Book excerpt: This book explores the dynamics behind Romania’s relationship with the European Union from the collapse of the Ceaucescu regime in 1989, to its recent accession to the EU in 2007. As a completely up-to-date and detailed study, it identifies key developments in EU-Romania relations, as well as the challenges Romania faced in its efforts move from the margins of the European integration to EU membership. In so doing, the analysis contributes to wider debates about the dynamics underpinning EU enlargement. Moreover, the book reveals the consequences and limits of Europeanization. Romania and the European Union analyses: the impact of integration on the consolidation of democracy in Romania; the country’s economic development, in accordance with the EU’s Copenhagen criterion - the need for acceding states to possess a ‘functioning market economy’; the process of macroeconomic reform; the reform of its public administration; the country’s efforts in implementing the EU’s acquis in the areas of justice and home affairs –a focal point in the accession negotiations given Romania’s geographical location, and its vulnerability as a major transit point for illegal migration and trafficking into the EU – and securing its external borders; the EU’s role in promoting reform as well as the limits of EU influence the obstacles Romania has had to overcome in meeting the demanding pre-requisites of accession to the EU. This book identifies the EU’s role in promoting reform, but equally the limits of EU influence. It reveals the obstacles Romania has had to overcome in meeting the demanding pre-requisites of accession to the EU.

This book was released on 2008-01-01 with total page 402 pages. Available in PDF, EPUB and Kindle. Book excerpt: Among the criteria for accession to the European Union are democracy and the Rule of Law. In the insightful analysis offered by the author of this book, these concepts - while admirable and even necessary criteria in principle - are almost impossible to measure, and any judgement grounded in them will always be difficult to justify. In his words, 'by including analysis of democracy and the Rule of Law within the field of the EU enlargement law, the Union entered an unstable terrain of vague causal connections and blurred definitions.' Dr Kochenov addresses this problem by proceeding as follows: 1. Outlining EU enlargement law in general, including the principle of conditionality and the role played by the analysis of democracy and the Rule of Law in enlargement preparation; 2. Focusing on the role actually played by the monitoring of democracy and the Rule of Law in ten candidate countries, scrutinizing the way the EU used the legal tools and competences outlined in its enlargement law. The book adopts the EU's own understanding of democracy and the Rule of Law, as derived directly from the substance of the numerous legal and political instruments issued by the Community Institutions and especially the Commission in the course of the pre-accession process. In this way it demonstrates the actual - as opposed to the officially announced - role played by the assessment of democracy and the Rule of Law in the candidate countries in the regulation of enlargement. Many formidable inconsistencies in the application of the conditionality principle are thus laid bare. This leads the author to a series of recommendations on policy and procedure that he demonstrates could be profitably applied to the regulation of current and future accessions, using the Commission's own structure of monitoring pre-accession reforms in the three areas of the legislature, executive, and judiciary in candidate countries. The probity and soundness of these recommendations, firmly grounded as they are in the actual pre-accession monitoring and its consequences for the pre-accession progress of ten Eastern European countries admitted to the EU in 2004 and 2007, will greatly interest policymakers and scholars concerned with the future of European integration.

Available in PDF, EPUB and Kindle. Book excerpt: Will joining the European Union help achieve prosperity, stability and democracy in Central and Eastern Europe? This book addresses this question by analysing how the European Union has approached this enlargement. Specifically, the book shows how, in its enlargement to the East, the European Union has tried to guide the post- communist states of Central and Eastern Europe towards new institutions and changing rules. In addressing the little explored link between post-communist transformations and enlargement, the book presents the effects of enlargement governance extended by the EU on domestic processes of reform and transformation. With its rich empirical overview of the reform challenges to various sectors, the author presents various scenarios of the interaction of EU rules with post communist reform. In contrast to other books on enlargement, this one relies on the perspective of scholars from Eastern Europe to illustrate the importance of the accession process to reform.

Available in PDF, EPUB and Kindle. Book excerpt: This book examines in depth the impact of the EU on aspects of the quality of democracy in eight selected post-communist countries. Considering both the political and legal aspects of the dynamics among institutions and focussing on inter-institutional accountability, the book analyses how constitutional designs have been effectively implemented to achieve this, and to what extent this was the result of EU action. In order to make a comparative assessment of the EU on democracies, the book features detailed case studies according to their different status vis-à-vis the EU, including older new member states: Poland and Hungary; newer new member states: Romania and Bulgaria; potential candidates: Albania and Serbia; and neighbour and remote neighbour states: Ukraine and Armenia. Each chapter addresses a range of dimensions and most relevant domains of inter-institutional accountability, that is: executive-legislative relationships; constitutional justice; decentralisation and regionalism; and the role of ombudsman or other relevant authorities. Seeking to assess how important the role of the EU has been in influencing the modes and characteristic of democracies and fundamental rights established in these regions, this book will be of interest to students and scholars of comparative politics, EU politics, Post-communist studies and democratization studies.

Book excerpt: This collection of essays by a multinational group of authors examines the political, social and economic consequences of the most recent enlargement of the European Union. It does not confine itself to a discussion of the impact on the new member states but also considers the likely effects of this enlargement on the EU itself. These effects include not only the familiar need for new modes of governance but also involve other changes resulting from a process of what has been called mutual learning. These essays analyse various aspects of this process starting with the Constitutional Convention. Sometimes the focus is on the impact on the new members, sometimes on the changes likely to occur in the EU and its older members as a result of this enlargement. The emphasis on change is encapsulated in the book's title, 'Europe on the Move'.

Book excerpt: The states from Central and Eastern Europe that joined the EU in 2004 and 2007 provide a fascinating series of case studies for scholars interested in politics, IR and development studies. The interest comes from the fact that never before had so many recipients of EU aid joined the Union and taken on the commitment to become aid donors. The journey from recipients of aid to aid donors is interesting because, not only does it tell us about development policy in CEE states, this policy area gives us an insight into governmental structures in CEE states, foreign policy priorities, public opinion, the role of NGOs/civil society and how well CEE states have taken on board the EU acquis (the EU’s rule book). The book also explores whether the development cooperation programmes of the majority of CEESs reflect the so-called "transition experience" of moving from authoritarianism and socialism to democracy and modern liberalism. It also explores the extent to which these donors are aligned with the approaches of the DAC donors. Finally, by extending the scrutiny to the bottom-up development activities of non-state actors and public opinion, the book will analyse the dynamics of the solidarity of the former ‘East’ with the global ‘South’. This book was published as a special issue of Perspectives on European Politics and Society

This context is created by macroeconomic constraints, the unfinished process of transition and the requirements of membership. The task of this new CEPS paperback book is to identify these constraints and point to policy options for decision-makers on both sides of the enlargement process.

Book excerpt: This book critically examines how and why Eastern enlargement has impacted on EU human rights policy. By drawing on the EU’s intervention in human rights provision in Romania before 2007, it is demonstrated that the feedback effects of this intervention have led to the emergence of an EU child rights policy. Eastern enlargement has also raised the profile of Roma protection, international adoptions and mental health at the EU level. The impact of these developments has been further reinforced by the constitutional and legal provisions included in the Lisbon Treaty. It is argued that Eastern enlargement has led to the emergence of a more robust and well-defined EU human rights regime in terms of its scope and institutional clout. This book makes a substantial contribution to the scholarship on EU enlargement, Europeanisation and EU human rights policy by providing empirical evidence for the emergence and persistence of EU institutional and policy structures upholding human rights.

Available in PDF, EPUB and Kindle. Book excerpt: Anitta M. Hipper examines to what extent and under what conditions the EU's transformative power met with resistance in Romania. The book touches upon a raw nerve for most post-communist societies: justice and anti-corruption reform. Through the use of a context-sensitive approach, it assesses how domestic factors influenced the implementation of EU conditionality towards Romania from 1990 to 2012. Empirical investigations reveal a struggle between various interested parties in complying with EU conditionality. As a result, a complex layer of (non-)compliance emerged and it became a Herculean task to ensure the sustainability of reform by reformist forces within Romania and the EU.
