Book excerpt: A Lei no 14.230/2021, sancionada em 25 de outubro do citado ano, promoveu uma verdadeira revolução no sistema brasileiro anticorrupção, em especial no tocante à tutela da probidade administrativa. Uma análise detida do texto legislativo aprovado permite extrair 192 (cento e noventa e duas) mudanças formais na Lei de Improbidade Administrativa (Lei n o 8.429/92), que vão desde a ementa até o último artigo. Os efeitos (teóricos e práticos) dessas alterações são percebidos desde o primeiro dia de vigência da "Nova Lei de Improbidade Administrativa", pois inaugurou-se, em especial, um debate (na academia e no foro judicial) sobre a (ir)retroatividade ou não das novas disposições benéficas aos que são investigados, processados e condenados por atos de improbidade administrativa. O Supremo Tribunal Federal (STF) já deliberou pelo reconhecimento da repercussão geral dessa questão (Tema 1199), tendo o Ministro-Relator (Alexandre de Moraes) determinado a suspensão dos feitos na Suprema Corte e no Superior Tribunal de Justiça (STJ) que tratem da matéria, ainda que por meio de simples petição. Não obstante isso, deve-se salientar que a (ir)retroatividade da lei é apenas o principal ponto de debate no que diz respeito à aplicação das novas regras legais, motivo pelo qual invocou-se o citado instituto de uniformização jurisprudencial. É preciso ressaltar, contudo, que a "Nova Lei de Improbidade Administrativa" produz efeitos para além da seara cível-administrativa que tutela a probidade administrativa, tendo provocado alterações que impactam significativamente o Direito Eleitoral, tais como: 1 - A obrigatoriedade de capacitação voltada para o compliance anticorrupção; 2 - Exclusão de incidência da lei de improbidade administrativa aos atos de dilapidação, malbaratamento ou desvio dos recursos públicos geridos pelos partidos políticos e suas fundações; 3 - Efeito expansivo do dolo específico (necessário para a caracterização dos atos de improbidade administrativa) para os ilícitos eleitorais e os reflexos desse juízo na questão da inelegibilidade; 4 - Previsão de um rol taxativo dos atos de improbidade administrativa violadores dos princípios administrativos e a revogação do desvio de finalidade (antigo inciso I da Lei no 8.
