Yet despite regulation’s increased presence in current politics and media, The Politics of Regulatory Reform argues that the regulatory process and its influence on the economy is misunderstood by the general public as well as by many politicians. In this book, two experienced regulation scholars confront questions relevant to both academic scholars and those with a general interest in ascertaining the effects and importance of regulation. How does regulation impact the economy? What roles do politicians play in making regulatory decisions? Why do politicians enact laws that require regulations and then try to hamper agencies abilities to issue those same regulations? The authors answer these questions and untangle the misperceptions behind regulation by using an area of regulatory policy that has been underutilized until now. Rather than focusing on the federal government, Shapiro and Borie-Holtz have gathered a unique dataset on the regulatory process and output in the United States. They use state-specific data from twenty-eight states, as well as a series of case studies on regulatory reform, to question widespread impressions and ideas about the regulatory process. Book excerpt: On January 18, 2011, President Obama signed Executive Order 13563, Improving Regulation and Regulatory Review, which instructs federal regulators to do the following: coordinate their agencies activities to simplify and harmonize rules that may be overlapping, inconsistent, or redundant; determine whether the present and future benefits of a proposed regulation justify its potential costs (including taking into account both quantitative and qualitative factors); increase participation of industry, experts, and the public (“stakeholders”) in the formal rule-making process; encourage the use of warnings, default rules, disclosure requirements, and provisions of information to the public as an alternative to traditional “command-and-control” rule-making restricting consumer choice; and mandate a government-wide review of all existing administrative rules to remove outdated regulations. Executive Order 13563 includes a qualitative “values” provision to be considered in the required cost-benefit analysis, which can potentially counteract the alleged regulatory reform rationale of President Obama. Furthermore, in Executive Order 13563, President Obama established a deadline of May 18, 2011, for all executive branch agencies to submit their plans to streamline their rulemaking operations and repeal those “overlapping, inconsistent, or redundant” rules. These two issues, along with complementary regulatory review proposals being discussed in the U.S. Congress, are evaluated in this essay.

Book excerpt: Pursuant to a congressional request, GAO discussed the implementation of Executive Order 12866, which is intended to improve regulatory planning and review. GAO noted that: (1) the extent of federal agencies' cost-benefit analyses of proposed regulations depends on whether the regulatory action is economically significant or significant for noneconomic reasons; (2) agencies are required to provide the Office of Information and Regulatory Affairs (OIRA) with their cost-benefit analyses of the regulatory action, but agencies often do not perform these analyses because they believe the analyses are not worth the time and effort; (3) OIRA provided cost-benefit analyses for 28 of 29 economically significant regulatory actions reviewed, but 2 of these analysis did not contain all required elements; (4) 14 significant noneconomic regulatory actions did not have cost-benefit analyses for various reasons; (5) although there was evidence of OIRA involvement in all regulations reviewed, the data was insufficient to determine whether OIRA-recommended changes were made; (6) at present, OIRA reviews are limited to only significant regulatory actions; (7) OIRA works informally with agencies during regulations' development and its influence may often be indirect and subtle; (8) for 21 of 32 rules, OIRA-suggested changes appear to have been substantive; and (9) periodic agency reviews of regulations have resulted in the elimination or revision of some regulations, but the overall regulatory burden appears not to have been significantly reduced because of regulatory obsolescence and duplication and the addition of new regulations.
