Depuis les années 70, l'Etat intervient en Allemagne dans la politique de santé par des réformes dont la plus interventionniste a été la reforme Seehofer de 1993. Les mécanismes de régulation destinés à sortir le système de santé allemand de la crise ont respecté jusqu'à présent les principes sur lesquels repose l'assurance maladie légale allemande depuis sa création par le chancelier Bismarck en 1883. Dans le cadre de cette étude, les relations économiques qui déterminent le système de santé allemand, en particulier les actions des différents groupes d'intérêt économique, ont fait l'objet d'une analyse détaillée. Le système de santé allemand a été caractérisé jusqu'à l'entrée des récentes réformes de 1989 et 1993, par une régulation de type néolibérale et les interférences entre les unions professionnelles déterminaient son fonctionnement. Dans le contexte de la crise, l'Etat allemand est intervenu dans cette régulation corporatiste, formelle et décentralisée pour sauver l'existence de l'assurance maladie légale. L'objectif de cette étude est de montrer que l'on peut introduire des éléments de marché ponctuels dans un système de santé sans pour autant changer les principes socio-politiques sur lequel il est fondé. L'exemple de l'Allemagne montre que les instruments mis en place par la reforme Seehofer visent à inciter les décideurs décentralises (caisses d'assurance maladie et professionnels de la santé) à se comporter de manière efficiente à l'intérieur d'enveloppes globales sévères. Ces mécanismes de régulation visent à une logique d'acheteur s'appuyant sur la mise en concurrence des producteurs de soins. A terme le système allemand devrait être géré selon les règles générales de l'économie sociale de marché. Le rôle de l'Etat allemand se limiterait alors à superviser le cadre de la concurrence et à garantir la protection des citoyens à faible revenu ainsi que des plus démunis.
