Available in PDF, EPUB and Kindle. Book excerpt: The metaverse seems to be on everybody’s lips – and yet, very few people can actually explain what it means or why it is important. This book aims to fill the gap from an interdisciplinary perspective informed by law and media and communications studies. Going beyond the optimism emanating from technology companies and venture capitalists, the authors critically evaluate the antecedents and the building blocks of the metaverse, the design and regulatory challenges that need to be solved, and commercial opportunities that are yet to be fully realised. While the metaverse is poised to open new possibilities and perspectives, it will also be a dangerous place – one ripe with threats ranging from disinformation to intellectual property theft to sexual harassment. Hence, the book offers a useful guide to the legal and political governance issues ahead while also contextualising them within the broader domain of governance and regulation of digital technologies.

Available in PDF, EPUB and Kindle. Book excerpt: This open access book examines regulating an environment that has no jurisdiction, is fully anonymous and infinitely vast? Welcome to the Metaverse, an online virtual reality that is expected to add billions to the global economy. The Metaverse offers a new type of virtual economy with practically endless business opportunities. The question is how to prevent these opportunities from being abused to commit money laundering and finance terrorism (MLFT). This book explores the current European Union legislation designed to prevent MLFT in connection with the Metaverse. It analyses the legislation in relation to the three traditional stages of MLFT: placement, layering and integration. Furthermore, some additional risks specific to the Metaverse are discussed, such as Non-Fungible Tokens (NFTs) and the high level of anonymity. The book concludes that the current legislation is not suitable for facing the new challenges of the Metaverse. In turn, the book puts forward a novel approach to regulating and enforcing MLFT legislation: using a system of smart assets equipped with AI to prevent and detect MLFT. In addition, it makes recommendations on how to improve the legal framework with regard to the new challenges arising from the Metaverse. Particular attention is given to creating a legal framework that incorporates the use of smart assets and the Internet of Things, in order to provide a safe environment for potential users and society. With a solid background in financial law and technology, the author successfully creates a novel system of regulation and enforcement that is based on the use of automatic enforcement, whilst keeping sufficient legal safeguards in place for potential Metaverse users. This book will be of interest to anyone interested in the Metaverse. Whether you want to regulate it or open your own virtual business, it’s a must-read!

Book excerpt: The digital era has improved many aspects of our lives. There has never been greater access to information, nor a time when so much of the information available to us was free. Many marginalized groups and individuals now have large and unstoppable digital megaphones in their hands. Those who are physically far apart can feel closer to each other. Art has never been so easy to find, nor have so many artists paid for their work. Similarly, knowledge and expert opinions in fields ranging from medicine to law to education to aeronautics to finance are readily available through digital media (usually free). The metaverse is a shared virtual world accessed through physical means that users can access from any platform while connected to the internet, and where they can interact through their virtual avatars. It will likely be used for a multitude of purposes such as gaming (the primary use as of now), shopping and novel advertising, job training, education, working remotely, doctor's appointments, travel, social activities, entertainment, buying and selling virtual land, trading crypto & NFT's and selling real-world goods virtually. Access to the Metaverse can be via virtual reality, augmented reality, or a combination of both. Metaverse is a unique development in cyberspace. It uses Virtual Reality (VR) and Augmented Reality (AR) headsets to transpose users from physical space to virtual reality. A person sitting in Nigeria can roam the fields and hill tracts of Mongolia. People can weigh in on opinions about the Russia-Ukraine conflict, Taiwan strait crisis, and Israel-Palestine dispute amongst a host of other topics with people across the globe while interacting in the Plaza and people with common interests such as soccer fans can find a meeting place. Also, business executives can conduct conferences, attend meetings, and deliver presentations while sitting in the comfort of their homes. However, a host of important questions arise as to how to regulate this new frontier. The issues of concern regarding data collection (such as biometric data specifically), which might later be used by algorithms for targeted advertised campaigns make regulators wary of this new space. Moreover, there is the looming threat that with a lack of criminal code regulating activities in the metaverse, it might be circumvented by unscrupulous fraudulent actors for unlawful activities. These concerns are addressed in Section iii (a) of this report. Also, the question of regulating and underwriting financial transactions and contracts in the metaverse is something that is not entirely covered by existing laws and regulations. Lastly, the spread of fake news across the metaverse can result in disastrous consequences in the real world. The need to regulate the metaverse requires a robust legal architecture that caters to the ever-evolving needs of this new space; in particular regulating targeted advertising and marketing in this new domain.

Available in PDF, EPUB and Kindle. Book excerpt: Regulating Digital Industries is the first book to address the tech backlash within a coherent policy framework. It treats competition, privacy and free speech as objectives that must be pursued in a coordinated fashion by a dedicated industry regulator. It contains detailed discussions of current policy controversies involving social media companies, search engines, electronic commerce platforms and mobile apps. It argues for new laws and regulations to promote competition, privacy and free speech in tech and outlines the structure and powers of a regulatory agency able to develop, implement and enforce digital rules for the twenty-first century. Deeply informed by the history of regulation and antitrust in the United States, it brings to bear insights from the breakup of AT&T and the Microsoft case and from broadcasting and financial services regulation to enrich the discussion of remedies to the failure of tech competition, the massive invasion of privacy by digital firms and the information disorder perpetuated by social media platforms. It offers a comprehensive summary of regulatory reform efforts in the United States and abroad and shows how accomplishing the goals of these reform efforts requires the establishment of a single digital agency with jurisdiction to reconcile and balance the complementary and conflicting goals of promoting competition, protecting privacy, and preserving free speech in digital industries. It discusses in detail how a digital regulatory agency would be structured and the powers it would need to have. It confronts head on some of the challenges in establishing a strong digital regulator including the First Amendment roadblock that limits government authority over digital speech and the judicial opposition to the expansion of the administrative state. It is essential reading for policymakers, public interest advocates, industry representatives, academic researchers and the general public interested in a coherent policy approach to today’s tech industry discontents.

Available in PDF, EPUB and Kindle. Book excerpt: This edited volume examines the impact of the metaverse on finance and law. As the commercial development of the internet and digital technology has done for more than thirty years, the metaverse phenomenon raises questions about the relevance of existing legal rules in dealing with new practices: between the need for adaptation, evolution, or new rules. While the Blockchain ecosystem has developed steadily over the last few years and its applications are still evolving, can we assume that the metaverse will become "the most prodigious phenomenon of the 21st century"? The term metaverse refers to a virtual world. Technically, using known but evolving technologies, the term refers to a network of 3D virtual worlds. In its current state of development, there is a metaverse and not a single virtual world as there is an internal one, simply because its development is still dependent on proprietary technologies. The development of the metaverse is no less accurate, and a few recent examples suggest that lawyers will not be able to escape this phenomenon, which looks set to involve individuals, companies, and institutions. The financial world is not immune to the emergence of the metaverse either. Traditional finance is moving into new virtual worlds. Several banks and insurance companies are entering this world, far removed from their traditions. Some have even set up branches there. However, what are these financial institutions trying to achieve by entering this market segment? This book addresses these questions with contributions from academics and experts from both fields.

Virtual reality is the next new frontier for Silicon Valley. Mark Zuckerberg, who has overseen Meta’s investment of billions into VR, pitches it as the next dominant computing paradigm. More than just a gaming technology, VR is top of mind for academics, tech reportage, and industry evangelists who all see the potential for VR to revolutionize fields such as education and health, as well as the way we work and communicate. But will VR achieve all this? In Fantasies of Virtual Reality, Marcus Carter and Ben Egliston strip bare the tech industry’s vision of a future dominated by immersive VR experiences, challenging the utopian promises of this technology’s potential. Carter and Egliston offer a critical account of VR in a variety of contexts, from gaming to human resources to policing and the military. They argue that while VR does hold significant potential, the overhyped expectations surrounding it, from achieving true empathetic understanding to transforming traditional education and office work, are often overstated and fraught with issues of privacy, control, and exclusion. What’s more, there is nothing truly virtual about virtual reality: VR is deeply entrenched in the material world, driven by tangible technological, economic, and social logics. An accessible introduction to this emerging technology, Fantasies of Virtual Reality is essential reading for anyone interested in what VR can really do—and what is just plain fantasy.
