Available in PDF, EPUB and Kindle. Book excerpt: This book provides a response to the unexpected challenges imposed on every aspect of today’s maritime business. All chapters of this book are concerned with the single challenge facing the maritime business world – that is, uncertainty. Each chapter deals with a specific area of the maritime business community in an effort to better understand the complicated markets, to seek for a solution of economic or financial sustainability under the pressure of climate changes, to discuss technology as an option for the future, and finally to show how to utilise the big data set for better informed decision- and policymaking that used to be unfeasible in terms of scale and capacity. It is hoped that all those endeavours are considered as the first small step towards practically transforming the industry in line with Schumpeter (1943) as well as academically changing a paradigm of thinking and scientific discovery in line with Kuhn (2012), so that the maritime industry is better informed and prepared, and can greatly contributing to human lives.

Book excerpt: The combination of the Port State Control system that is currently in operation and the tactics employed by the International Maritime Organization (IMO) for the introduction of rules and regulations for safety and pollution prevention at sea, led to the establishment of a system which has the potential to bring about significant changes. These changes extend beyond the area of safety and pollution prevention, reaching areas lying entirely beyond the scope of IMO, and actually affecting directly private maritime law. The relevant provisions of the law of the sea are outlined, in order to define the legal framework within which the regulation process for matters of safety and pollution prevention may operate. Special reference is made to the development of the concept of Port State Control and its emergence as a new, alternative method of enforcement under the guidance of IMO. The study focuses on the modus operandi of IMO and critically evaluates the tactics employed by the organization in pursuing its ends. The book also examines the practices employed by influential port states in enforcing international regulations, and it assesses the reactions of smaller states with large registries, as well as the different sectors of the industry to these developments. These developments will lead to new legislation in the contracting states, with the potential of changing the principles of private maritime law. The author also draws attention to the impact that the ISM Code and the STCW '95 may have on issues of private maritime law, through an analysis of the use of English maritime case law. The book is intended for all involved in shipping law - carriers, shipowners, ship managers, marine insurers, port managers, and others.

Book excerpt: CJEU - The most important cases in the field of direct taxation A great number of cases pending before the European Court of Justice (CJEU) concern the fundamental freedoms and state aid in respect of direct taxation. In particular, the number of infringement procedures brought before the CJEU by the European Commission has been increasing year on year. The CJEU is a driving force in the field of direct tax harmonization. All judgments and pending cases, therefore, have to be carefully analysed by academics as well as practitioners. This book discusses the most important cases in the field of direct taxation pending before or recently decided by the CJEU. Moreover, the national background of these cases is discussed and possible infringements of the fundamental freedoms and State aid rules are analysed. The analyses are presented by esteemed national and European tax law experts. The contributing authors ́ focus on the preliminary questions submitted to the CJEU by the national courts and the CJEU case law could be of relevance for driving future judgments. This book goes to the heart of the national tax systems, exposing hidden obstacles to the fundamental freedoms.

Book excerpt: Towards a Better Port Industry provides professionals in freight transport and maritime logistics, and specifically the port industry, as well as students in these fields, with a better conceptual understanding of the port industry. It includes key insights and best practices for port management and development, and an overview of new trends and developments relevant for developing winning strategies. After an introduction, Chapter 2 offers a new perspective on port governance, in which public interests, corporatization, state-ownership, and shareholder policies take a central role. Chapter 3 explains how new trends and developments affect port development and argues that assuming ‘business as usual’ often leads to major port development mistakes. Chapter 4 deals with port development and discusses all major port development challenges, including granting concessions, developing a port vision, crafting stakeholder support, choosing port performance indicators and creating a port innovation system. The final chapter deals with port development strategies and includes themes such as strategies of port development companies, pricing and business development. This book will broaden professionals’ conceptual understanding of the ports industry, and provide insights on the latest developments in this area. For students, this book provides an industry-focused and non-technical ‘essential reading’ for gaining a deep understanding of the ports industry.

Book excerpt: "This book provides an authoritative analysis of how increasing globalization in the maritime sector challenges the entwined shipping communities of traditional maritime nations. Through an empirical analysis of developments in labor mobility within the maritime sector in Denmark it shows that the shipping companies have been significant providers of competence to the national maritime skills base, but also that their current global factor sourcing choices threaten to dissolve this skills base. These findings have important implications regarding productivity, growth and competitiveness for policy makers and companies in the maritime domain."--Publisher's website

Available in PDF, EPUB and Kindle. Book excerpt: This book focuses on the management of ship operations, an activity that requires integrative knowledge and technical expertise that spans various disciplines. As such, ship operations personnel are expected to be well-versed with aspects of management, economics, engineering, technology and law. Further, ship operations management requires the ability to identify and neutralize threats and to manage risks and make decisions that will optimize costs and contribute to performance improvements. Despite the fundamental nature of ship operations management, no book has ever attempted to reconcile and compile a comprehensive body of knowledge, while pursuing a coherent, structured and systematic approach. This edited volume addresses that fundamental gap in the extant literature, and brings together a wealth of knowledge from experts in their respective fields. Concretely, it explores issues of organization, technical management, crewing and behavioral issues, chartering and post fixture, risk management, finance, legal aspects of international conventions and regulations, attainment of safety, security and marine insurance, as well as ocean governance and sustainability. As such, the book offers a vital reference guide for maritime companies and organizations, while also serving as a teaching supplement in academic and professional maritime programmes.

Chapters in the book highlight how a number of aspects have been affected in the modernization process, such as the adoption of ‘western’ curriculum and English language in schools, the use of animation to boost school student comprehension of texts, the rural–urban divide, pedagogical training to emergent andragogy-dependent market needs, converting ‘local ’ shipping experiences to fill growing ‘global ’ needs, and multilateral environmental adaptation and mitigation mandates being adopted ‘locally.’
