Available in PDF, EPUB and Kindle. Book excerpt: This book compares legally allowed dismissal conditions in employment contracts in Taiwan and Japan and then examines the possibility of introducing the Taiwan-style severance payment system into Japanese employment contracts. A significant difference exists between employment regulations of Japan and Taiwan. In Japan, dismissal of an employee on the grounds of ability is not easily upheld in a court of law, and a set rule for dismissals with severance payment does not exist. On the other hand, in Taiwan, where regulations do not allow dismissal at will, an employee can still be dismissed with severance payment, as long as due process is followed. Written by labor lawyers and labor economists from both Taiwan and Japan, this book describes the procedures that must be followed in the dismissal process in the two countries. It also shows that this difference in dismissal conditions between the two countries explains the low labor mobility in Japan and high labor mobility in Taiwan, and that this difference in labor mobility, in turn, caused the shift of IT production from Japan to Taiwan in the 1990s. The final chapter of the book elucidates the need for introducing the Taiwan-style severance payment before carrying out further deregulation in Japan.

Containing sections on redundancy payments, unfair dismissal, and collective redundancies, as well as a number of practical tools, the book is an invaluable resource for practitioners working in the area. Now in its third edition, the book has been fully revised and extended to accommodate the extensive changes in legislation that have been implemented since the publication of the second edition in 2001. It considers the effect of the statutory disciplinary, dismissal and grievance procedures in redundancy dismissals following the Employment Act 2002, along with the impact of the Information and Consultation of Employees Regulations 2004, and the Employment Equality (Age) Regulations 2006. It analyzes the wealth of recent case law, particularly with reference to the changes to employer obligations arising from the decision in UK Coal Mining Ltd v NUM & BACM 2007] (EAT) and the new rules on collective consultation following Junk v K hnel and Susie Radin Ltd v GMB. Including extensive appendices, charts, specimen letters and forms, Redundancy: The Law and Practice is an invaluable reference for any practitioner working in the area of employment law.

Available in PDF, EPUB and Kindle. Book excerpt: Redundancy, restructuring, downsizing. There are few, if any, other management books on this important topic, and yet the pace of redundancies has only accelerated in recent years. Coupled with this, many companies that implement redundancies as a cost-cutting exercise often fail to achieve their goal. Whilst viewed as an uncomfortable topic by many, guidance on how to implement a redundancy programme that is fair, proportionate and ultimately leads to improved organisational performance, has never been more needed. This book fills this important gap. It takes the reader through a redundancy implementation strategy – Re-Focus, Re-Organise and Re-Build – that incorporates the key aspects of planning and analysis, fairness and justice, and prepares management for redundancy implementation through training. What will your communications include? What will be your strategy for implementation? What training does your management need? Various helpful template examples are included for employee consultation, communication and training. The book will be invaluable for business managers, HR professionals, employee representatives and HR students.

Book excerpt: Honeyball and Bowers' Textbook on Employment Law is an approach to employment law with strong critical analysis whilst placing it in its wider contexts, in a concise and user-friendly format. Fully updated to take into account the recent significant developments in this area, including the Equality Act 2010, the key topics on most employment law courses are addressed in detail. An extremely clear writing style allows this text to remain accessible and student-focussed, while providing detailed explanations and analysis of the law. The text also includes diagrams and chapter summaries throughout to aid student understanding, while further reading suggestions assist with essaypreparation and research. Setting employment law in context, this book considers both industrial and collective issues as well as examining the increasing role of the EU in UK employment law. A separate chapter on human rights also enables students to understand the role human rights legislation plays in the development of employment law. This book also contains cross referencing to Painter & Holmes' Cases & Materials on Employment Law, ensuring that these two texts continue to complement one another and provide the perfect combination of textbook analysis and the most up-to-date cases and materials. This text is accompanied by a free Online Resource Centre (www.oxfordtextbooks.co.uk/orc/honeyball12e/) which contains updates to the law and useful weblinks.

Available in PDF, EPUB and Kindle. Book excerpt: There is substantial disagreement among policy-makers about how governments should respond to the problem of high unemployment. Thus far there has been little, if any, systematic attempt to evaluate the strengths and weaknesses of the main unemployment policies available to governments in market economies. Individual policy recommendations are usually made in isolation from one another. This book attempts to provide a balanced assessment of the various policy options, including the following: demand management versus supply-side policy, subsidizing employment and training, restructuring labour market regulations, and reforming the welfare state. The book also examines the political economy of unemployment policy and the effect of this policy on productivity growth.

This book is concerned with the examination and assessment of the impact of changes in technology on companies in three selected industries: printing, steel and chemicals. Its main focus is on the employment and associated labour market effects of technological change; but part of the rationale for the study as a whole has been to relate these effects to the technological environment of each industry. Accordingly, a good deal of attention has been paid to the character of the innovations themselves and to their implications for the industries in general terms. This title will be of interest to students of Business Studies and Economics.
