Book excerpt: During Chile’s shift to neoliberalism, the dictatorship of Augusto Pinochet passed a swath of probusiness labor legislation. Subsequent labor reforms by democratically elected progressive administrations have sought to shift power back to workers, but this task has proven difficult. In Building Power to Shape Labor Policy, Pablo Pérez Ahumada explains why. Focusing on reforms to collective labor law, Pérez Ahumada argues that analyzing how both workers and employers mobilize power to influence government policies is crucial for understanding labor reform outcomes. He examines the relational character of power to explain how different types of power—structural, institutional, associational—interact with each other, and proposes a relational understanding of power and how it is balanced among competing social classes. While workers and employers both have a hand in shaping labor law, their influence is not equal. Analysis of recent events in Chile reveals how the balance of power and the lingering effects of neoliberalism manifest in labor reform.

Available in PDF, EPUB and Kindle. Book excerpt: Following the death of Franco, Spain underwent a transition to democracy in the mid-1970s. Although a rapid process of modernization occurred, the Spanish welfare state was seen, until fairly recently, as relatively underdeveloped. However, given the progressive Europeanization and expansion of Spanish social policy, questions arise as to whether the Spanish welfare system should still be considered as peripheral to West European welfare states. This volume is divided into three sections. The first section deals with broad trends in the evolution of the Spanish welfare state. To begin with, the consolidation path of social protection policies is explored. Attention is also paid to the process of Europeanization. Furthermore, the analysis explores advances in gender equality policies. In the second section, attention is turned to governance issues, such as collective bargaining, the interplay among levels of government, the welfare mix and public support for social policies. The third and final part of the book addresses five main challenges facing the Spanish welfare state in the 21st century, namely, the need to enhance flexicurity; to achieve a better work-family balance; to coordinate immigration policies with existing social protection; to tackle the persistence of high rates of relative poverty; and to face intense population ageing, both in terms of increasing needs for care and the reform of the pension system.

Book excerpt: Arguing that economic policies in Argentina, Brazil, and Mexico favor markets over institutions and the international economy over the domestic - to the detriment of the workforce in those countries - this publication presents extensive evidence in support of placing employment concerns at the center of economic and social policies. The authors discuss the challenges the three countries face in creating employment, as well as the evolution of the labor market since 1990 in terms of the quantity and quality of jobs. They then explore the impact of five policy areas on employment creation: macroeconomic policy, trade liberalization, foreign direct investment, labor market regulations and policies, and social dialogue. Their concluding recommendations offer concrete steps for balancing market forces and policy intervention in the interest of employment growth in a sound economy

Book excerpt: Thirty-three distinguished authorities in the field of labour and industrial relations law gather here to enhance and complement the work of the late Marco Biagi, a man who, at the time of his violent and untimely death, had shown himself to be the most insightful and committed international scholar in this complex and controversial and, as it proved, even dangerous field. The topics covered range over many of Professor Biagi's special interests, including the following: the formulation of a new basis for labour law that could resolve new issues; employee protection in corporate restructuring; the trend toward individual 'enterprise bargaining'; a new European employment policy and what it might entail; the growing phenomenon of 'flexibilisation'; the effects of an aging workforce; the crucial nexus of free trade, labour, and human rights; the promise of EU enlargement; and protection of part-time workers. There is a lot of insight, innovation, and just clear thinking in this wide-ranging and far-reaching book. It will be of exceptional value to scholars, lawyers, and others concerned with the extensive and unpredictable changes under way in today's world of work.

Available in PDF, EPUB and Kindle. Book excerpt: This volume is a successor of sorts to the Institute's 1986 volume Toward Renewed Economic Growth in Latin America, which blazed the trail for the market-oriented economic reforms that were adopted in Latin America in the subsequent years. It again presents the work of a group of leading Latin American economists who were asked to think about the nature of the economic policy agenda that the region should be pursuing after a decade that was punctuated by crises, achieved disappointingly slow growth, and saw no improvement in the region's highly skewed income distribution. The study diagnoses the first-generation (liberalizing and stabilizing) reforms that are still lacking, the complementary second-generation (institutional) reforms that are necessary to provide the institutional infrastructure of a market economy with an egalitarian bias, and the new initiatives that are needed to crisis-proof the economies of the region to end its perpetual series of crises. Book excerpt: Mark S. Anner spent ten years working with labor unions in Latin America and returned to conduct eighteen months of field research: he found himself in the middle of violent raids, was detained and interrogated in a Salvadoran basement prison cell, and survived a bombing in a union cafeteria. This experience as a participant observer informs and enlivens Solidarity Transformed, an illustrative, nuanced, and insightful account of how labor unions in Latin American are developing new strategies to defend the interests of the workers they represent in dynamic global and local contexts. Anner combines in-depth case studies of the auto and apparel industries in El Salvador, Honduras, Brazil, and Argentina with survey analysis. Altogether, he documents approximately seventy labor campaigns—both successful and failed—over a period of twenty years. Anner finds that four labor strategies have dominated labor campaigns in recent years: transnational activist campaigns; transnational labor networks; radical flank mechanisms; and microcorporatist worker-employer pacts. The choice of which strategy to pursue is shaped by the structure of global supply chains, access to the domestic political process, and labor identities. Anner's multifaceted approach is both rich in anecdote and supported by quantitative research. The result is a book in which labor activists find new and creative ways to support their members and protect their organizations in the midst of political change, global restructuring, and economic crises.

Available in PDF, EPUB and Kindle. Book excerpt: Derived from the renowned multi-volume International Encyclopaedia of Laws, this monograph on Chile not only describes and analyses the legal aspects of labour relations, but also examines labour relations practices and developing trends. It provides a survey of the subject that is both usefully brief and sufficiently detailed to answer most questions likely to arise in any pertinent legal setting. Both individual and collective labour relations are covered in ample detail, with attention to such underlying and pervasive factors as employment contracts, suspension of the contracts, dismissal laws and covenant of non-competition, as well as international private law. The author describes all important details of the law governing hours and wages, benefits, intellectual property implications, trade union activity, employers’ associations, workers’ participation, collective bargaining, industrial disputes, and much more. Building on a clear overview of labour law and labour relations, the book offers practical guidance on which sound preliminary decisions may be based. It will find a ready readership among lawyers representing parties with interests in Chile, and academics and researchers will appreciate its value in the study of comparative trends in laws affecting labour and labour relations.
