Book excerpt: Uno de los aspectos que contempla la Ley 31/1995, de 8 de noviembre, de Prevención de Riesgos Laborales (en adelante, LPRL) es la protección de los trabajadores en materia de seguridad y salud laboral. Lo más importante de esta normativa gira en torno al derecho del trabajador a ser protegido en su salud; para ello se impondrán ciertas obligaciones al empresario, considerado el principal sujeto responsable pero no el único. Los deberes que se precisan en la Ley son la incorporación de un plan de prevención en la empresa y de equipos de trabajo y de protección individual, la elaboración de un plan de emergencia, informar y formar a los trabajadores, la vigilancia de la salud, la documentación en materia de seguridad y salud, y la coordinación de actividades empresariales. Para determinados colectivos como son los trabajadores menores de edad, los trabajadores temporales y contratados por empresas de trabajo temporal, las trabajadoras en situación de embarazo, parto reciente y lactancia natural; se establecen obligaciones específicas. El incumplimiento por los empresarios de sus obligaciones en materia de prevención de riesgos laborales conllevará ciertas responsabilidades; estas pueden ser administrativas, penales y civiles. Complementando estas, el Real Decreto Legislativo 1/1994, de 20 de junio, por el que se aprueba el Texto Refundido de la Ley General de la Seguridad Social (en adelante, LGSS) constituye la responsabilidad en materia de seguridad social o el recargo de prestaciones.

A continuación se detallan los entresijos de la responsabilidad en materia de Seguridad Social, destinada a compensar al trabajador por los daños acaecidos en el desempeño de su trabajo, la cual se traduce en un Recargo de prestaciones que abonará el empresario en favor del trabajador afectado. Posteriormente se considera la responsabilidad administrativa, de naturaleza pública, tomando como referencia principal el texto de la Ley de Infracciones y Sanciones en el Orden Social, pero sin olvidar mencionar el régimen de la Inspección de Trabajo y Seguridad Social, órgano con potestad sancionadora en esta materia. Prueba de ello son las modificaciones efectuadas tanto a dicha ley como al Reglamento de los Servicios de Prevención, primera y principal norma de desarrollo. La mentada ley recoge la obligación que tiene todo empresario de velar por la seguridad y de que se cumplan unos requisitos mínimos para que los trabajadores puedan realizar sus funciones laborales en las debidas condiciones de protección. De este modo, la exigencia de una actuación preventiva por parte de la empresa desborda el mero cumplimiento formal de un conjunto de deberes y obligaciones, requiriendo la planificación de la prevención desde el momento mismo del diseño del proyecto empresarial, la evaluación inicial de los riesgos inherentes del trabajo y su actualización periódica, así como la ordenación de un conjunto de medidas de acción preventiva. Además, se trata de una acción dinámica que exige una renovación constante. En lógica correspondencia, el ordenamiento jurídico contempla una serie de mecanismos de refuerzo dirigidos a garantizar que los deberes asumidos resultan efectivamente acatados. Entre tales instrumentos ocupa un lugar destacado la exigencia de responsabilidades, que ponen de manifiesto el carácter mixto propio de la normativa preventiva, al permitir tanto la reclamación de indemnizaciones por los daños y perjuicios causados por actos u omisiones culposas o negligentes (responsabilidad civil), como la imposición de sanciones por las infracciones cometidas (responsabilidad administrativa y penal). En el concreto ámbito de la prevención es posible, incluso, una ulterior modalidad de responsabilidad; a saber, la de Seguridad Social o recargo de prestaciones, de naturaleza híbrida.

El análisis se inicia, tras la exposición del objeto del trabajo y de la metodología, con una introducción en la que se explica tanto el origen y evolución histórica de esta figura como su finalidad y naturaleza jurídica. A continuación, se exponen los presupuestos para su aplicabilidad (infracción empresarial y nexo de causalidad) y se estudian, por una parte, el órgano judicial competente para la determinación del importe del recargo, los elementos a tomar en consideración y una serie de supuestos particulares, y por otra, los sujetos responsables del pago del mismo. Más adelante, se detalla el procedimiento administrativo de imposición del recargo (incluyendo determinados problemas procesales) y la recaudación de su importe por la Tesorería General de la Seguridad Social. Además, se exponen cuestiones fundamentales para comprender esta figura como son la prohibición de aseguramiento del recargo o la compatibilidad de responsabilidades. En último lugar, se incluyen las conclusiones obtenidas a partir del análisis del recargo de prestaciones y se cita la bibliografía.

The increased significance of the digital economy has rendered the traditional concept of PE inadequate for the allocation of taxing jurisdiction over the modern, mobile or digital international business. The author’s in-depth analysis explains the legal elements of the PE principle with attention to their continuing benefit and their shortcomings: criteria defining a PE- place of business, location, right of use, duration, business connection, business activity, ordinary course of business; evidence of a right of use to a place of business; business activities included in the PE concept of the tax treaties; identification of projects offshore and onshore; UN model treaty deviations from the OECD agency clause; distinction between jurisdictions with significant natural resources and countries possessing the capital, technology and know-how necessary to explore and exploit these resources; and how policies in each country may erode the PE concept.
