Book excerpt: The National Energy Board publishes reasons for decisions when it expects its decisions to influence actions beyond the particular case that was heard. In 2006 and 2007, in response to apportionment concerns on the Trans Mountain pipeline system, Terasen Pipelines (Trans Mountain) Inc. (now Trans Mountain Pipeline Inc.) submitted a series of applications to the National Energy Board of revisions to the Trans Mountain Tariffs. Four of these applications proposed significant and controversial changes to the capacity allocation procedures on the pipeline system. The Board's decisions on these applications, with reasons, were released 15 March 2006, 12 April 2006, 20 July 2006 and 16 August 2007. This document compiles these four decisions for ease of reference.--Includes text from document.

Book excerpt: On 27 February 2009, Keystone applied to the Board for a CPCN under section 52 of the National Energy Board Act (NEB Act or Act) authorizing Keystone to construct and operate the Keystone XL Pipeline, and for an approval pursuant to Part IV of the NEB Act for the toll methodology and tariff. The Keystone XL Pipeline Project consists of the construction of approximately 529 kilometres (km) of new 914 millimetre outside diameter (nominal pipe size 36 inch) pipeline from Hardisty, Alberta to Monchy, Saskatchewan. The Project will also include related physical works including: eight pump stations, storage tanks and other related works and activities including 32 mainline valves, cathodic protection for the pipeline, and pig launcher and receiver facilities. This report provides an overview of the matters considered by the Board in reaching a decision on the Application. Details of the Board's assessment of issues identified by the Board or by parties to the proceeding are set out in these Reasons. In coming to its findings, the Board considered all of the evidence on the record in this matter including economic feasibility, commercial impact, tolls and tariffs, engineering, land matters, Aboriginal concerns, environment and socio-economic matters, and the public interest.--Includes text from document.

Book excerpt: Supreme Court of Canada decisions have defined a general framework for the "duty to consult" Aboriginal peoples and accommodate their concerns over natural resource development, but anticipate the details of that framework will be expanded upon in the future. Aboriginal Consultation, Environmental Assessment, and Regulatory Review in Canada offers a paradigm that advances that discussion. It proposes an integrated and robust planning model for natural resource extraction allowing Aboriginal peoples, industry, governments, tribunals, and the Courts to all make contributions to reconciliation in the context of sustainable development and environmental protection. Kirk Lambrecht surveys the law of actual and asserted Aboriginal rights and historical and modern Treaty rights in Canada and discusses the national and international purposes of environmental assessment and regulatory review. He appraises the fundamental principles of Supreme Court of Canada jurisprudence defining aboriginal consultation and accommodation as a constitutional imperative and uses case studies involving the National Energy Board to demonstrate how integrated process has evolved over time. Finally he offers general conclusions on the practical utility, and outstanding challenges, involving an integrated planning paradigm.

Available in PDF, EPUB and Kindle. Book excerpt: During the past thirty years, international trade agreements have focused increasingly on areas of provincial jurisdiction. In The Provinces and Canadian Foreign Trade Policy, Kukucha argues that Canadian provinces have maintained a level of autonomy in response to these developments, sometimes even influencing Canada's global trade relations and the evolution of international norms and standards. The first comprehensive review of provincial foreign trade policy in Canada, the book highlights the convergence of debates related to federalism, Canadian foreign policy, and the global political economy as they are played out in the negotiation and implementation of international trade agreements. It will be of interest to students and practitioners of political science, public policy, and economics.

Available in PDF, EPUB and Kindle. Book excerpt: Rapidly rising carbon emissions from the intense development of Western Canada’s fossil fuels continue to aggravate the global climate emergency and destabilize democratic structures. The urgency of the situation demands not only scholarly understanding, but effective action. Regime of Obstruction aims to make visible the complex connections between corporate power and the extraction and use of carbon energy. Edited by William Carroll, this rigorous collection presents research findings from the first three years of the seven-year, SSHRC-funded partnership, the Corporate Mapping Project. Anchored in sociological and political theory, this comprehensive volume provides hard data and empirical research that traces the power and influence of the fossil fuel industry through economics, politics, media, and higher education. Contributors demonstrate how corporations secure popular consent, and coopt, disorganize, or marginalize dissenting perspectives to position the fossil fuel industry as a national public good. They also investigate the difficult position of Indigenous communities who, while suffering the worst environmental and health impacts from carbon extraction, must fight for their land or participate in fossil capitalism to secure income and jobs. The volume concludes with a look at emergent forms of activism and resistance, spurred by the fact that a just energy transition is still feasible. This book provides essential context to the climate crisis and will transform discussions of energy democracy. Book excerpt: This book traces the interacting histories of the disciplines of ecology and economics, from their common origin in the ancient Greek concept of oikonomia, through their distinct encounters with energy physics, to the current obstruction of neoliberal economics to responses to the ecological and climate crisis of the so-called Anthropocene. Reconstructing their constitution as separate sciences in the era of fossil-fuelled industrial capitalism, the book offers an explanation of how the ecological sciences have moved from a position of critical collision with mainstream economics in the 1970s, to one of collusion with the project of permanent growth, in and through the thermal crisis of the biosphere.

Available in PDF, EPUB and Kindle. Book excerpt: First World Petro-Politics examines the vital yet understudied case of a first world petro-state facing related social, ecological, and economic crises in the context of recent critical work on fossil capitalism. A wide-ranging and richly documented study of Alberta’s political ecology – the relationship between the province’s political and economic institutions and its natural environment – the volume tackles questions about the nature of the political regime, how it has governed, and where its primary fractures have emerged. Its authors examine Alberta’s neo-liberal environmental regulation, institutional adaptation to petro-state imperatives, social movement organizing, Indigenous responses to extractive development, media framing of issues, and corporate strategies to secure social license to operate. Importantly, they also discuss policy alternatives for political democratization and for a transition to a low-carbon economy. The volume’s conclusions offer a critical examination of petro-state theory, arguing for a comparative and contextual approach to understanding the relationships between dependence on carbon extraction and the nature of political regimes.
