Unprecedented in its coverage of territorial government, this book identifies a wide range of available resources from each state to reveal the underlying legal principles that helped form the United States. In this unique publication, a state expert compiles each chapter using his or her own style, culminating in a diverse sourcebook that is interesting as well as informative. In Prestatehood Legal Materials, you will find bibliographies, references, and discussion on a varied list of source materials, including: state codes drafted by Congress county, state, and national archives journals and digests state and federal reports, citations, surveys, and studies books, manuscripts, papers, speeches, and theses town and city records and documents Web sites to help your search for more information and more Prestatehood Legal Materials provides you with brief overviews of state histories from colonization to acceptance into the United States. In this book, you will see how foreign countries controlled the laws of these territories and how these states eventually broke away to govern themselves. The text also covers the legal issues with Native Americans, inter-state and the Mexico and Canadian borders, and the development of the executive, legislative, and judicial branches of state government. This guide focuses on materials that are readily available to historians, political scientists, legal scholars, and researchers. Resources that assist in locating not-so-easily accessible materials are also covered. Special sections focus on the legal resources of colonial New York City and Washington, DC—which is still technically in its prestatehood stage. Due to the enormity of this project, the editor of Prestatehood Legal Materials created a Web page where updates, corrections, additions and more will be posted.

Book excerpt: Was the British Atlantic shaped more by imperial rivalries or by the actions of subnational groups with a variety of economic, social, and religious agendas? The Creation of the British Atlantic World analyzes the interrelationship between these competing explanations for the development of the British Atlantic by examining migration patterns on both the macro and micro level. It also scrutinizes the roles played by trade, religion, ethnicity, and class in linking Atlantic borders and the increasingly complicated legal, intellectual and emotional relationship between the British sovereign and colonial charterholders. Offutt, Robert Olwell, Carole Shammas, Wolfgang Splitter, Mark L. Thompson, Karin Wulf, Avihu Zakai.

Available in PDF, EPUB and Kindle. Book excerpt: The years between 1450 and 1550 marked the end of one era in world history and the beginning of another. Most importantly, the focus of global commerce and power shifted from the Mediterranean Sea to the Atlantic Ocean, largely because of the discovery ofthe New World. The New World was more than a geographic novelty. It opened the way for new human possibilities, possibilities that were first fulfilled by the British colonies of North America, nearly 100 years after Columbus landed in the Bahamas. TheHistorical Dictionary of Colonial America covers America's history from the first settlements to the end and immediate aftermath of the French and Indian War. This is done through a chronology, an introductory essay, appendixes, an extensive bibliography, and over 400 cross-referenced dictionary entries on the various colonies, which were founded and how they became those which declared independence. Religious, political, economic, and family life; important people; warfare; and relations between British, French, Spanish, and Dutch colonies are also among the topics covered. This book is an excellent access point for students, researchers, and anyone wanting to know more about Colonial America.

Available in PDF, EPUB and Kindle. Book excerpt: Women before the Bar is the first study to investigate changing patterns of women's participation in early American courts across a broad range of legal actions--including proceedings related to debt, divorce, illicit sex, rape, and slander. Weaving the stories of individual women together with systematic analysis of gendered litigation patterns, Cornelia Dayton argues that women's relation to the courtroom scene in early New England shifted from one of integration in the mid-seventeenth century to one of marginality by the eve of the Revolution. Using the court records of New Haven, which originally had the most Puritan-dominated legal regime of all the colonies, Dayton argues that Puritanism's insistence on godly behavior and communal modes of disputing initially created unusual opportunities for women's voices to be heard within the legal system. But women's presence in the courts declined significantly over time as Puritan beliefs lost their status as the organizing principles of society, as legal practice began to adhere more closely to English patriarchal models, as the economy became commercialized, and as middle-class families developed an ethic of privacy. By demonstrating that the early eighteenth century was a crucial locus of change in law, economy, and gender ideology, Dayton's findings argue for a reconceptualization of women's status in colonial New England and for a new periodization of women's history.

Book excerpt: Insubordinate Spirit is a unique exploration into the life of Elizabeth Winthrop and other seventeenth-century English Puritans who emigrated to the rough, virtually untouched wilderness of present-day New England. Excerpts from newly discovered personal diaries and correspondence provide readers with not only fascinating insights into the hardships, dangers, and losses inherent to English and Dutch settlers in the 1600s, but also first-hand descriptions of the local Native Americans' family life, allegiances, and society. Caught between the unendurable expectations of her Puritan relatives and land disputes with the neighboring Dutch, Elizabeth Winthrop demonstrated a tremendous strength of resolve to protect her own family and remain true to her heart.
