Book excerpt: Andrews on Civil Processes is a fresh and stimulating examination of Civil Justice, embracing court proceedings, mediation, and arbitration. A critical and principled treatment of the subject made possible by extensive knowledge not only in the English methods and techniques but also in foreign civil procedural laws. The work guides the reader through the practice of dispute resolution in all its major forms - public and private, adjudicative and conciliatory and thus provides a complete picture of the court and arbitration systems, and of the developing technique of mediation. It is an outward-looking work and advisors seeking further leads are assisted by detailed citation of primary sources and rich bibliographical references to national and foreign works. As a fundamental and systematic treatment of the subject by a leading expert, this fully revised and updated 2nd edition is an essential work of reference for litigation advisors, judges, commentators, and students. As many non-resident parties choose to conduct arbitration in London or bring proceedings before the English High Court, notably the Commercial Court, the clear and well-ordered structure of Andrews of Civil Process is also of interest to the lawyers beyond England and Wales.
Book Synopsis Arbitration and Contract Law by : Neil Andrews
Download or read book Arbitration and Contract Law written by Neil Andrews and published by Springer. This book was released on 2016-04-18 with total page 347 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book deals with the contractual platform for arbitration and the application of contractual norms to the parties' dispute. Arbitration and agreement are inter-linked in three respects: (i) the agreement to arbitrate is itself a contract; (ii) there is scope (subject to clear consensual exclusion) in England for monitoring the arbitral tribunal's fidelity and accuracy in applying substantive English contract law; (iii) the subject-matter of the arbitration is nearly always a ‘contractual’ matter. These three elements underlie this work. They appear as Part I (arbitration is founded on agreement), Part II (monitoring accuracy), Part III (synopsis of the English contractual rules frequently encountered within arbitration). The book will be a useful resource to foreign lawyers or English non-lawyers, English lawyers seeking a succinct discussion, and to arbitral tribunals.

This book was released on 2007-01-29 with total page 242 pages. Available in PDF, EPUB and Kindle. Book excerpt: The ALI (American Law Institute) and UNIDROIT (the International Institute for the Unification of Private Law) are preeminent organizations working together toward the clarification and advancement of the procedural rules of law. Recognizing the need for a “universal” set of procedures that would transcend national jurisdictional rules and facilitate the resolution of disputes arising from transnational commercial transactions, Principles of Transnational Civil Procedure was launched to create a set of procedural rules and principles that would be adopted globally. This work strives to reduce uncertainty for parties that must litigate in unfamiliar surroundings and to promote fairness in judicial proceedings. As recognized standards of civil justice, Principles of Transnational Civil Procedure can be used in judicial proceedings as well as in arbitration. The result is a work that significantly contributes to the promotion of a universal rule of procedural law. The American Law Institute was organized in 1923 following a study conducted by a group of prominent American judges, lawyers, and law professors. Their recommendation that a lawyers' organization be formed to improve the law and its administration led to the creation of The American Law Institute. UNIDROIT was founded in 1926 as a specialized agency of the League of Nations. It exists as an independent intergovernmental organization on the basis of a multilateral agreement, the UNIDROIT Statute. Its purpose is to study needs and methods for modernizing, harmonizing, and coordinating private laws between states and groups of states and to prepare legislative texts for consideration by governments.

Book Synopsis Injustice in Residential Care by : Great Britain. Parliamentary and Health Service Ombudsman
Download or read book Injustice in Residential Care written by Great Britain. Parliamentary and Health Service Ombudsman and published by The Stationery Office. This book was released on 2008-03-26 with total page 36 pages. Available in PDF, EPUB and Kindle. Book excerpt: This joint report from the Health Service Ombudsman and the Local Government Ombudsman investigates complaints made by Mr & Mrs Taylor against Buckinghamshire County Council and Oxfordshire & Buckinghamshire Mental Health Partnership Trust. The complaints concern the care provided to their son, Frank, an adult with severe learning disabilities, from June 2001 to September 2003. Frank has no speech; cannot bathe, shave or dress himself; needs assistance to go to the toilet; needs to wear incontinence pads at night or for any lengthy periods spent outdoors. He needs one-to-one attention for 95 per cent of his waking time. The Council took over responsibility for the operation and management of the home in July 2002. In the care home his care needs were never properly assessed, and a number of significant failings in the level of care were identified. Complaints to both organisations were dealt with slowly, and there was confusion about which body should address the separate aspect of the complaints. Frank was removed from the care home, and kept and cared for at home for three months with no external support. The Ombudsmen, acting jointly under the Regulatory Reform (Collaboration etc between Ombudsmen) Order 2007, investigated. They find maladministration causing injustice and anxiety and distress to Frank and his parents. The conditions and care within the care home were unacceptable, and the Council failed to recognise that when taking over management responsibility. Frank's human rights may also have been infringed. The Ombudsmen recommend a payment of £32,000 as remedy for the injustice and distress caused.
