Book excerpt: Final Guidance for Federal Departments and Agencies - Establishing, Applying, and Revising Categorical Exclusions under National Environmental Policy Act (US Council on Environmental Quality Regulation) (CEQ) (2018 Edition) The Law Library presents the complete text of the Final Guidance for Federal Departments and Agencies - Establishing, Applying, and Revising Categorical Exclusions under National Environmental Policy Act (US Council on Environmental Quality Regulation) (CEQ) (2018 Edition). Updated as of May 29, 2018 The Council on Environmental Quality (CEQ) is issuing its final guidance on categorical exclusions. This guidance provides methods for substantiating categorical exclusions, clarifies the process for establishing categorical exclusions, outlines how agencies should engage the public when establishing and using categorical exclusions, describes how agencies can document the use of categorical exclusions, and recommends periodic agency review of existing categorical exclusions. A categorical exclusion is a category of actions that a Federal agency determines does not normally result in individually or cumulatively significant environmental effects. This guidance clarifies the rules for establishing, applying, and revising categorical exclusions. It applies to categorical exclusions established by Federal agencies in accordance with CEQ regulations for implementing the procedural provisions of the National Environmental Policy Act. The guidance was developed to assist agencies in making their implementation of the National Environmental Policy Act (NEPA) more transparent and efficient. Book excerpt: The purpose of this guide is to provide the Ballistic Missile Defense Organization (BMDO) managers and executing agents with an overview of the National Environmental Policy Act (NEPA) process, thus allowing BMDO to comply effectively with NEPA. This guide will help Program Managers and Project Integrators to comply effectively with NEPA in accomplishing the BMDO mission. What is NEPA? NEPA became law on January 1, 1970. The Act established national environmental policy and goals for the protection, maintenance, and enhancement of the environment, and it provided a process for implementing these goals within federal agencies. The Act also established the President's Council on Environmental Quality (CEQ), whose primary role is oversight of NEPA compliance. The CEQ published Regulations for Implementing the Procedural Provisions of the National Environmental Policy Act (Title 40, Code of Federal Regulations, parts 1500-1508).

Book excerpt: The Law Library presents the complete text of the Environmental Policies and Procedures - Compliance with the National Environmental Policy Act and Related Authorities (US Rural Utilities Service Regulation) (RUS) (2018 Edition). Updated as of May 29, 2018 The Farm Service Agency (FSA) is consolidating, updating, and amending its regulations implementing the National Environmental Policy Act of 1969, as amended (NEPA). FSA's previous NEPA regulations had been in place since 1980. Significant changes to the structure of FSA and the scope of FSA's programs require changes in FSA's NEPA regulations. The changes will also better align FSA's NEPA regulations with the President's Council on Environmental Quality (CEQ) NEPA regulations and meet the FSA responsibilities for periodic review of their categorical exclusions (CatExs). CatExs involve proposed actions that typically do not result in individual or cumulative significant environmental effects or impacts and therefore do not merit further environmental review in an Environmental Assessment (EA) or Environmental Impact Statement (EIS). The additions to the existing list of CatExs improves the clarity and consistency of the regulations. This final rule also expands and clarifies the list of proposed actions that require an EA. The FSA NEPA implementing regulations also cover the Commodity Credit Corporation (CCC) programs that FSA administers on behalf of CCC. In addition, this rule makes conforming changes to existing references to FSA NEPA regulations in other FSA regulations. The revisions to the FSA NEPA implementing regulations are intended to improve transparency and clarity of the FSA NEPA process for FSA program participants, and to provide for a more efficient environmental review that will lead to better decisions and outcomes for stakeholders and the environment. Finally, in coordination with the Rural Housing Service, Rural Business-Cooperative Service, and Rural Utilities Service, this rule removes the old NEPA regulations. This ebook contains: - The complete text of the Environmental Policies and Procedures - Compliance with the National Environmental Policy Act and Related Authorities (US Rural Utilities Service Regulation) (RUS) (2018 Edition) - A dynamic table of content linking to each section - A table of contents in introduction presenting a general overview of the structure

No one knows more about NEPA than Lynton Caldwell. And no one has a clearer vision of its relevance to our future. Highly recommended." —David W. Orr, Oberlin College What has been achieved since the National Environmental Policy Act was passed in 1969? This book points out where and how NEPA has affected national environmental policy and where and why its intent has been frustrated. The roles of Congress, the President, and the courts in the implementation of NEPA are analyzed. Professor Caldwell also looks at the conflicted state of public opinion regarding the environment and conjectures as to what must be done in order to develop a coherent and sustained policy.

Addressing these issues requires an understanding of technical, economic, and policy perspectives; based upon extensive research and practical experience of the authors, these perspectives are thoughtfully and clearly presented. Covered in this book are subjects related to environmental engineering and planning which include environmental laws and regulations, international perspectives on environmental analysis engineering and planning, economic and social impact analysis, public participation, and energy and environmental implications of major public works and private projects. Contemporary issues ranging from climate change to ecorisk and sustainability are covered in a special section as well. Under Contemporary Challenges are environmental issues that have received considerable public support and concern; they include: climate change, acid rain, deforestation, endangered species, biodiversity, ecorisk, cultural resources, and sustainability. For most of these issues, there are scientific agreements and disagreements; there are many uncertainties, thus views differ widely. These topics are discussed in considerable detail. Notwithstanding uncertainties and differing views on such topics, all of this information is put in a policy context such that progress towards addressing these contemporary challenges can be made while consensus on the nature and extent of the problem and resultant solutions are being developed. The book provides considerable information about many timeless issues. These issues range from resources needed for sustaining the quality of life on the planet: air resources to natural resources. Specifically covered are: air, water, land, ecology, sound/noise, human aspects, economics, and resources. For each of these areas, some of the key elements are described so that one can effectively manage complex environmental engineering and planning requirements. Each of the elements are clearly defined and other information, such as how human activities affect the element, source of affects, variable to be measured, how such variables can be measured, data sources, and evaluation and interpretation of data, etc. are provided. Material presented provides a rich source of information so the reader can efficiently and effectively use it to make meaningful environmental engineering, planning, and management decisions. Book excerpt: As contained in the Regulations for Implementing the Procedural Provisions of the National Environmental Policy Act, 40 CFR 1500--1508, the Council on Environmental Quality (CEQ) directs federal agencies to adopt their own procedures for implementing the Act. The US Department of Energy (DOE) and the US Department of Agriculture Forest Service (USFS) are two examples of federal agencies with dissimilar but functionally equivalent CX processes. The DOE and USFS were selected as subjects for this study because of their distinctly different missions and as a results of the author's familiarity with the policies of both agencies. The objectives of this study are to: (1) describe the CX policies and processes of the two agencies, (2) identify the similarities and differences between the two processes, and (3) suggest ways for improving these processes. In performing this evaluation, the authors will identify the components of each agency's CX process that clearly contributes qualitative information for the purpose of making environmental planning decisions. Drawing from the best elements of each process, the authors will provide some general recommendations that should enable the agencies to fulfill their various obligations to the CX process while concurrently performing early, thorough, and expeditious environmental reviews under NEPA.
