Available in PDF, EPUB and Kindle. Book excerpt: Exploring the referenda practices of eight European states, this book unpacks the intricacies of the institutional and procedural settings of referendum authorization to reach an equilibrium between the exercise of popular sovereignty and the protection of rule of law. The book also examines how by authorizing certain issues and refusing others, state institutions can exercise considerable control over the whole referendum process. Outlining how the rise of populist political parties and governments in Europe have brought direct democracy to the fore, this future-oriented book highlights four procedural guarantees that are compatible with democratic referendum authorization procedures. These include the independence and impartiality of the decision-maker, the right to a reasoned decision, the right to be heard and the right to an effective remedy. Using comparative analysis and data collection, the book demonstrates why these guarantees are minimum requirements to ensure that the rights of the initiators and voters are represented in the procedure and therefore reduce the risk of arbitrary decision-making. This state-of-the-art title will be an invaluable resource for academics and students of constitutional and administrative law, politics and public policy. With its practical application, governmental policymakers and practitioners will benefit widely from the book.

Available in PDF, EPUB and Kindle. Book excerpt: Why have referendums on European integration proliferated since the 1970s? How are referendums accommodated within member states' constitutional orders and with what impact on the European integration process? What is the likely institutional impact of referendums on the future of the European integration process? Drawing on an interdisciplinary approach, these are just some of the fundamental questions addressed in this book. The central thesis is that the EU is faced with a 'direct democratic dilemma', which is compounded by the EU's rigid constitutional structure and a growing politicisation of the referendum device on matters related to European integration. Referendums and the European Union discusses how this dilemma has emerged to impact on the course of integration and how it can be addressed.

Available in PDF, EPUB and Kindle. Book excerpt: The proposed enlargement of the European Union to include countries from Central and Eastern Europe has become an important political issue. Widening the European Union focuses on those institutional reforms of the Union that may be necessary to make the enlargement possible. The institutional structure, originally designed for the Union of just six states, might not be suitable for a EU of twenty-seven or more member states. An overview of current rational choice theories of institutional change is provided before the volume focuses on several aspects of institutional reforms in the Union. Widening the European Union contains contributions from a distinguished team of European academics. This book is a valuable resource to students of the European Union with an interest in its politics and policy, enlargement and institutional reform.

Available in PDF, EPUB and Kindle. Book excerpt: This handbook provides an empirically rich analysis of referendums in Europe from the end of the Second World War to the present. It addresses a range of perennial theoretical and legal questions that face policy-makers when they offer citizens the chance to take or influence decisions by referendum, not least whether to accept the ‘will of the people’. Taking a multi-disciplinary approach, drawing on historical, philosophical and political science perspectives, the book includes a contextual section on the history of referendums, the theoretical questions underpinning their use, and on constitutional and legal questions about the use of referendums. The empirical sections are divided into those referendums that focus on domestic issues, such as constitutional matters or questions of social policy, and those related to the European Union, including membership referendums and treaty ratification.

Available in PDF, EPUB and Kindle. Book excerpt: The European Union is grappling with a democracy problem. The succession of crises which have plagued the increasingly executive EU for years, has led to a rising cacophony of voices calling for fundamental change to the integration project. Yet despite the seismic shock of the Brexit referendum and the electoral upsets by nativist parties across the continent, few of the plans for EU reform include concrete proposals to reduce the age-old democratic deficit. This book is concerned with the two-pronged question of how the relationship between citizens, the state and EU institutions has changed, and how direct democratic participation can be improved in a multi-layered Union. As such, this edited volume focuses not on populism per se, nor does it deeply engage with policy and output legitimacy. Rather, the research is concerned with process and polity. Building on the notion of increasing social, economic and political interdependence across borders, this volume asks how a sense of solidarity and European identity can be rescued from the bottom up by politically empowering citizens to ‘take back control’ of their EU.

Available in PDF, EPUB and Kindle. Book excerpt: The book identifies the impact of misinformation in the context of referenda. While the notion of misinformation is at the centre of current events and is the subject of several studies, it has rarely been addressed in the context of referenda or from a multidisciplinary and comparative perspective. This book fills this gap. Different legal orders have been chosen because of their extensive referendum practices (California and Switzerland); a recent legislative process on the issue of misinformation (Germany, France, and Canada); or recent experience with a vote during which it was considered that false information had been disseminated (Brexit, Catalan independence, and Italian constitutional referendum of 2016). By bringing together authors from the political and legal sciences, the book focuses on combining the expertise of researchers from different backgrounds and origins in order to propose innovative solutions. In this regard, the book is characterized by the fact that it does not aim to combat misinformation per se, but develops suggestions meant to guarantee the conditions of formation of the political will during referenda. The book will be an invaluable resource for legal scholars, political scientists, and specialists of political communication. Outside the world of academia, the book may draw the attention of policy-makers, practitioners, and journalists confronted with the challenges of misinformation or disinformation.

Available in PDF, EPUB and Kindle. Book excerpt: 'I can enthusiastically recommend and endorse this book. It serves the very important purpose of collecting key documents together in an elegant and accessible text. There currently exists a huge proliferation of material on the EU Constitution this volume makes a very wise selection of this profusion, compiling it into a manageable and informative whole. Nine chapters deal with the most significant matters concerning the Constitution. A short but well written introduction at the start of each chapter precedes following extracts. Part of the value of this book lies in the fact that it includes translations of some important documents which are difficult, or impossible, to access in English for example, recent decisions of national courts concerning the European Arrest Warrant. All in all, this work is a comprehensive, but not overwhelmingly large, collection of materials on the EU Constitution, and it will prove extremely valuable to all those working within this area of law. By presenting the Constitution, the background to the Constitution, and the issues it deals with, in this clear and informative way, it will shed new light upon, and help all of us to form our own judgements on, the EU Constitution, and its importance to our lives.' Sionaidh Douglas-Scott, King's College London, UK 'Whatever the ultimate fate of the EU's Constitutional Treaty, both the events which led to its conclusion and those which occurred afterwards during its ill-fated ratification process have profoundly shaped the future of the European Union as a constitutional project. This collection of materials offers an invaluable set of resources for understanding these events, in their widest legal and political context. The text will be useful to all those who seek to understand both why the EU has reached such a turning point, and where it might go in the future.' Jo Shaw, Edinburgh Law School, UK This book offers a selection of materials that enable a better understanding of some of the most important changes that would be introduced by the Treaty establishing a Constitution for Europe in the EU legal and political system. It also helps to assess the need for the reforms embedded in the Constitutional Treaty as well as the quality of the formulations agreed upon by the signatory Member States. The book includes excerpts of the European Convention's work, selected statutory and constitutional provisions of the Member States, and also related passages from pertinent court decisions from both European courts as well as Member States' constitutional courts. Institutional and doctrinal analyses and relevant excerpts from the Constitutional Treaty itself are also included. Many of these documents directly relate to the provisions of the Constitutional Treaty, while the others, although not directly related, are nevertheless relevant to the debate surrounding it. The European Constitution, by two of the best experts on the Constitution for Europe, will be of great interest to researchers and teachers in the fields of European Law and European politics, and also to policy makers in European affairs.

Book excerpt: The use of electronic voting systems has caused controversy in the media and among the general public, and has even come under the scrutiny of the law courts. it has become clear that the uncertainties surrounding the introduction of e-voting are rarely of a technical nature, but primarily raise political and societal concerns. The key issue is to ensure that the principles of free and fair elections are upheld, regardless of the voting method chosen. This handbook is written for governments and organisations considering whether or not to conduct e-voting pilot schemes and trials or to make e-voting a feature of their electoral system. it reviews relevant issues such as building and safeguarding trust in the system, The value of open-source software And The implications of a voter verifiable audit paper trail. Concrete e-voting issues are discussed in the framework of the electoral cycle. This handbook can be used as a stand-alone guide, but governments or organisations would benefit most by consulting it in conjunction with Recommendation Rec(2004)11 of the Committee of Ministers of the Council of Europe on legal, operational and technical standards for e-voting

Available in PDF, EPUB and Kindle. Book excerpt: Far from displaying a uniform pattern of integration, the European Union varies significantly across policy areas, institutional development and individual countries. Why do some policies such as the Single Market attract non-EU member states, while some member states choose to opt out of other EU policies? In answering these questions, this innovative new text provides a state-of-the-art introduction to the study of European integration. The authors introduce the most important theories of European integration and apply these to the trajectories of key EU policy areas – including the single market, monetary policy, foreign and security policy, and justice and home affairs. Arguing that no single theory offers a completely convincing explanation of integration and differentiation in the EU, the authors put forward a new analytical perspective for describing and explaining the institutions and policies of the EU and their development over time. Written by a team of prominent scholars in the field, this thought-provoking book provides a new synthesis of integration theory and an original way of thinking about what the EU is and how it works.

Book excerpt: This report was produced online to coincide with the second reading of the European Union Bill (Bill 106, session 2010-11, ISBN 9780215557339) on 7 December 2010. The Committee is critical that it had been given only four weeks to investigate and prepare a report on the Bill's provision affirming the principle of Parliamentary sovereignty. This report sets out in detail the legal relationship between the United Kingdom and the European Union and the current debate on the scope of Parliamentary sovereignty, then evaluates the sovereignty clause (clause 18) in the light of evidence received. The evidence suggests that the legislative supremacy of Parliament is not currently under threat from EU law. However, the Committee believes recent UK court decisions have called into question the legal basis of Parliamentary sovereignty and the legislative supremacy of Parliament. It concludes that Clause 18 is a reaffirmation of the role of a sovereign Parliament in a dualist state, nothing more, nothing less. It does not address the competing primacies of EU and national law and much evidence suggests the clause is not needed. The Bill's proposal that approval to certain changes in EU law will require first to be approved by an Act of Parliament and that the change should be approved by a referendum is also considered. This "referendum lock" is viewed as an attempt to bind future Parliaments, but the Committee concludes there is no clear evidence that one Parliament has authority to act in this way.

Book excerpt: The report explains how Part 1 of the Bill will apply referendum locks and other constitutional safeguards before further competence or power can be transferred from the UK to the EU. It then highlights significant gaps in these safeguards, particularly in relation to amendments to the EU Treaties that are considered by the Government of the day to be insignificant, or to apply only to other Member States, or to allow simply for the accession of a new Member States, in which case a referendum will not be triggered. It looks at the potentially profound implications of the referendum lock for Parliamentary democracy and direct democracy, and its consequences for UK-EU relations. The Committee's overall evaluation and conclusions are summarised in the last chapter.
