Cette anticipation ressort en premier lieu du développement du régime normatif. Ce développement se manifeste à travers l'affinement qualitatif des mesures de lutte contre la pollution, l'expansion du champ opératoire du régime encadrant désormais aussi bien le comportement de l'Etat dans son ordre interne que son comportement dans l'ordre international dans la conduite de ses activités à risque, et enfin l'expansion du régime aux acteurs non étatiques à travers la reconnaissance des droits et obligations d'ordre procédural aux individus et acteurs privés. En second lieu, l'anticipation du dommage se manifeste à travers le développement du régime institutionnel. Le renforcement accru du rôle des institutions de bassin est mis en lumière. Sous l'effet de la nécessité de développer davantage les normes de comportement, les institutions de bassin se sont vues investies de compétences et de pouvoirs d'action variés, aussi bien dans l'élaboration des normes que dans la surveillance de leur mise en oeuvre.

At the international level the trend towards providing an increased protection to certain marine spaces has also been reflected in a number of treaties and declarations. This volume reviews the recent developments in the field of specially protected marine areas and preservation of the marine environment in general with particular emphasis on a specific region, the Mediterranean Sea. Special attention is devoted to the latter for three reasons. First, the regional framework for the protection of the environment in the Mediterranean (the so-called Barcelona system) has recently been updated and strengthened. Second, the Mediterranean is a typical example of the category of semi-enclosed seas where international cooperation between the bordering States should be particularly encouraged in various fields; this also explains why the scope of this book has been enlarged to also cover fisheries, a field which is closely connected to the sustainable development of marine areas.
