Book excerpt: In this report Select Committee on the Constitution supports the UK Government's position that the Scottish Government and Scottish Parliament do not have the authority to call a referendum on Scottish independence as this is would relate to the Union and is therefore a 'reserved' issue. On the subject of 'devolution-max', the Committee feels strongly that the issue should not be a question for Scotland alone. 'Devolution-max' has the potential to create different and competing tax regimes within the UK, so the whole population of the UK and their representatives should have a right to a say on any proposals for it. This would require inclusive and extensive multilateral negotiations right across the United Kingdom. The Committee also draws on its previous report on referendums (HL paper 99, session 2009-10, ISBN 9780108459870) which argued in favour of referendum questions posing two options, and therefore any referendum should present a straight choice between full independence or the status-quo, not including a third option for 'devolution-max'. The Committee also considers the process for deciding on the wording of any referendum. It should be for the Electoral Commission to report on the intelligibility of any proposed referendum question on Scottish independence. The Committee supports the UK Government's proposal that a section 30 order be made under the Scotland Act 1998 to allow for a referendum to be held. This would require the agreement of the both the UK and Scottish Parliaments.

Book excerpt: This report finds that serious questions remain unanswered about the Agreement reached between the UK and Scottish Governments on the holding of a referendum on Scottish independence. The Agreement provides for power to hold a referendum on Scottish independence to be devolved to the Scottish Parliament ... The role of the Electoral Commission is important in ensuring that the referendum question is intelligible and neutral. Although the two Governments agreed on the advisory role of the Electoral Commission, the Committee thinks its advice is authoritative and should be followed.

Available in PDF, EPUB and Kindle. Book excerpt: Scotland faces its biggest choice since the 1707 union that made the United Kingdom - should Scotland be an independent country? The Yes and No campaigns are well under way but with the vote looming closer the information available to the public is still limited. What will happen after the referendum? What are the international implications? What about the UK's nuclear deterrant, currently housed in Scotland? What happens if the vote is 'No'? Is it even clear what independence will mean? What about the oil? What will the currency be? What will happen to the Old Age Pension pot if the UK splits? Scotland's Choices, now fully revised for the critical last few months before the referendum, does just that. Written by one former civil servant, one academic and one think-tanker - one a resident Scot, one a Scot living in England and one an Englishman - the authors clearly explain the issues you may not have considered and detail how each of the options would be put into place after the referendum.

Available in PDF, EPUB and Kindle. Book excerpt: The September 2014 Scottish independence referendum was an event of profound constitutional and political significance, not only for Scotland, but for the UK as a whole. Although Scottish voters chose to remain in the UK, the experience of the referendum and the subsequent political reaction to the 'No' vote that triggered significant reforms to the devolution settlement have fundamentally altered Scotland's position within the Union. The extraordinary success of the Scottish National Party at the 2015 General Election also indicates that the territorial dimension to UK constitutional politics is more prominent than ever, destabilising key assumptions about the location and exercise of constitutional authority within the UK. The political and constitutional implications of the referendum are still unfolding, and it is by no means certain that the Union will survive. Providing a systematic and academic analysis of the referendum and its aftermath, this interdisciplinary edited collection brings together public lawyers, political scientists, economists, and historians in an effort to look both backwards to, and forwards from, the referendum. The chapters evaluate the historical events leading up to the referendum, the referendum process, and the key issues arising from the referendum debate. They also explore the implications of the referendum both for the future governance of Scotland and for the UK's territorial constitution, drawing on comparative experience in order to understand how the constitution may evolve, and how the independence debate may play out in future.

Book excerpt: The European Court of Human Rights has described the UK's current blanket ban on prisoner voting as 'general, automatic and indiscriminate' and found it to be in breach of article 3 of protocol 1 of the European Convention on Human Rights. The ECHR requires the UK to bring forward legislative proposals to amend our current legislation to be compliant with the Convention. The Government is putting forward three options to a Committee of both Houses for full Parliamentary scrutiny. The three options are: a ban for prisoners sentenced to 4 years or more; a ban for prisoners sentenced to more than 6 months; a continued ban for all convicted prisoners. When the Joint Committee has finished its scrutiny the Government will reflect on its recommendations it will continue the legislative process by introducing a Bill.

Book excerpt: The clock is relentlessly ticking! Our world teeters on a knife-edge between a peaceful and prosperous future for all, and a dark winter of death and destruction that threatens to smother the light of civilization. Within 30 years, in the 2030 decade, six powerful 'drivers' will converge with unprecedented force in a statistical spike that could tear humanity apart and plunge the world into a new Dark Age. Depleted fuel supplies, massive population growth, poverty, global climate change, famine, growing water shortages and international lawlessness are on a crash course with potentially catastrophic consequences. In the face of both doomsaying and denial over the state of our world, Colin Mason cuts through the rhetoric and reams of conflicting data to muster the evidence to illustrate a broad picture of the world as it is, and our possible futures. Ultimately his message is clear; we must act decisively, collectively and immediately to alter the trajectory of humanity away from catastrophe. Offering over 100 priorities for immediate action, The 2030 Spike serves as a guidebook for humanity through the treacherous minefields and wastelands ahead to a bright, peaceful and prosperous future in which all humans have the opportunity to thrive and build a better civilization. This book is powerful and essential reading for all people concerned with the future of humanity and planet earth.

Book excerpt: This book examines the evolution of the phenomenon and explores the genesis of overtourism and the system dynamics underlining it. The 'overtourism' phenomenon is defined as the excessive growth of visitors leading to overcrowding and the consequential suffering of residents, due to temporary and often seasonal tourism peaks, that lead to permanent changes in lifestyles, amenities and well- being. Enormous tensions in overtourism affected destinations have driven the intensification of policy making and scholarly attention toward seeking antidotes to an issue that is considered paradoxical and problematic. Moving beyond the 'top 10 things you can do about overtourism', this book examines the evolution of the phenomenon and explores the genesis of overtourism as well as the system dynamics underpinning it. With a rigorous scientific approach, the book uses systems-thinking and contemporary paradigms around sustainable development, resilience planning and degrowth; while considering global economic, socio-political, environmental discourses. Researchers, analysts, policy makers and industry stakeholders working within tourism as well as those within the private sector, community groups, civil society groups and NGOs will find this book an essential source of information.

Available in PDF, EPUB and Kindle. Book excerpt: This consultation paper sets out the Government's proposals for reform of the law on defamation, aiming to achieve balance between protection of freedom of speech and the protection of reputation. The Government wants to ensure that the threat of libel proceedings is not used to frustrate robust scientific and academic debate, or to impede responsible investigative journalism and the valuable work undertaken by nongovernmental organisations. Issues included in the draft Bill are as follows: a new requirement that a statement must have caused substantial harm in order for it to be defamatory; a new statutory defence of responsible publication on matters of public interest; a statutory defence of truth (replacing the current common law defence of justification); a statutory defence of honest opinion (replacing the current common law defence of fair/honest comment); provisions updating and extending the circumstances in which the defences of absolute and qualified privilege are available; introduction of a single publication rule to prevent an action being brought in relation to publication of the same material by the same publisher after a one year limitation period has passed; action to address libel tourism by ensuring a court will not accept jurisdiction unless satisfied that England and Wales is clearly the most appropriate place to bring an action against someone who is not domiciled in the UK or an EU Member State; removal of the presumption in favour of jury trial, so that the judge would have a discretion to order jury trial where it is in the interests of justice.
