalistic motivations for shaping the histories of enslaved people. The documentary archive was not simply a by-product of the business of slavery, but also a necessary tool that enslavers used to exploit the people they enslaved. Building on Montalvo's analysis of more than 18,000 sets of court records, Enslaved Archives is a close study of what we can and cannot learn about enslaved individuals from the written record. By examining five lawsuits in Louisiana, Montalvo deconstructs enslavers' cases—the legal arguments and rhetorical strategies they used to produce information and shape perceptions of enslaved people. Commodifying enslaved people was not simply a matter of effectively exploiting their labor. Enslavers also needed to control information about those people. Enslavers' narratives—carefully manipulated, prone to omissions, and sometimes false—often survive as the only account of an enslaved individual's life. In working to historicize the people at the center of enslavers' manipulations, Montalvo outlines the possibilities and limits of the archive, providing a glimpse of the historical and contemporary consequences of commodification. Enslaved Archives makes a significant intervention in the history of enslaved people, legal history, and the history of slavery and capitalism by adding a qualitative dimension to the analysis of how enslavers created and maintained power.

Though existing scholarship shows that intraracial black violence did not reach high levels until after Reconstruction, contemporary records bear witness to its regular presence among enslaved populations. Slave against Slave explores the roots of and motivations for such violence and the ways in which slaves, masters, churches, and civil and criminal laws worked to hold it in check. Far from focusing on violence alone, Forret’s work also adds depth to our understanding of morality among the enslaved, revealing how slaves sought to prevent violence and punish those who engaged in it. Forret mines a vast array of slave narratives, slaveholders’ journals, travelers’ accounts, and church and court records from across the South to approximate the prevalence of slave-against-slave violence prior to the Civil War. A diverse range of motives for these conflicts emerges, from tensions over status differences, to disagreements originating at work and in private, to discord relating to the slave economy and the web of debts that slaves owed one another, to courtship rivalries, marital disputes, and adulterous affairs. Forret also uncovers the role of explicitly gendered violence in bondpeople’s constructions of masculinity and femininity, suggesting a system of honor among slaves that would have been familiar to southern white men and women, had they cared to acknowledge it. Though many generations of scholars have examined violence in the South as perpetrated by and against whites, the internal clashes within the slave quarters have remained largely unexplored.
