Book excerpt: A ideia de ampliar o acesso à justiça, preconizada por Cappeletti no Projeto Florença[1] de 1978, impulsionou diversas reformas legislativas ao final do século XX, com o objetivo de gerar maior democratização da Justiça. Em especial, no Brasil, assistimos à implementação de mecanismos de notória popularização da Justiça, quais sejam, o fomento dado às defensorias públicas, a criação de ações específicas e procedimentos diferenciados para a tutela de interesses coletivos lato sensu e também a inauguração dos Juizados Especiais. Entretanto, a amplitude da justiça a todos gerou uma explosão de litigiosidade, face ao aumento progressivo das causas levadas ao crivo do Judiciário e à consequente morosidade do sistema. A fim de trazer uma solução frente ao problema, foram levadas a cabo reformas no Judiciário com o intuito de controlar o acesso à justiça e, notadamente, desafogar as pautas dos Tribunais Superiores. Essa fase teve marcos processuais significativos como as súmulas vinculantes[2], o requisito da repercussão geral[3] nas questões constitucionais e o fortalecimento de um peculiar sistema de precedentes no Brasil. O presente trabalho pretende debruçar-se sobre a evolução do sistema de precedentes no Brasil, abordando a tendência de aproximação entre os sistemas Common Law e Civil Law e as feições peculiares que a valorização dos precedentes assumiu em nosso ordenamento. Será tratada a problemática que envolve a aplicação dos precedentes judiciais em nosso país, e se os mesmos proporcionam, de fato, a mais correta aplicação do direito. Também serão analisados alguns dos fatores que impulsionaram as recentes reformas de valorização dos precedentes e súmulas no Brasil. Tais fatores vão desde a crise do judiciário, o ideal de celeridade já preconizado pela EC 45/04 e o apego pela eficiência meramente quantitativa, tal como contemplada nas metas de produtividade impostas pelo CNJ. [1] O projeto Florença de Acesso à Justiça (Florence Access-to-Justice Project), fundado pela Fundação Ford e pelo Conselho Nacional de pesquisa Italiana, co-dirigido por Mauro Cappelletti e Earl- Johnson Jr., envolveu 23 países na década de 70, buscando perceber as possíveis soluções técnicas para os problemas de seus sistemas. [2] A Emenda Constitucional nº 45, de 08.12.04, acrescentou à Constituição Federal o art. 103-A, que institui a súmula de efeito vinculante, dispondo que o STF poderá, de ofício ou por provocação, mediante decisão de dois terços dos seus membros, após reiteradas decisões sobre matéria constitucional, aprovar súmula que, a partir de sua publicação na imprensa oficial, terá efeito vinculante em relação aos demais órgãos do Poder Judiciário e à administração pública direta e indireta, nas esferas federal, estadual e municipal. [3] A Repercussão Geral das questões constitucionais foi introduzida pela Emenda Constitucional nº 45, de 08.12.04, criando um filtro para admissão dos Recursos Extraordinários, qual seja, a demonstração de relevância (jurídica, social, política ou econômica) e transcendência da questão debatida.
