Existen algunas recopilaciones sectoriales (sobre medio ambiente o sobre electricidad) que recogen por separado y parcialmente algunas de estas disposiciones. Pero ambas materias aparecen íntimamente imbricadas en la realidad diaria del sector energético y de las políticas públicas. Buena prueba de ello es la elaboración de una Estrategia Española de Cambio Climático y Energía Limpia. Horizonte 2012 (actualmente en tramitación), en la que se definen actuaciones “estrechamente relacionadas” -dice la propuesta del Gobierno- para luchar contra el cambio climático y para conseguir una energía más limpia. Este conjunto normativo presenta cuatro notas características que han condicionado el contenido y la estructura de la presente recopilación: 1a. La dispersión normativa, apreciable tanto en lo institucional (hay normas internacionales, comunitarias, estatales y autonómicas), como en lo sectorial (hay normas generales o de amplio espectro y otras específicas relativas a la industria, al sector eléctrico, a la vivienda, al transporte o a la agricultura). 2a. La movilidad o transitoriedad. La calificación de legislación motorizada se queda ya corta para reflejar las continuas modificaciones parciales de la normativa y los completos cambios legislativos que se dan en estos sectores con mucha frecuencia. Así, por ejemplo, la Ley del Sector Eléctrico ha sufrido 15 modificaciones parciales en sus diez años de vigencia. Y la más reciente Ley 1/2005, de 9 de marzo, por la que se regula el régimen del comercio de derechos de emisión de gases de efecto invernadero ha tenido ya dos modificaciones (habiéndose producido la primera por un Real Decreto-Ley aprobado al día siguiente de la publicación de la Ley en el BOE). Si esto ocurre con las leyes cabeceras del correspondiente grupo normativo, es fácil imaginar que ocurre con los reglamentos. 3a. La importancia del soft law: los Libros Verdes o Blancos, las Estrategias, los Programas y Planes y, en general, las disposiciones programáticas son muy abundantes y resultan absolutamente imprescindibles para comprender -y para conocer anticipadamente- las acciones y normas que de ellos derivan. 4a. La importante dimensión técnica de la normativa: esta legislación incorpora un importante conjunto de disposiciones de carácter técnico (generalmente relegado a los anexos). En ocasiones, incluso, se efectúan remisiones a normas técnicas privadas (las Instrucciones Técnicas Complementarias del Reglamento de Instalaciones Técnicas en los Edificios se remiten, en muchas ocasiones, a las normas UNE) o se innovan las formas o técnicas normativas ordinarias al mezclar en la ordenación normas técnicas de carácter reglamentario, cono documentos técnicos sin carácter reglamentario, y que con reconocimiento oficial, se consideran complemento de aquéllas (es el caso de los Documentos Reconocidos del Código Técnico de la Edificación, que son complemento de los Documentos Básicos del propio Código). Estas cuatro características constituyen serias dificultades cuando se pretende realizar una recopilación normativa completa y comprensible. Para tratar de superarlas hemos estructurado la recopilación en las tres partes o sectores ya comentados: cambio climático, energías renovables y eficiencia energética. En cada una de estas partes los textos se agrupan por su origen y ámbito de aplicación: internacional, comunitaria y estatal. Los textos normativos se reproducen en su versión consolidada (es decir, con la oportuna incorporación de las modificaciones que haya tenido la norma y dejando constancia de esa modificación en nota a pie de página). Además, se ha incluido una relación de los principales textos programáticos (planes, estrategias, programas) sobre estas materias. Las dimensiones que iba adquiriendo el código iban aconsejando no incluir (salvo alguna excepción) los textos completos de dichos documentos. Pero, su importancia y el hecho de que no sean de fácil localización y acceso nos han llevado a incluir una relación de los mismos, indicando el lugar o publicación donde pueden consultarse. También se han incluido referencias de las normas que guardan una relación indirecta con los ámbitos implicados (como, por ejemplo, las normas sobre contaminación atmosférica), así como de la normativa autonómica, muy numerosa e importante en el ámbito de las energías renovables y de la eficiencia energética. Estas referencias se incluyen en las relaciones que figuran al final de cada uno de las partes de la recopilación. El presente código se compone de 37 epígrafes que comprenden la reproducción de cuarenta normas y nueve relaciones de disposiciones en las que aparecen referenciadas más de 40 disposiciones programáticas y más de 100 normas europeas, estatales y autonómicas sobre cambio climático, energías renovables y eficiencia energética. Para facilitar el conocimiento y manejo de estas cerca de 200 normas y disposiciones se acompañan un índice cronológico y un índice analítico con más de treinta voces principales y un centenar de voces secundarias. Asimismo se ha incorporado una relación de las páginas web oficiales de los organismos con competencias o funciones en materia de cambio climático y energía, donde se puede encontrar información adicional sobre dichas materias.
