Book excerpt: In 2007, the Province of Ontario passed a new Endangered Species Act (ESA). Following a year-long review process with stakeholders, the Ontario government, led by the Ministry of Natural Resources (MNR) developed this legislation, which identifies Ontario as the North American leader in species-at-risk protection and recovery, and claims to be the first to combine science-based listing of species at risk with mandatory habitat protection and mandatory recovery planning. This is consistent with an election campaign promise made by the Ontario Liberal party. Regulations guiding the implementation of the new legislation have been approved, along with an expansion in the number of species to be covered, changed roles for affected landowners/land users, and changed impacts on both protected species at risk habitat and on affected landowners in Ontario. The legislation is now being implemented and enforced. The purpose of this paper is to describe the provisions of the Ontario ESA, provide an economic analysis of these provisions, and make recommendations for improvements.

Available in PDF, EPUB and Kindle. Book excerpt: Canada's federal system, composed of ten provincial governments and three territories, all with varying economies and political cultures, is often blamed for the country's failure to develop coordinated policy responses to key issues. But in other federal and multi-level governance systems, the ability of multiple governments to test a variety of policy responses has been lauded as an effective way to build local and national policy. Despite high-profile examples of policy diffusion in Canada, there has been surprisingly little academic study of policy learning and diffusion among provinces. Featuring cutting-edge research, Provincial Policy Laboratories explores the cross-jurisdictional movement of policies among governments in Canada’s federal system. The book comprises case studies from a range of emerging policy areas, including parentage rights, hydraulic fracturing regulations, species at risk legislation, sales and aviation taxation, and marijuana regulation. Throughout, the contributors aim to increase knowledge about this understudied aspect of Canadian federalism and contribute to the practice of intergovernmental policymaking across the country.

Book excerpt: Market globalization and the globalization of environmental concerns have spurred demand for greater international accountability for forest stewardship. In response, a range of multi-lateral governmental and non-governmental initiatives have emerged to redefine the rules of global trade, and demand verification of the legality and/or sustainability of forest products originating from within and outside national boundaries. At the same time there is a lack of transparency and shared understanding about the environmental forest policies that already exist within the world's leading forest producing and consuming countries. The result is that many stakeholders have developed perceptions about a country's regulatory environment that are not consistent with what is actually taking place. This book provides a uniquely detailed and systematic comparison of environmental forest policies and enforcement in twenty countries worldwide, covering developed, transition and developing economies. The goal is to enhance global policy learning and promote well-informed and precisely tuned policy solutions.

Available in PDF, EPUB and Kindle. Book excerpt: States today play a major role in implementing and enforcing environmental laws such as the Clean Air Act, Clean Water Act, and the Resource Conservation and Recovery Act. A thirty year review of ESA identified state leadership in species conservation as a necessary element in better conserving the nation‘s imperiled species, yet the theoretical and practical reasons and applications of an enhanced state role are little understood and have not been subjected to any meaningful analysis. This book, for the first time, presents the legal and policy analysis for federalism considerations in implementing ESA. The book undertakes a comprehensive analysis of the economic rationale for federalism in ESA administration; compares administration of ESA to other major environmental statutes; reviews various tools under the existing Act to enhance state role in species conservation; evaluates major case studies to determine roles the state can play in species conservation and recovery; and concludes with policy recommendations to encourage greater state involvement in species conservation.

Available in PDF, EPUB and Kindle. Book excerpt: In a rapidly changing environment, management of natural resources is essential. Currently the world is undergoing a rapid loss of biodiversity through extinctions caused by human activities. Despite the alarming rate of species endangerment and subsequent loss, efforts to reduce species loss have been met with a number of complications. It is evident that any effective environmental management policy for biodiversity is more likely than not to encroach on private, public and commercial interests. This study investigates implementation successes and challenges specifically of Ontario's Endangered Species Act (OESA) within the larger context of Southern Ontario's land use planning policies (i.e., Greenbelt Act, Oak Ridges Moraine Plan, Niagara Escarpment Plan) and the Biodiversity Strategy. The study explores the roles and capacity of the government and non-government institutions involved in implementing the legislation and identifies gaps through expert interviews. While it was found that together such initiatives have succeeded in raising the public profile of endangered species, difficulty in proper implementation remains. Generally, this arises from a lack of coordination between and within the responsible authorities, lack of meaningful engagement with stakeholders and insufficient institutional capacity. Incongruousness in the process and substance among the mentioned biodiversity conservation and land use planning measures leads to use of regulations without the desired result. Finally, a critique I offered on the single-species approach to conservation taken in the legislation and suggest an alternative approach that is transparent, adaptively managed, and engages stakeholders is suggested.
