Book excerpt: This paper examines the effects on conduct and performance of allowing members of an industry-wide research joint venture to exercise a greater monopoly power in the downstream product market. I identify necessary and sufficient conditions for joint commercialization of cooperative research outcomes to raise equilibrium cooperative R & D investments in cost reduction, final output, and social welfare. The main findings are (1) an increased product-market collusion increases firm profit but may increase or decrease cost-reducing R & D investments; (2) full product-market collusion is not socially optimal; (3) if product-market collusion does not increase R & D spending or if R & D cost function is sufficiently convex, no product-market collusion is socially optimal; and (4) a higher spillover rate in R & D makes it more likely that product-market collusion benefits consumers and increases social welfare.

The paper shows that (i) full cooperation leads to better results in terms of R&D efforts compared with non-cooperation; (ii) collusion at the production stage may increase both producers' and consumers' surplus especially when the degree of spillovers is not too high and the products are not homogeneous; (iii) the gains in terms of social welfare from full cooperation increase when the efficiency of R&D decreases.

The literature on the theory of collusion is deep and broad but most of that work does not take account of the possible illegality of collusion. Recently, there has been a growing body of research that explicitly focuses on collusion that runs afoul of competition law and thereby makes firms potentially liable for penalties. This book, by an expert on the subject, reviews the theoretical research on unlawful collusion, with a focus on two issues: the impact of competition law and enforcement on whether, how long, and how much firms collude; and the optimal design of competition law and enforcement. The book begins by discussing general issues that arise when models of collusion take into account competition law and enforcement. It goes on to consider game-theoretic models that encompass the probability of detection and penalties incurred when convicted, and examines how these policy instruments affect the frequency of cartels, cartel duration, cartel participation, and collusive prices.
