Book excerpt: This study evaluates the effect of incentive regulation on the productivity of U.S. local exchange carriers between 1988 and 1993. Introducing pure price-cap schemes has a strong and positive, but lagged, effect on technical efficiency. Where price-cap schemes operate in conjunction with an earnings- sharing scheme, there is immediate effect on technical efficiency, but the impact is less strong than the effect of a pure price-caps scheme. Where only an earnings-sharing scheme operates, its effect is detrimental to technical efficiency. Weaker, though broadly positive, results are obtained as to the effect of incentive regulation on scale efficiency.

Nowhere else in the industrial world is it easier to set up a discount store, start a new airline, or shrink a payroll. But extensive economic deregulation has been matched by a burgeoning body of social law cracking down on business. From shareholder litigation and strict product liability to punitive environmental controls and workplace rules, entrepreneurs run a gauntlet of legal perils. The costs of this expanding and contentious agenda often exceed the value of its social benefits. The projected annual costs over benefits of the 1990 Clean Air Act, for instance, surpass the estimated value of U.S. exports blocked by all of Japan's known import restrictions. How sustainable is this situation amid the pressures of globalization? The contributors to this volume explore the question from a variety of perspectives. U.S. policymakers frequently criticize the rest of the world for policies and practices that are said to constrict American commerce. Yet some trade disputes have been ignited by questionable rules made in the United States. Indeed, legal strictures have posed barriers to imports and possibly discouraged foreign investors, as well as interfered with some U.S. exports. At times the social regulatory regime has also stirred abrasive efforts to extend U.S. sanctions to foreign soil. Even if those frictions have been of minor consequences so far, inefficient legal and regulatory conventions exact a toll on U.S. productivity growth. The book concludes that in a global economy the burdensome regulations of foreign countries deserve attention, but increasingly so do the burdens that American "adversarial legalism" imposes on itself and sometimes on others. Ideas and prospects for correcting the problem are discussed throughout. The contributors include Lee Axelrad, Thomas F. Burke, Loren Cass, Robert A. Kagan, Mark K. Landy, Roger G. Book excerpt: Incentive regulation is designed to improve productive efficiency, enhance service quality and consumer welfare, and reduce the costs of regulation. The issue that is considered here is whether incentive regulation in the form of a price cap applicable to interstate access service to local loops in the telecommunications industry in the United States has resulted in an increase in the technical efficiency and allocative efficiency of local exchange carriers. The results suggest that for changes in technical efficiency, there is a definite randomness between 1985 and 1993 with technical efficiency increasing in some years and decreasing in others. Subsequent to 1993, however, there is a consistent improvement in technical efficiency. Given that incentive regulation in the form of price caps was implemented in 1991, it is likely that some portion of the improvement in technical efficiency subsequent to 1993 is attributable to incentive regulation.

By means of a new set of quantitative indicators of regulation, we show that the cross-country variation of regulatory settings has increased in recent years, despite extensive liberalisation and privatisation in the OECD area. We then look at the regulation-growth linkage using data that cover a large set of manufacturing and service industries over the past two decades. We focus on multifactor productivity (MFP), which plays a crucial role in GDP growth and accounts for a significant share of its cross-country variance. We find evidence that reforms promoting private governance and competition (where these are viable) tend to boost productivity. Both privatisation and entry liberalisation are estimated to have a positive impact on productivity. Einhorn In continuing to deregulate telecommunications companies, regulators have begun to consider alternative approaches to traditional cost-based price regulation as a means of encouraging monopoly efficiency, promulgating technological innova tion, protecting consumers, and reducing administrative costs. Under cost-based regulatory procedures that had been used, prices were designed to recover the regulated company's costs plus an allowed rate of return on its rate base; this strategy was costly to administer, provided no consistent incentives to cost-ef ficiency and technological improvement, afforded many opportunities for strategic misrepresentation of reported costs, and may have encouraged both uneconomic expansion of the utility's rate base and cross-subsidization of its competitive services. A category of alternative regulatory approaches can be classified broadly as social contracts. Under the general strategy of social contract regulation, regulators first delimit a group of regulated core services that they continue to regulate and then stipulate a list of constraints that the utility must agree to meet in the future; in exchange, regulators agree to detariff or deregulate entirely other competitive or nonessential services that the utility may offer. As long as no stipulated constraints are violated, the utility may price freely any service; if it reduces costs, it may keep a share of its profits. According to the National Telecommunications Information Administration (NTIA, 1987), social contract agreements of one form or another have been considered or implemented in a majority of American states.
