En Suisse plus de 1200 enfants de 0 à 4 ans ont été concernés par le divorce de leurs parents. Les chiffres varient selon les années pour atteindre parfois plu de 2000, ce qui démontre que la problématique n'est pas négligeable. Ainsi des décisions de type de garde inadéquates pour les très jeunes enfants, peuvent engendre des pathologies importantes à l'âge adulte. Outre des éléments statistiques, le travail mentionne les revendications égalitaires des mouvements de condition paternelle qui militent pour l'équivalence parentale, mettant en exergue l'égalité relationnelle entre père et mère avec un tout petit enfant. S'appuyant sur des considérations socioculturelles et scientifiques par le biais d'experts reconnus, et notamment sur le fait que la mère travaille moins et qu'elle est de fait plus à la maison, les lobbies des pères affirment qu'elle peut nouer une relation plus proche avec un enfant en bas âge. Mais si la situation était inversée, la relation du nourrisson et du petit enfant serait pour le père, identique à celle de la mère. De part la reconnaissance de l'apport paternel auprès du bébé et du tout petit enfant, et aussi sous la pression des revendications égalitaires en matière parentale, les législations changent. On observe un débat nourri sur le plan européen notamment en Belgique qui, au moment de l'élaboration de ca travail, débattait sur l'automaticité de la garde partagée et de l'autorité parentale conjointe quel que soit l'âge de l'enfant. Outre des considérations juridiques suisses relatives aux relations personnelles, le travail présente quelques législations européennes et s'attarde sur la législation française relative à l'autorité parentale, la loi de 2002, objet de critiques controversées des scientifiques reconnus dans le monde de l'enfance. Le travail aborde la position des chercheurs et notamment celle du Dr Maurice Berger, psychanalyste et pédopsychiatre français concernant la garde alternée des enfants de 0 à 6 ans, et la primauté relationnelle de la maman auprès du petit enfant. Dès lors qu'il est séparé trop longtemps de sa mère, sa figure d'attachement principale, le bébé et le tout petit enfant peuvent éprouver des angoisses, et les manifester par une pathologie conséquente pouvant mettre en péril leur évolution. La garde partagée pour des enfants en bas âge n'apparaît pas comme une alternative adéquate. La loi française sur l'autorité parentale et d'autres législations européennes fabriqueraient ainsi des pathologies. L'auteur expose les propositions du Dr Berger concernant les relations personnelles, s'appuyant sur les recommandations de T. Berry Brazelton et Greensplan pédopsychiatre américains de renommée mondiale. Aux antipodes de ces propositions, il mentionne celles d'Elisabeth Badinter, agrégée de philosophie et écrivain en France, affirmant l'égalité du père avec la mère lors du maternage auprès du nourrisson et de l'enfant en bas âge. Le débat est loin d'être terminé sur cette question. Le travail fait part des résultats d'une enquête, menée auprès des travailleurs sociaux masculins et féminins oeuvrant dans les services de protection de l'enfance en Suisse romande. Que pensent-ils de la garde alternée et quelles relations personnelles préconisent-ils pour de très jeunes enfants ? Il résume des opinions au travers d'entretiens complémentaires que l'auteur aura menés auprès de professionnels de la magistrature valaisanne, d'un avocat et d'une pédopsychiatre. Il ressort de l'enquête et des entretiens une propension à préconiser des relations personnelles courtes mais fréquentes auprès du parent qui n'a pas la garde, ainsi qu'une proposition majoritaire affirmant la primauté de la relation maternelle avec le nourrisson et le tout petit enfant. En conclusion, l'auteur souligne la difficulté pour les intervenants en protection de l'enfant, de conscientiser les parents sur les besoins de leurs enfants, et recommande l'utilisation du timing du Dr Berger concernant les relations personnelles.
