Book excerpt: Malgré les tensions politiques qui animent régulièrement les rapports de la Fédération de Russie avec la France, on aurait tort de croire que l’activité scientifique entre ces deux pays en pâtisse. L’organisation, à Toulouse, en 2018, d’un colloque ayant pour thème le droit russe le démontre puisque tous les juristes russes qui ont été invités ont accepté d’y participer. Ce colloque qui a également fait intervenir des chercheurs français, spécialistes de la Russie et/ou du droit russe, a ainsi permis de croiser les regards sur la relation entre la Russie et les États européens ainsi que sur le droit russe, encore jeune mais déjà très dense. Face à la richesse de ces échanges, tant sur le plan juridique qu’historique ou géopolitique, on ne pouvait se résigner à ne pas les partager à travers une publication. C’est désormais chose faite grâce aux Cahiers Jean Monnet. Et, même si Jean Monnet était davantage tourné du côté ouest que du côté est de l’Europe, il aurait très certainement accueilli avec bienveillance ces échanges au cours desquels des questions importantes et contemporaines ont été abordées telles que la place du principe de laïcité, le rôle de la bioéthique, les positions de la Cour constitutionnelle face au pouvoir politique ou à la Cour européenne des droits de l’homme, l’équilibre recherché entre droit public et droit civil en raison du développement de l’économie de marché, la corruption de la justice, l’ouverture au numérique, etc. Les actes de ce colloque sont présentés dans cet ouvrage suivant la dynamique suivante : I/ La relation entre l’Europe et la Russie. II/ Droit constitutionnel russe et droits et libertés fondamentaux. III/ Droit russe et économie de marché. IV/ Droit russe et modernité. V/ La justice russe. Pour chacun de ces thèmes, quelques arrêtes saillantes ont été retenues, l’idée n’étant pas de livrer un manuel exhaustif de droit russe, ce qui aurait assurément été mission impossible.
